Public Utility District Memorandum To: Board of Directors From: Jessica Wilson Date: December 6, 2006 Subject: Final Completion and a Closeout Change Order for the Brockway Transmission Pipeline Project 1. Why this matter is before the board: The Brockway Transmission Pipeline project is essentially complete. A closeout change order and a resolution accepting the project require Board approval. 2. History: The Board previously awarded the Brockway Transmission Pipeline project to Vulcan Construction & Maintenance, Inc. On September 6, 2006, the Board approved Change Order No. 1 for this project in the amount of $219,534.92. Over half of the Change Order addressed rock work encountered by the bore and jack subcontractor under the railroad tracks. 3. New information: On October 30, 2006, District staff performed a final walkthrough of the project and generated punch list items requiring correction. These items were completed by November 3, 2006. 1 am requesting a Closeout Change Order to the Contract for issues covered under six general items that will cover all of the remaining issues related to this project. Item 1: The contract is based on a lump sum and unit price bid. The attached table shows the differences between bid totals and the amounts actually constructed. This analysis results in a credit to the District in the amount of$41,595.13. Item 2: This item addresses all of the additional asphalt the Contractor was required to place. The bid was based on a six-foot wide trench restoration along the alignment. However, in many spots along the alignment, large boulders were removed or blasted and larger trench widths were restored, up to a full 12-foot wide lane in some locations. There was also about 140 feet along Estates Drive of solid rock that Page 1 required extensive blasting. In that section, the entire road was repaved. Lastly, the Town's Encroachment permit required a "partial lane enhanced restoration" on Estates Drive, Martis Drive, and Ranch Way. This requirement resulted in additional paving beyond the amount indicated in the Bid Documents. Based on the additional asphalt quantities calculated and additional costs from Advanced Asphalt, Vulcan agreed to the amount of$70,000.00. Item 3: As mentioned in monthly staff reports to the Board, blasting was performed on four occasions by a local subcontractor hired by Vulcan. The largest of the blasts entailed two days worth of drilling holes for explosives along 140 feet of the alignment on Estates Drive. The other locations were smaller in scale, requiring 2 to 4 hours to complete. Vulcan is owed $51,332.06 for this item to cover costs incurred. Item 4: At one location in Martis Drive, the vertical alignment of the new pipeline profile conflicted with an existing storm drain and sewer lateral. There was not enough cover to go above the storm drain and not enough clearance to go between the two pipes. Going beneath the sewer lateral would have required at least a day's worth of blasting because the sewer was resting on solid rock. After discussions with both TSD and the Town, it was decided that the existing 21- inch corrugated storm drain pipe would be replaced with a new 18-inch smooth wall storm drain pipe at the same location. The new 18-inch pipe would be raised as much as possible and this would allow the new 24-inch water pipe to fit between the storm drain and the sewer lateral. Vulcan is owed $12,951.84 for purchase and installation of the new storm drain pipe. Item 5: Wherever possible, the Contractor deflected the pipe at the joints to achieve the required curvature. However, at three locations, the pipe could not be offset enough given the field conditions and additional elbows were required. Vulcan is owed $6,658.00 to cover the costs of purchase and installation of these three additional elbows not shown on the Contract Drawings. Item 6: At the end of the pipeline alignment at Ranch Way and SR 267, the new pipeline connects to an existing 24-inch pipeline constructed in 2001. A new 90 degree elbow was installed at this connection point. This new elbow changed the local hydraulics and thrust restraint requirements at this location. Shortly after the new pipeline was placed into service, a nearby push-on joint on the existing pipeline (installed in 2001) moved about 6-inches creating a pipeline break and a large leak. The Water Department had expected that this push-on joint was restrained. It has functioned without problem since its installation in 2001. The Water Department Field Crew managed to install some temporary piping to service the customers and Vulcan was directed to repair the pipe break and install some additional pipe restraints. Vulcan is owed $10,008.35 for the parts and labor associated with this work. Page 2 4. Recommendation: a) I recommend that the Board authorize Contract Change Order No. 2, in the amount of a $109,355.12 payment to Vulcan Construction & Maintenance, Inc., from the District. b) I recommend that the Board pass a Resolution accepting the Brockway Transmission Pipeline project as complete and authorizing the filing of the Notice of Completion. The Contractor agrees to furnish all labor and materials and perform all other necessary work, inclusive of the directly or indirectly related to the approved time extension, required to complete the Change order items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood that the Change Order shall be effective when approved by the District. That the District hereby accepts the Brockway Transmission Pipeline Project as complete. 2. That the Clerk of the District be directed to file with the County of Nevada the Notice of Completion, a copy of which is attached hereto. 3. That 35 days following the filing of the Notice of Completion, the monies retained from the contractor payments be released to the contractor if no claims have been made to the District by material suppliers or laborers.
