Subject: Consideration of the District's Vote and Provide Direction to Staff on
Voting for the Donner Pass Road Assessment and Maintenance
District
1. WHY THIS MATTER IS BEFORE THE BOARD
Approving an assessment district is within the Board's purview.
2. HISTORY
The Town of Truckee's 2025 General Plan Identifies planned circulation system
improvements that would offset the effects of increased traffic due to development.
The Town's Capital Improvement Project list includes the Donner Pass Road Corridor
Improvement Plan (Envision DPR), which encompasses Donner Pass Rd. from the
McIver Roundabout to the interchange at Coldstream Rd. The goal of the project is to
enhance pedestrian, bicycle, and vehicle movement. Anticipated improvements
include sidewalks, crosswalks, bike lanes, medians at select locations, and the
potential of undergrounding current electric facilities.
Phase 1 of the project is from Richards Blvd. to Frates Lane, Attachment 1. The
existing corridor has several gaps in the sidewalk; Phase 1 will construct sidewalks
where there is currently none, and to provide pedestrian islands at select crosswalk
locations, improve bike lanes to Town standards, and to consolidate business access
points. The project improvements will provide a safe corridor for pedestrians,
bicyclists, school children, and enhance vehicle line of site.
District staff has participated in all phases of the discussion since 2015. Staff has
attended public outreach workshops, responded to surveys and have been active in
discussions related to the undergrounding of electric facilities.
3. NEW INFORMATION
The whole process has been very collaborative between the District and the Town of
Truckee. Through many meetings the Town has agreed to provide on street parking
for District business, move the bus stop currently adjacent to the garden, to the other
side of Donner Trails Rd. and to provide a crosswalk with pedestrian refuge island at
the walkway from the main entrance to Donner Pass Rd.
In order to maintain the new and existing facilities in a safe condition the Town has
found it necessary to create a the Envision DPR Landscaping and Lighting
Assessment District No. 1 with all property owners paying a proportionate share based
upon the square footage along Donner Pass Rd.
The anticipated total cost of improvements is estimated at $1072001000 and will
increase road maintenance costs of approximately $92,200 per year. It is estimated
that it will cost $72,932 per year to be borne by adjacent property owners to maintain
the investment in the first year. The assessment rate is $1.091 per square foot. The
assessment district proposes to provide the following:
• Routine Maintenance of Sidewalks and Landscaping ($1.091/ SF per year) -
Generating approximately $84,320 per year of funds for the services at
buildout. Includes snow removal once a day during storm events (approximately
25 times per year) without the use of de-icing agents, sweeping to remove
sediment, debris and trash removal at least twice a year. This also includes
snow removal across driveways to clear a path for sidewalk continuation;
• $5,000 per year for the district administration, and $5,000 per year to put
toward a reserve for insurance deductibles;
• Town would also provide $8,651 annually towards the assessment district to
provide snow off -hauling operations for the sidewalks;
• For the landscaping, this includes weeding, water service, irrigation
maintenance, and plant replacement. Approximately 1,500 square feet of new
landscaping is proposed in the Town right of way as a part of the sidewalk and
crosswalk improvements.
Yet, according to Town Municipal Code, Attachment 2, the property owner is required
to maintain the sidewalk in a safe conon for use by pedestrians and other members
of the public. This would include keeping the sidewalk free and clear of dirt, sand,
gravel, trash, ice and any snow removal in-between the Town's snow removal.
Additionally, the long-term replacement of the sidewalks and driveway aprons would
be the responsibility of the adjacent property.
Requirements for the approval of the assessment district include the following voting
structure:
• One vote is assigned per one dollar of assessment,
• Each property is assessed a dollar amount based upon square footage of
frontage infrastructure included in the district;
• Assessment district requires a 50% + $1 vote of returned ballots to form the
assessment district;
• Vote is to determine max assessment value based on buildout condition;
• Assessments would be increased to reflect the San Francisco/Oakland/San
Jose Consumer Price Index.
Should the assessment district fail, the Town would have no revenue stream to fund
the dedicated sidewalk maintenance for this project.
4. FISCAL IMPACT
The estimated fiscal impact for FY19 and FY20 is anticipated to be $3,792.15.
Additionally, the District will save avoided costs of employees and equipment blowing
and sweeping the sidewalk.
• The cost is based upon the District's sidewalk area of approximately 3,476
square feet at $1.091 per square foot;
• Assessments may be adjusted annually to reflect the annual change in the
San Francisco/Oakland/San Jose Consumer Price Index (CPI) for February to
February;
• Annual increases for the CPI shall be determined by the Truckee Town
Council.
5. RECOMMENDATION
District staff is very supportive of the assessment district and recommends that the
Board vote in the affirmative for the Envision DPR Landscaping and Lighting
Assessment District No. 1.
In order for the assessment district to pass it requires a 50% plus $1 vote of all
returned ballots.
• The Board must vote to either approve or disapprove the assessment district;
• Have the Board President sign the ballot and direct staff to deliver the ballot to
the Town Clerk.

CHAPTER 13.05 SIDEWALK MAINTENANCE
13.05.010 Maintenance Responsibility
It shall be the duty of all owners, and their tenants, of real property within the Town whose property
borders any improved sidewalk to maintain the sidewalk in a safe condition for its use by
pedestrians and other members of the public. The duty created by the ordinance shall include the
duty to keep the sidewalk free and clear of all dirt, sand, gravel, filth, rubbish, ice and snow.
If, as the result of the failure of the landowner and/or tenant to keep the sidewalk maintained in a
safe condition, any person while exercising ordinary care to avoid the danger and who suffers
damage to his person or property though any unsafe conditions on the adjoining improved sidewalk,
shall have recourse for damages thus suffered against the landowner and/or tenant failing to
maintain the sidewalk in a safe condition.
