9 Alder Drive Pump station CEQA
Agenda Item # 9 Public Utility District Memorandum To: Board of Directors From: Neil Kaufman -Date: March 15, 2007 Subject: Adoption of Alder Drive Pump Station Mitigated Negative Declaration CEQA 1. WHY THIS MATTER IS BEFORE THE BOARD The District is proposing construction of the Alder Drive Pump Station project. Prior to starting construction activities, the District is required to complete an environmental review of the proposed site in compliance with CEQA. 2. HISTORY The 2004 Water Master Plan identified a planned pump station on the northwest comer of Alder Drive and Comstock Drive. The purpose of this pump station is to pump water into the Prosser Heights area from Gray's Crossing and the 6170 Pressure Zone. The District acquired an easement from East-West Partners at this location as part of the Gray's Crossing project. The project involves construction of the pump station building along with the associated site piping and electrical service. In November 2006,the Board approved a contract with Inland Ecosystems to prepare an Initial Study associated with the CEQA review of the Alder Drive Pump Station project. At the January 17, 2007 meeting, the Board of Directors approved the initial study and directed that it be circulated. A public hearing regarding the Alder Drive Pump Station was held on February 7, 2007. No comments were received at the public hearing. On January 18, 2007 the District mailed the Initial Studies for both the Alder Drive Pump Station and Fibreboard Well projects to the State Clearinghouse. The State Clearinghouse received and posted the Initial Study for the Fibreboard Well on January 22, 2007. However, it appears that the Initial Study for the Alder Drive Pump Station was misplaced by the State Clearinghouse and not posted. This problem was discovered on February 9, 2007. A new copy of the Initial Study was sent to the State Clearinghouse the same day. Considering that the Initial Study was not posted by the State Clearinghouse until February 9, 2007 the public comment period was extended until March 12, 2007. A second public hearing was held on March 7, 2007 in the event that some interested parties did not receive adequate notice of the project from the State Clearinghouse. No comments were received at this second public hearing. Page 1 3. NEW INFORMATION The time period for submitting written and oral comments on the CEQA Initial Study has elapsed. No written or oral comments have been received regarding the project. Attached with this memorandum are the Final Mitigated Negative Declaration and Notice of Determination. Filing the Notice of Determination with the State Clearinghouse and Nevada County Clerk completes the CEQA process for the project. 4. RECOMMENDATION I recommend the Board take the following actions regarding the environmental review for the Alder Drive Pump Station Project. 1. Adopt the Final Mitigated Negative Declaration 2. Approve the project for purposes of CEQA. 3. Approve the Mitigated Monitoring Plan. 4. Authorize the filing of the Notice of Determination with the Office of the Nevada County Clerk and the Governor's Office of Planning and Research. 5. Adopt the De Minimis Impact Finding and authorize the filing of the Certificate of Fee Exemption with the Nevada County Clerk. 6. Adopt a finding that the draft documents as circulated and the negative declaration reflect the Districts independent judgment.
