This item relates to a discussion of the requirement to send a notice to water customers annually describing the District's water quality. Truckee Donner PUD New Early Conservation Programs Proposal May,2007 California has traditionally been a leader in promoting energy conservation and has decided to step up this commitment in the last few years by enacting several pieces of new energy legislation. Truckee Donner PUD has been promoting energy conservation for over a decade and has made a commitment to step up its conservation programs. TDPUD would like to get on board with the conservation movement by enhancing its existing programs and adding some new ones quickly. Then over time, TDPUD with the help of a newly forming TDPUD Conservation Committee can add a multitude of new programs. Below is a proposal for conservation activities TDPUD staff can implement in the next few months. Proposed TDPUD Conservation Programs Basic Qualifications: An applicant must be a TDPUD electric customer to participate in TDPUD's electricity energy conservation programs. TDPUD water only customers can participate in the clothes washer rebate program. Applicants must fill out a TDPUD Conservation Program application and attach their original invoice to verify the purchase of energy-efficient measures and appliances. A TDPUD conservation staff person may call for an on-site appointment to verify the installation of the conservation measure(s) before issuing a conservation rebate from TDPUD. Conservation Program Marketing TDPUD conservation staff will be working with a local marketing firm to create a marketing plan and marketing pieces to promote TDPUD's conservation programs. The following are marketing elements planned to be included in the conservation marketing program: TDPUD Newsletter, Bill Stuffer, Message on Customer Bill, Website, Local Media including: newspapers, TV, radio, other publications including Green Building Resource Guide. Lighting Programs Residential Lighting Change Out Description: The purpose of a residential lighting rebate program is to encourage TDPUD customers to replace their existing incandescent light bulbs in their homes and multi- family dwelling units with fluorescent light bulbs as a result of receiving a cash rebate. This is a proposed new program. People are beginning to realize that changing out incandescent lighting to fluorescent lighting is very low-cost ($75/average household) and cost-effective(<1 year simple payback)measure to reduce their energy bill. Incentive: The rebate is proposed to be $1 per compact fluorescent bulb replacing an incandescent light bulb. The program is proposed to be designed so that multi-family dwellers must purchase and install at least 5 fluorescent light bulbs and residents of single-family homes must install at least 10 fluorescent light bulbs to receive the $1 per fluorescent bulb rebate. The rebate will be placed as a credit on the customer's bill. Program Logistics: 1) TDPUD markets rebate programs. Customer may want to call conservation staff to verify program qualifications, 2) Customer turns in application with original invoice attached for rebate, 3) Staff then reviews for eligibility and processes rebate request, records activity in report and provides customer with credit on their TDPUD utility bill. Conservation program element budget: 2007- $10,000 Low-Income Lighting Change Out Description: The purpose of this residential lighting rebate program is to encourage lower-income TDPUD customers to replace their existing inefficient incandescent light bulbs with fluorescent light bulbs as a result of receiving free fluorescent light bulbs. This is a proposed new program. Incentive: Lower-income TDPUD customers will receive free compact fluorescent light bulbs for replacing existing incandescent light bulbs in their dwellings. The program may be designed so that TDPUD staff can visit low-income TDPUD customers where they live. Truckee's trailer parks include many residents on limited incomes. Program Logistics: 1) TDPUD markets residential low-income lighting program and TDPUD staff will arrange visits to lower income households, multi-family locations including trailer parks, etc. Customer may want to call conservation staff to verify program qualifications, 2) Staff schedules a visit to low-income housing areas and plans to assist lower income family in installing fluorescent light bulbs in as many housing units as possible. Return trips may be necessary to make sure all interested households receive their light bulbs, 3) Staff then records activity in report. Conservation program element budget: 2007- $3,000 Commercial Lighting Change Out Description: The purpose of a commercial lighting rebate program is to encourage TDPUD business customers to replace their existing inefficient light bulbs or lighting systems with new, high energy efficiency light bulbs and lighting systems as a result of receiving a cash rebate. This is a proposed new program. This proposed program is a very common approach to encouraging businesses to upgrade to high efficiency lighting. Incentive: Commercial customers will receive a conservation rebate equal to 1/3 the cost of qualifying lighting measures/fixtures purchased and installed. The rebate applies to both the capital purchase of lighting measures as well as the labor cost to install the new, high efficiency lighting fixtures and lamps. Lamp/fixture change-outs must be replaced with T-8 lamps with electronic ballasts or more energy-efficient options. Program Logistics: 1) TDPUD markets rebate programs. Customer may want to call conservation staff to verify program qualifications, 2) Customer turns in application for rebate and staff inspection, 3) Staff calls customer and makes appointment to come out and verify light bulbs and lighting systems were installed as specified, 4) Staff then processes rebate request, records activity in report and TDPUD mails customer a check. Conservation program element budget: 2007- $20,000 Appliance Rebate Program Clothes Washers Description: The purpose of a clothes washer rebate program is to encourage TDPUD customers to go to a higher efficiency clothes washer model than currently planned as a result of receiving a cash rebate. The clothes washer provides TDPUD and its customers with a dual benefit of energy and water savings. This is an existing program and it is proposed that TDPUD change the rebate level from $50 to $100. Incentive: Must be a front-loading model to receive the $100 rebate. Other Utility Incentive programs: See attached spreadsheet. Program Logistics: 1)TDPUD markets rebate programs. Customer may want to call conservation staff to verify qualifying clothes washer models, 2) Customer turns in application with attached original invoice for rebate, 3) Staff then processes rebate request, records activity in report and TDPUD mails customer a check. Conservation program element budget: 2007- $3,000 Refrigerators Description: The purpose of a refrigerator rebate program is to encourage TDPUD customers to go to a higher efficiency refrigerator model than currently planned as a result of receiving a cash rebate. This is an existing program and it is proposed that TDPUD change the rebate level from $50 to a range of$50-150 based on efficiency. Refrigerator Recycling- A new requirement added this year to the Refrigerator Rebate program is that you will need to give up your old refrigerator to be recycled by a TDPUD contracted recycling company to receive the rebate. TDPUD will have the refrigerator recycling company make an appointment with you to come and pick up your old refrigerator from your home or business. TDPUD will pay the cost of removing your old refrigerator and having it recycled. Incentive: Scale begins at Energy Star for$50 rebate. A refrigerator that exceeds Energy Star by 8% will receive a$100 rebate and by 15% a$150 rebate. Customers replacing an existing refrigerator must work with TDPUD to recycle their old refrigerator. Program Logistics: 1) TDPUD markets rebate programs. Customer may want to call conservation staff to verify qualifying refrigerator models, 2) Customer turns in application for rebate with attached original invoice, 3) Staff then processes rebate request, records activity in report and TDPUD mails customer a check. Conservation program element budget: 2007- $7,000 Dishwashers Description: The purpose of a dishwasher rebate program is to encourage TDPUD customers to go to a higher efficiency dishwasher model than currently planned as a result of receiving a cash rebate. This is a proposed new program with a proposed rebate range of$50-150 based on efficiency. Incentive: Scale begins at Energy Star for$50 rebate. A dishwasher receiving an Energy Factor rating of between .74 - .80 will receive a$100 rebate and an Energy Factor rating of.81 or greater a$150 rebate. Program Logistics: 1) TDPUD markets rebate programs. Customer may want to call conservation staff to verify qualifying dishwasher models, 2) Customer turns in application for rebate with attached original invoice, 3) Staff then processes rebate request, records activity in report and TDPUD mails customer a check. Conservation program element budget: 2007- $3,000 Water Heater Program Electric Water Heaters Description: The purpose of an electric water heater rebate program is to encourage TDPUD customers to go to a higher efficiency electric water heater model than currently planned as a result of receiving a cash rebate. This is an existing program. Incentive: stay with the existing $2 per gallon/rebate. To qualify for the rebate water heaters less than 60 gallons must have an Energy Factor of.93 or higher. Electric water heaters 60 gallons and larger must have an Energy Factor of.91 or higher. Program Logistics: 1) TDPUD markets rebate programs. Customer may want to call conservation staff to verify qualifying electric water heater models, 2) Customer turns in application for rebate with attached original invoice, 3) Staff then processes rebate request, records activity in report and TDPUD mails customer a check. Conservation program element budget: 2007- $5,000 Space Heating Program Ground Source Heat Pumps Description: The purpose of a ground source rebate program is to encourage TDPUD customers to go to a higher efficiency electric ground source heat pump model than currently planned as a result of receiving a cash rebate. This is an existing program proposed to stay with the existing $2 per gallon/rebate. Incentive: stay with the existing rebate level of$200/ton. Program Logistics: 1) TDPUD markets rebate programs. Customer may want to call conservation staff to verify program qualifications, 2) Customer turns in application for rebate and staff inspection, 3) Staff calls customer and makes appointment to come out and verify a ground source heat pump was installed as specified, 4) Staff then processes rebate request, records activity in report and TDPUD mails customer a check. Conservation program element budget: 2007- $15,000 Building Diagnostics & Mitigation Building Envelope Blower Door Leakage Test & Central Air Distribution System Leakage Test Description: the purpose of the building envelope and central air distribution diagnostics rebate program is to encourage TDPUD customers to have their building envelopes(floors, walls and ceilings)tested for air leakage to determine potential for space heating & cooling energy savings. This is an existing program. Incentive: Reduce incentive from $100 to $75 rebate per home or business receiving a blower door or duct blaster test. This equates to about 1/3 the cost of a test, but does not ensure the mitigation work gets done. Program Logistics: 1) TDPUD markets rebate programs. Customer may want to call conservation staff to verify program qualifications, 2) Customer turns in application for rebate with attached original invoice, 3) Staff then processes rebate request, records activity in report and TDPUD mails customer a check. Conservation program element budget: 2007- $2,500 Building Envelope Blower Door Leakage Mitigation & Central Air Distribution System Leakage Mitigation Description: the purpose of the building envelope and central air distribution air leakage mitigation rebate program is to encourage TDPUD customers to have their building envelopes (floors, walls and ceilings) sealed for air leakage for space heating & cooling energy savings. This is a newly proposed program. This program is designed for homes that use electric space heating and cooling. Incentive: Proposed rebate is $250 for building envelope sealing, $250 for duct sealing and neither rebate incentive will exceed 50% of mitigation cost. Program Logistics: 1) TDPUD markets rebate programs. Customer may want to call conservation staff to verify program qualifications, 2) Customer turns in application for rebate with attached original invoice, 3) Staff then processes rebate request, records activity in report and TDPUD mails customer a check. Director Sutton indicated that she had not heard anything about the lawsuit. On January 17, 2005 Robert Clarke, the on-call electric lineman, was involved in a vehicle accident where an adult woman (Cynthia Billings) and three small children (Derek Billings, Caitlin Billings and Lindsey House) were involved. On January 19, 2005 1 notified the insurance company about the accident. On May 25, 2005 the District received claims for damages presented to the District by the injured parties. On June 1, 2005 Peter and I presented the claims for damages information to the Board in executive session. After executive session, the Board took action to deny all four claims that had been presented. On January 4, 2006 the District was served with two summonses, one from Cynthia Billings and the other from Debbie House the mother of Lindsey House. On January 5, 20061 sent the Board a confidential memorandum telling you that we had received the summonses and that the item was scheduled for discussion in executive session on January 18, 2006. On October 23, 2006 we received a letter from Douglas M. (Gregory) Kilduff the attorney hired by the insurance company to defend the District which stated that the lawsuits had been settled in their entirety. I have attached a copy of the letter. While the letter does not say how much the insurance carrier had to pay out to settle the claims, Keith Grand indicated during the board meeting that the amount paid out was approximately $136,000. 1 followed up with Keith regarding the amount. The exact amount was $136,719.77 which included $12,846.29 in attorney fees and a reimbursement to the District in the amount of $5,862.91 for the District vehicle that was totaled in the accident. American Home Assurance Company was the insurer at the time and was part of the rural electric program offered by AIG during the 2004-05 policy year. I hope that this answers any questions that the Board may have had relating to these lawsuits.
