Finally, it should be noted that I have had an initial conversation with District legal counsel regarding the legality of this type of an infrastructure build. Mr. Gross's thoughts were that with certain limitations, the payment of prevailing wages, etc, that a design/build/lease-back arrangement would allowed under the Public Utility Code and other State regulations.
