Consideration of an Agreement for Alternative Counsel with Bold,
Pol isner,Maddow,Nelson,&Judson
1.WHY THIS MATTER IS BEFORE THE BOARD
Board approval is required for contracts in excess of $15,000.
2.HISTORY
The District utilizes Porter Simon Law Firm;in specific Steve Gross,for legal
representation.Steve Gross has been the District's attorney for well over 20 years.
The District has relied upon Mr.Gross'advise and opinion,always maintaining a great
relationship which continues today.
However,there are times when Porter Simon Law Firm has a conflict of interest in
representing the District.
3.NEW INFORMATION
On a couple of occastions the District has needed to contact alternative counsel for
assistance.The District has contacted attorney's within the Truckee area,only to find
out they have conflicts as well.This is normal in a town as small as Truckee;
however,this also means the District will need to utilize out-of-town alternative
councel.
A reference for Bold,Polisner,Maddow,Nelson &Judson (BPMNJ)was provided to
the District.BPMNJ has over 20 years experience in representing a range of special
districts,water district and cities throughout Northern California.
A benifit of the size of the lawfirm,they have significant experience in all phases of the
legal and technical work necessary to represent the Distict in our needs.
4.FISCAL IMPACT
Sufficient funds exist in the FY16 and FY17 Budget.
5.RECOMMENDATION
Authorize the General Manager to execute a contract with Bold,Polisner,Maddow,
Nelson,&Judson Law Firm as the District's alternative counsel.
