SUBJECT: Public Hearing Regarding Adoption of a Water Shortage
Contingency Plan

RECOMMENDATION:
a) Conduct a public hearing for the Water Shortage Contingency Plan (WSCP).
b) Adopt ordinance 2021-01 adopting the Water Shortage Contingency Plan.
DISCUSSION:
The Urban Water Management Planning Act (California Water Code Section 10610)
requires that all urban water suppliers prepare urban water management plans and update
them every five years. The District is considered an urban water supplier since it serves
more than 3,000 customers.
The current 2015 Urban Water Management Plan (UWMP) was adopted in June 2016.
Adoption of the 2020 UWMP is scheduled for June 2, 2021.
A required component of the UWMP is an updated WSCP. The District’s current WSCP
was adopted in September 2014 with Ordinance 2014-05.The updated draft WSCP
contains significant revisions from the 2014 version.
At the May 5, 2021, Board Meeting, a review of the draft WSCP was conducted. The Board
of Directors then scheduled a public hearing on the revised WSCP for June 2, 2021.
Section 7 of the WSCP discusses the District’s legal authority to impose and enforce the
provisions of the WSCP. The draft version presented on May 5 noted that additional
information would be provided by the District’s legal counsel. Attached the complete draft
WSCP with the revisions to Section 7. There are minor revisions to Section 12, which
discusses adoption of the WSCP.

An electronic copy of the draft WSCP was posted on the District’s website for public
review. Notices regarding the public hearing on the draft WSCP were placed in the Sierra
Sun on May 14, and May 21. Notices of the public hearing were also mailed to the
appropriate local agencies. As of May 24, the District has not received any comments
regarding the draft WSCP.
Two Board actions are required:
1) Adoption of the WSCP
2) Adoption of Ordinance 2021-01
FISCAL IMPACT:
There is no fiscal impact associated with this item.
