WHY THIS MATTER IS BEFORE THE BOARD The State of California Office of Emergency Services requires non -state agencies to have a designation of applicant's agent on file. This designation requires Board action. The Board's consideration of this matter will then allow the District to apply for any fiscal recovery that may be available for the extraordinary expenses the District incurred during the January 2017 extreme storms. 2. HISTORY The District is exploring recovery opportunities for the expenses incurred in January 2017, as result of the severe storms. The state Governor's office declared a state of emergency on January 23, 2017 to secure funding to help communities respond to, and recover from, the severe winter storms. Staff presented workshop items to the Board at both the January 19, 2017, and February 1, 2017, Board meetings. The workshops included: • The Atmospheric River! Wednesday January 4th to January 9th - Started with significant snow fall and then two days of extreme rain. • The Blizzard! Tuesday January 10 to January 13 - Large amount of very heavy wet snow in a very short period, that caused extensive damage. • Mutual Aid! Wednesday to Saturday January 11 to January 13 - "The Blizzard" caused so much damage the District received Mutual Aid from City of Roseville and Plumas Sierra Rural Electric. • The Aftermath! January 13 to January 18 -Primary electric lines were all restored by Saturday January 17. Crews continued to repair downed secondary services, transformers, and other single incident events to customer homes. • The storms keep coming! January 19 to January 25 - The District experienced an additional 14,115 customer interruptions and 2,651 outage calls during that period. 3. NEW INFORMATION Staff contacted the State of California OES group and the Nevada County OES representative, and staff was informed that there may be funds available to the District for recovery of expenses incurred over the duration of the emergency declaration. FISCAL IMPACT If recovery funds are available the funds would partially replenish the Electric and Water Utility General Funds for eligible expenses incurred over the emergency declaration duration. 5. RECOMMENDATION 1. Receive this report and direct staff to pursue any available emergency relief funding; and 2. Approve Resolution 2017-03 officially designating the General Manager, Michael Holley, as the District's agent for the Office of Emergency Services. Jeremy Popov Michael D. Brown declared a state of emergency beginning January V, in counties across California following severe winter storms to secure funding to help communities respond to and recover from severe winter storms under all applicable laws; and WHEREAS, Placer County, Nevada County and the Town of Truckee also issued declarations of local emergencies; and WHEREAS, the extreme winter weather resulted in customer interruptions which required extensive and extraordinary repairs to the District's distribution system, including removal of trees and repairs to damaged lines; and WHEREAS, the damage was severe and extensive, which required the District to initiate a mutual aid request to solicit support from other electric utilities. Mutual Aid increased the District's staffing, added additional equipment, and supplies for repairs through the emergency periods; and WHEREAS, the emergency also required that the District contract with an additional emergency tree removal company to remove hazards in the area; and WHEREAS, the California State Office of Emergency Services requires a designation of applicant's agent resolution for non -state agencies to be on file in order to be eligible to apply for recovery under all applicable laws; and WHEREAS, the Board needs to designate an agent to execute for and on behalf of Truckee Donner Public Utility District, and such agent shall be responsible to provide the Governor's Office of Emergency Services with all matters pertaining to such state disaster assistance, including any assurances, agreements, and ancillary agreements required. NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE TRUCKEE-DONNER PUBLIC UTILITY DISTRICT DOES RESOLVE AS FOLLOWS: The Board of Directors designates the General Manager as the authorized agent for the Truckee Donner Public Utility District to provide the Governor's Office of Emergency Services with all matters pertaining to such state disaster assistance, including any assurances, agreements and ancillary agreements required. A new resolution must be submitted if a previously submitted Resolution is older than three (3) years from the last date of approval, is invalid or has not been submitted. When completing the Cal OES Form 130, Applicants should fill in the blanks on page 1. The blanks are to be filled in as follows: Resolution Section: Governing Body: This is the group responsible for appointing and approving 6ents. Examples include: Board of Directors, City Council, Board of Supervisors, Board of Education, etc. Name of Applicant: The public entity established under the laws of the State of California. Examples include: School District, Office of Education, City, County or Non-profit agency that has applied for the grant, such as: City of San Diego, Sacramento County, Burbank Unified School District, Napa County Office of Education, University Southern California. Authorized Agent: These at•e the individuals that are authorized by the Governing Body to engage with the Federal Emergency Management Agency and the Governor's Office of Emergency Services regarding grants applied for by the Applicant. There are two ways of completing this section: 1. Titles Only: If the Governing Body so chooses, the titles of the Authorized Agents would be entered here, not their names. This allows the document to remain valid (for 3 years) if an Authorized Agent leaves the position and is replaced by another individual in the same title. If "Titles Only" is the chosen method, this document must be accompanied by a cover letter naming the Authorized Agents by name and title. This cover letter can be completed by any authorized person within the agency and does not require the Governing Body's signature. 2. Names and Titles: If the Governing Body so chooses, the names and titles of the Authorized Agents would be listedI A new Cal OES Form 130 will be required if any of the Authorized Agents are replaced, leave the position listed on the document or their title changes. Governing Body Representative: These are the names and titles of the approving Board Members. Examples include: Chairman of the Board, Director, Superintendent, etc. The names and titles cannot be one of the designated Authorized Agents, and a minimum of two or more approving board members need to be listed. Certification Section: Name and Title: This is the individual that tivas in attendance and recorded the Resolution creation and approval. Examples include: City Clerk, Secretary to the Board of Directors, County Clerk, etc. This person cannot be one of the designated Authorized Agents or Approving Board Member (if a person holds two positions such as City Manager and Secretary to the Board and the City ]Manager is to be listed as an Authorized Agent, then the same person holding the Secretary position would sign the document as Secretary to the Board (not City Manager) to eliminate "Self Certification."
