SUBJECT: Authorization to transfer assessment district funds on deposit in restricted funds
to reimburse the water department general fund for maintenance projects completed in
Ponderosa Palisades #4 and Sierra Meadows
#3
1. WHY THIS ITEM IS BEFORE THE BOARD
Only the Board can authorize staff to transfer money from restricted funds.
2. HISTORY
In 1997, Nevada County sent the District surplus assessment district monies from the Ponderosa
Palisades #4 Assessment District and Sierra Meadows#3 Assessment District. At the time, the
Board authorized staff to keep the funds on deposit in restricted accounts. These funds can only
be used for maintenance of the original improvements within the assessment districts.
3. NEW INFORMATION
The District has since spent water department general funds for water maintenance projects
within these two assessment district boundaries. The projects and their costs are listed below:
A) Ponderosa Palisades #4 Leak repair at Blueberry and Aspenwood.
Original amount received from Nevada County = $594.62
Current amount on deposit in restricted funds = $890.72
Total repair cost incurred = $2,988.31
B) Sierra Meadows #3 Leak repairs on Torrey Pine, Jeffrey Pine, Red Fir &Alpine Fir
Amount on deposit in restricted funds = $3,577.25
Current amount on deposit in restricted funds= $5,228.94
Total repair cost incurred = $13,461.33
4. RECOMMENDATION
A) I recommend that the Board n Fund in ze staff to withdraw the balance of the Ponderosa
the amount of $890.72 plus accrued interest
Palisades #4 Improvement to reimburse
the water department general fund for water line repairs.
B) I recommend that the Board authorize staff to withdraw the balance of the Sierra Meadows 3
Improvement Fund in the amount of $5,228.94 plus accrued interest to reimburse the water
department general fund for water line repairs.

Enclosed for final processing please find the agreements for disbursement of surplus assessment
district funds for Ponderosa Palisades 4 and Sierra Meadows 3 and 4 which have been executed
by TDPUD's Board President, J. Ron Hemig.
If further action is required on behalf of the District, please let us know before the June 29, 1997
deadline.

AGREEMENT FOR DISBURSEMENT OF SURPLUS
ASSESSMENT DISTRICT FUNDS
THIS AGREEMENT is entered into this day of 19_, by and
between the COUNTY OF NEVADA, hereinafter referred to as "County," and the Truckee
Donner Public Utility District,hereinafter referred to as "District."
WHEREAS, County possesses certain funds which remain from a levy of assessments
against certain parcels which were within the boundaries of the Ponderosa Pallisades 4_
Assessment District, which.funds are surplus; and
WHEREAS, pursuant to the provisions of California Streets and Highways Code Section
10427, County is authorized.to transfer said surplus funds to the public agencies which own
and/or operate the public facilities which were constructed by and through said Assessment
District.
J RMS AND CONDITIONS
NOW, THEREFORE, the above-named parties agree to the following terms and
conditions:
1. County shall tender to District and District hereby agrees to accept and to use the
surplus assessment district funds in the amount of $594.62, solely for the maintenance of the
improvements which were constructed with the funds raised from the subject assessments.
2. In accepting the tender of the above stated funds, District hereby agrees to
indemnify, defend, and hold harmless the County and its agents and employees from and against
any and all claims, damages, losses, and expenses relating directly or indirectly to the
distribution, disbursement, administration, management and/or use of the surplus assessment
district funds tendered to District under this agreement by the County.
