HomeMy WebLinkAbout4 Truckee River Trail easement Agenda Item # sPublic Utility �i Memorandum To: Board of Directors From: Peter Holzmeister Date: July 26, 2007 Subject: Truckee River Trail easement Why this matter is before the Board: This matter involves a request from the Town of Truckee that our District convey easements to the Town to enable them to maintain the Truckee River Trail. History: You are probably familiar with development of the Truckee River Trail. That trail crosses over land owned by TDPUD in three places. Two of those places are within the Regional Park that we have leased to the Truckee Donner Park and Recreation District. The third piece of TDPUD land that is crossed is at the Martis Valley Substation. Several years ago we conveyed an easement to the Recreation and Park District for purposes of allowing the Trail to cross the Martis Valley parcel. At that time everyone believed that the Recreation and Park District. The Trail was planned to cross two of our parcels in the Regional Park, but since that property was already under lease to the Recreation and Park District there was no need for us to grant them an easement for the Trail. New information: Now things have changed. The Town of Truckee will be maintaining the Trail. So easements need to be established in the name of the Town of Truckee. The easement we conveyed to the Recreation and Park District at Martis Valley Substation needs to be rescinded by action of the Recreation and Park District and then convey by TDPUD to the Town. Two new easements across the parcels in Regional Park need to be conveyed to the Town, with concurrence of the Recreation and Park District. Attached is a letter from Dan Wilkins, Public Works Director/Town Engineer, describing this entire matter and including maps and other supporting documents. I believe Dan will be at the meeting to help discuss this. The goal for the Truckee River Trail corridor in the Town of Truckee Trails and Bikeways Master Plan is to provide a multi-purpose trail connection across the Town of Truckee, along the Truckee River, connecting Donner Lake to the Glenshire Subdivision. With this letter, the Town would like to document a proposal to Truckee Donner Public Utility District (TDPUD) regarding the transferring of ownership and granting of easements along Phase 1 of the Truckee River Trail for purposes of paving and maintaining the trail. Truckee Donner Recreation and Parks District(TDRPD) currently holds easements through ore TDPUD-owned parcel (APN 19-450-45) for Phase 1 of the Truckee River Trail, as shown in Attachment A. The trail travels through two additional TDPUD-owned parcels (APN 19-450-53 and 19-450-54) for which no easements currently exist. A portion of the Truckee River Trail is currently constructed of a Class 2 aggregate base material. The Town has identified funding in the FY 2007/2008 budget to pave this section of trail with asphalt concrete, consistent with the Town of Truckee Trails and Bikeways Master Plan. The Town and TDRPD have agreed upon the Town taking over ownership and maintenance responsibilities of the Truckee River Trail, provided that the underlying landowners of the trail are also agreeable to this change in ownership and responsibility. A copy of the letter from TDRPD concurring with this agreement is attached to this letter(Attachment B). With this letter the Town would like to formally request that the easement through APN 19-450- 45 be transferred from TDRPD to the Town of Truckee. The Town will take the lead on the logistics of accomplishing this task, assuming that TDPUD is willing to allow the easement to be transferred and/or granted. The transfer of the easement would essentially require that TDRPD abandon their existing easement through TDPUD property. I have attached the easement plat and legal description that were prepared by Sagebrush Surveying in 1998 for the easement dedication to TDRPD (Attachment Q. In addition, and as shown in Attachment A, a portion of the trail runs through APNs 19-450-53 and 19-450-54. These parcels are also owned by TDPUD but no easement was dedicated to TDRPD because it is to be part of the Truckee Regional Park. Therefore, if the Town were to take over ownership and maintenance of the trail through this parcel, it would be necessary to create easement through the parcels with accompanying legal and new plats and legal descriptions. In 2000, the Town retained Gary Shuart, a licensed land surveyor, to begin the preparation of the easement documents for this portion of the trail, the results of which are provided in Attachment D. However, once the trail was complete it was decided that TDRPD would maintain ownership of the trail for the time being, and so these easements were never created. Therefore, the Town is in the process of retaining a surveyor to prepare and complete the plat and legal description documents, which we will forward to you when available. Based upon the TDPUD's overall support for the Truckee River Trail project, the Town hopes that the transfer of ownership of these easements from TDRPD to the Town of Truckee is generally acceptable to TDPUD. As such, the Town would respectfully request that the TDPUD Board consider this action. I would like to thank TDPUD, on behalf of the Town, for its continued cooperation and partnership in improving this important community asset. The board took the following action: The District accepts the proposal from the Town of Truckee to take over phases 1 and 2 of the Truckee River Legacy Trail and the plan that specifies the paving of the trail. The District will release our easements to the Town of Truckee allowing the Town to renegotiate with land owners. The Town will take over the responsibility of maintenance and liability of the trail from Regional Park to River View Sports Park. The trail and any paving in Regional Park cannot be wider than the current existing multi use trail in existence now. This letter confirms the District's action to transfer ownership of the Truckee River Legacy Trail from Regional Park to River View Sports Park to the Town of Truckee.
