History: The Board recently discussed the advantages of starting regular Board meetings at 6:00, rather than at 7:00 PM as is the current practice. A motion was introduced and adopted to enact an ordinance making that change. Our practice is to conduct a public hearing prior to adopting an ordinance. New information: A notice of this public hearing was advertised in the Sierra Sun. Attached is the draft ordinance that would, if adopted, change the time of regular Board meetings. Recommendation: After the public hearing, the Board can adopt the ordinance if it chooses. .� , DONNER DistrictPublic Utility O�dinance No. 2007 - XXX AMENDING ORDINANCE 9502 BY LAWS OF THE DISTRICT AND TITLE 2 OF THE ADMINISTRATION CODE: TIME OF REGULAR BOARD MEETINGS NOW, THEREFORE, BE IT ENACTED by the Board of Directors of the Truckee Donner Public Utility District as follows: 1. Section 2.04.020 of the District Code of Regulations shall be amended to read as follows: 2.04.20 Time of Meeting—The time for regular meetings of the Board is the first and third Wednesday of each month at 6:00 P.M. If and when said Wednesday falls on a legal holiday, then said regular meeting shall be held at 6:00 P.M. on a date to be determined by the Board. 2. All ordinances or other actions adopted by the Board of Directors that are inconsistent with this ordinance shall be repealed insofar as they are inconsistent. 3. That the Deputy District Clerk of the District be directed to public this ordinance in accordance with the laws of the State of California. 4. That this ordinance shall be come effective after the lapse of thirty (30) days from the date of adoption of this ordinance. PASSED AND ADOPTED by the Board of Directors of the Truckee Donner Public Utility District in a meeting duly called and held within said District on the 181h day of July, 2007. Holzmeister, District Clerk A ORDINANCE NO. 9502 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT AMENDING THE BYLAWS OF THE DISTRICT AND TITLE 2 OF THE ADMINISTRATION CODE NOW, THEREFORE, BE IT ENACTED by the Board of Directors of the Truckee Donner Public Utility District as follows: 1. That effective 30 days from the date of passage of this ordinance the Bylaw amendments and changes to Title 2 of the District's Administration Code attached hereto shall take effect. 2. That the Deputy District Clerk of the District be directed to publish this ordinance in accordance with the laws of the State of California. When the Order of Adjournment fails to state the hour to which the adjourned meeting is to be held, it shall be held at the hour specified for regular meetings. In the event that an adjourned meeting is not called, and a special meeting does not take place prior to the next regular meeting, then the unfinished items shall be placed on the agenda for the next regular meeting. (Bylaws, Section 5) 2.04.040 Special Meetings - A special meeting may be called at any time by the President or by a majority of the members of the Board, by delivering personally or by mail written notice to each member of the Board and to each local newspaper of general circulation, radio or television station requesting notice in writing. Such notice must be delivered personally or by mail at least 24 hours before the time of such meeting as specified in the notice. The call and notice shall specify the time and place of the special meeting and the business to be transacted. No other business shall be considered at such meetings by the Board. Such written notice may be dispensed with as to any member who at or prior to the time the meeting convenes files with the Clerk/Ex-officio Secretary a written waiver of notice. Such waiver may be given by telegram. Such written notice may also be dispensed with as to any member who is actually present at the meeting at the time it convenes. (Bylaws, Section 6) 2.04.050 Written Notice of all Meetings - In addition to the requirements contained in other sections of these Bylaws, advance written notice shall be given for all meetings in the following manner: 2.04.050.1 A written notice of all meetings shall be mailed to each Director as far in advance of the meeting as possible, but, in any event, either mailed or expressly hand-delivered so as to be received 49 hours in advance of the meeting. Notwithstanding the foregoing, and in accordance with -6 1 herein, notice for all special meetings shall be made at least 24 hours in advance of said meeting. Any Director may, at his discretion, file a signed waiver of such notice with the District. Tine 2 Page 4 ORDINANCE NO. 7703 of TRUCKEE-DONNER PUBLIC UTILITY DISTRICT CHANGING THE DAYS AND TIME OF REGULAR BOARD MEETINGS BE IT ENACTED by the Board of Directors of the Truckee-Donner Public Utility District as follows: The time for the regular meeting of the Board shall be the first and third Mondays of each month at 7 : 00 p.m. If and when said Monday falls on a legal holiday, then said regular meeting shall be held at 7 : 00 p.m. on the next day following said holiday. This Ordinance shall become effective after the lapse of thirty (30) days from the date of adoption and commence with the second meeting in June , 1977 . The Clerk of the District shall immediately cause a copy of this Ordinance to be published once in the local newspaper and copies shall be posted in at least three (3) public places within the District. If there is a concern that some of the audience might miss their chance to testify during the first agenda item called Open Public Comment period at the beginning of the meeting, then the directors could institute a new, second Public Comment period to occur say at 7:30pm, in between regularly scheduled items. This way, someone arriving late could still bring to the board a new topic of concern to them. Then the meeting could proceed after that ' time out' for the 2nd Public Comment period.
