WHY THIS MATTER IS BEFORE THE BOARD The Board requested that this matter be brought to their attention for a decision. 2. HISTORY Approximately 75 percent(135 miles) of the District's electric distribution system is composed of overhead facilities using wood pole structures. The overwhelming majority of these overhead lines have been constructed along road rights-of-way. There are some areas of the District where overhead lines follow back yard easements including sections of Prosser Lakeview Estates and Sierra Meadows. These are typically single phase tap lines, not three phase main lines. However, there is a area in Donner Lake where a three phase main line cuts across a hillside for approximately 2,000 feet with no easy means of access (see attached Figure 1). The only access to these structures is on foot, which makes outage restoration or maintenance extremely problematic. In order to eliminate these structures, the Electric Department has performed the following actions, briefly summarized below: • Joint Trench with Water Department: In 2004, the Water Department installed a 12inch mainline from the Cedar Point Dr. area to the intersection of Denton Avenue and Pioneer Drive. We had their contractor install a 6 inch conduit and several vaults along this route for a distance of about 2,600 feet. Our portion of the cost was approximately$160,000. This underground system would form the new mainline circuit necessary to replace overhead cross country line. However, a gap existed because our east side electrical connection must occur at the intersection of Reed Ave. and Pioneer Drive, a distance of about 600 feet along the Pioneer Drive right-of-way. • Cedar Point Dr. and West Reed Ave: During 2005 and early 2006, crews installed a padmount switch at Cedar Point Dr. and riser facilities on West Reed Ave. to complete the west and south side underground connections. Crews also started to pull cable into the conduit system. The cost to install these facilities is approximately$110,000. • Pioneer Drive Connection: On the east side of the project, the 600 foot gap along Pioneer Drive, between Denton Ave. and the District's existing 3 phase overhead line at the intersection of Reed Ave. and Pioneer Drive must be closed to complete the mainline circuit connection. Possible construction options included a 4 pole overhead line, an underground line requiring 2 vault structures, or a cross country connection to Reed Avenue. Any cross country connection to Reed Avenue is problematic because it requires the establishment and clearing of new right-of-way along a fairly steep wooded hillside. It has been the District's practice to use established right-of-way corridors, typically road right-of-ways, for the placement of electric facilities as much as possible. This is the preferred method of locating utility facilities because it minimizes associated utility impacts. The underground option along Pioneer Drive was rejected for a number of reasons, including the fact that the District will have spent approximately $270,000 to underground a majority of this route already, taking advantage of joint trenching opportunities with the Water Department. Although the Water Department placed new line in this 600 foot section of Pioneer Drive in 2005, it was installed using slipline, not trench construction methods. This roadway section of Pioneer Drive is narrow, and already contains underground facilities including a water, natural gas and sewer lines. An underground electric conduit and vault system could be installed, but not without great difficulty. Because this neighborhood is an existing overhead electric line area, and sufficient right-of-way and road shoulder areas exist to place pole structures, the overhead pole line alternative was chosen as the best option. 3. NEW INFORMATION In September, 2006 the District engaged Sage Land Surveying to stake the 600 foot section of Pioneer Drive right-of-way between Denton and Reed Avenues. Following the staking of the road right-of-way, the District engaged Harrison Tree Service to clear a 10 foot section road shoulder area (well within the road right-of-way) of trees and brush necessary to build the overhead pole line. I was then contacted by residents in this neighborhood who were concerned because they were depending on some of the trees and brush, which we had removed, to keep their vehicles from sliding over the road embankment during winter weather. They also had questions about placement and alternatives to the proposed overhead line. Some of these residents brought their concerns to a Board meeting in December, 2006. At this meeting, the Board asked that the proposed overhead line extension be agendized for future meeting. 4. RECOMMENDATION Chapter 7.48, Section 7.48.010 of the District's policies states: It shall be the policy of the Truckee Donner Public Utility District to require all new or rebuild construction to be placed underground wherever practical. Special circumstances may dictate undergrounding is not practical and the District reserves the right to determine the practicality of a rp oiect. The installation of overhead electrical facilities to serve single-family dwellings, within an existing overhead subdivision, shall be permitted. All multi-family dwellings, commercial buildings and land parcels that are to be divided into four or more individual lots, shall require the installation of underground facilities regardless of location. Therefore, because of the reasons outlined above and in concurrence with District Policy, I recommend that the Board direct staff to proceed with the construction of a 4 pole overhead distribution line on Pioneer Drive between Denton and Reed Avenues. t ti� T i I 1 rr� a. Remember, your response must be received before Wednesday, April 4 DATE: April 4, 2007 TO: TDPUD Members of the Board FROM: Pioneer/Denton/Reed Property Owners, Donner Lake RE: Proposed TDPUD Overhead Power Line My name is Susan Lindstrom and I'm back here to speak once again on behalf of about 50 residents on Pioneer, Reed and Denton roads at Donner Lake who could not be here tonight. Recall that we're an informal road association and are here to ask that the Board consider our absolute opposition to a current project by the PUD to construct a new overhead power line on our road. As we understand the proposed project, the new overhead line consists of a total of five new poles, not four as stated in the District's staff report. In the span of about 600 feet, wires would cross over Pioneer Drive twice, terminating at a new stub pole at the hairpin, where the line would hook-up to an existing underground power line that extends across open space to the Donner Lake Interchange at Cedar Point Drive. In anticipation of construction of the proposed line in October 2006, the PUD clear-cut trees up to a 20-foot-wide corridor along Pioneer Drive; it was not limited to a 10-foot- wide swath as stated in the staff report. We know that the District has the right to "trim" trees along their line, but does it also have the right to remove them? The residents were not contacted in advance of the clear cut. Recall that the PUD's removal of this vegetation created a safety hazard along our road, requiring the installation of a guardrail. When the TDPUD stated that we would have to pay for most of the guardrail, we appealed to the Board, which concurred with our request. We appreciate the TDPUD ultimately taking responsibility for their actions by financing 60-feet of rail. Guardrail aside, a key issue remains unresolved. At the December meeting, we asked: What is the PUD policy regarding the installation of new overhead power lines within an established subdivision? The question was left unanswered until now, and from the staff report, District policy has been clearly stated, I repeat: It shall be the policy of the Truckee Donner Public Utility District to require all new or rebuild construction to be placed underground wherever practical. Special circumstances may dictate undergrounding is not practical and the District reserves the right to determine the practicality of a project(Chapter 7.48, Section 7.48.010). It seems that the core of the policy statement hinges on "practicality." And, we ask, outside of the ever-present issue of cost, what is so impractical about undergrounding the line between Reed and Pioneer in order to connect to the existing underground line at the intersection of Pioneer and Denton? Why was the 2,600-foot section of new underground line that adjoins Pioneer Avenue practical to construct and ours is not? We know that undergrounding a line is always more expensive than the installation of overhead lines (even though maintenance costs are ultimately reduced.) But, if increased cost is the only factor that makes undergrounding impractical, then when is it ever practical to install an underground line? We believe that the PUD's recommendation for an overhead line on Pioneer Avenue is inconsistent with their policy statement. In an effort to gain some perspective on policies for other utilities districts, we contacted the General Manager for the North Tahoe Public Utilities District, Lee Schegg, and Jack Beckman, District Engineer at the Tahoe City Public Utilities District. We also talked to Phil Carrilo, Operations Manager for the Sierra Pacific Power Company. All were in agreement that new utilities are typically undergrounded, especially in scenic areas. We also learned that SPPC has initiated a program with Placer, Eldorado, Plumas, Sierra, and Nevada counties to establish districts, whereby areas with a high concentration of overhead wires are targeted for the conversion of overhead to underground line. The SPPC has even set aside 2% of their total revenues to pay for the new underground wiring. We bring these examples to the Board's attention to illustrate the clear and growing trend to underground utilities lines. In our particular case, the installation of a new overhead power line on Pioneer Avenue would degrade our existing viewshed of Donner Lake (e.g. W. Reed Avenue). The District justifies their plans "because this neighborhood is an existing overhead electric line area." But, we also have existing underground lines in our neighborhood and this section of Pioneer is currently free of overhead lines. Furthermore, we know that once an overhead line has been established, other utilities join the pole, as is distressingly evident by the spaghetti network of wires than hang on other overhead lines at Donner Lake. On Pioneer, at least seven parcels would be directly affected by the line, lots where residents have lived for up to 40 years. Vistas marred by power lines could substantially reduce our property values, as has been confirmed by a local Donner Lake realtor. In addition. the rural mountain ambiance of our roadway would be forever compromised. Last winter, the District offered to enter into an agreement to underground the line on Pioneer Drive, if we installed it largely at our own expense. We don't believe that the residents of Pioneer/Denton/Reed should have to bear the cost to underground a new overhead line that the District has chosen to build, not us. We maintain that our request to underground the line is consistent with TDPUD policy, in particular, and also with the general trend of public utilities to underground their new lines — especially in the scenic Truckee-Tahoe Basins. We don't believe we've had a fair public process in the planning of this new line. The TDPUD is a public agency, with the objective to have public input — before rather than after the planning. In the PUD staff report, it states that the District's goal is to "minimize associated utility impacts." This certainly has not been the case in our situation. Premature actions taken on the part of the PUD, without public input and without approval of the Board, have already left their indelible mark on our road. We now have a strip clear cut of trees and we now must install a safety guardrail and the project has not even been approved. And, now we are asked to endure a third eye-sore, a new overhead power line. The staff report maintains that "sufficient right-of-way and road shoulder areas exist to place pole structures." We need the road shoulder clear of obstructions, as a turn-out for two cars to pass along this steep pitch of road, and also we need this open space to store snow. The PUD would have to move poles far to the outside edge of the shoulder and doing so may require that yet another strip of trees be clearcut. The staff report also maintains that an underground line could only be constructed with "great difficulty" given existing underground utilities. This section of road and shoulder is at least 20 feet wide. There must be some remaining space for a new electrical line, even if installation had to slightly encroach into paving. In summary, we believe that there is no "impracticality" that would preclude the installation of an underground utility line on Pioneer Avenue, and in doing so, the PUD would follow through with actions that really do match their policy statements, as well as preserving the unique beauty of Donner Lake.
