DECISION OF THE PRE-DISCIPLINARY HEARING PANEL
IN THE MATTER OF THE PROPOSED DISCIPLINE OF
SCOTT TERRELL
Mr. Scott Terrell was given a NOTICE OF PROPOSED DISCIPLINE
by General Manager Peter Fiolzmeister on January 5, 2007. The proposed.
discipline was a two-week suspension without pay. Under the provisions of
Chapter 4.16 of the `rDPUD Code, a panel of three members of the Board of
Directors were selected by Mr. Terrell to conduct a pre-disciplinary (Skelly)
hearing.
The hearing panel consisted of Directors Sutton, Aguera, and
Thomason. Ms. Sutton acted as Chair of the panel. G. Richard Brown acted
as Special Counsel to the panel.
The pre-disciplinary hearing was held at 2:30 p.m. on Tuesday,
January 30, 2007 at the District office. Peter Holzmeister was present,
represented by attorney Steven Gross. Scott Terrell was present, represented
by attorney Brent P. Collison. At Mr. Terrell's request the hearing was open
to the public.
The three accusations at issue are summarized as follows:`
I. The District Board was considering whether to enter into
a 50-year power supply contract. Mr. Terrell was personally and
professionally opposed to the contract. Mr. Terrell, in his official capacity,
sought to secure legal representation for a group of citizens opposed to the
contract who intended to sue the District if it entered into the contract.
2. Mr. Terrell directly undermined the District's Power
Supply Engineer while the Engineer was working on the contract, resulting
in considerable disruption in the workplace.
3. Mr. Terrell was insubordinate to 1Ir. I-Iolzmeister when,
in a private meeting between the two concerning Mr. Terrell's role in
opposing the contract, Mr. Terrell said 1 know how to get my way.
