Subject: East River Street land
Why this matter is before the Board: This matter involves possible sale of District owned land,
which only the board can approve.
History: This matter came up at the July 18 meeting and was referred back to staff for additional
information. There is a long and complex history to this matter. The District was dealing with this
matter in 1992, but it was never resolved. The issue has been resurrected by the property owners
involved in the lot line problem.
East River Street has a long series of twenty-five foot parcels that front on East River Street and
back to the Truckee River. The two property owners who recently contacted me regarding this
problem are Wally Stevens and Jerry Carroll / Kate Fickle, a husband and wife. TDPUD owns two
twenty-five foot parcels (APN 19-160-34). To the immediate east of the District parcels, Jerry
Carroll / Kate Fickle (APN 19-160-30, 10305 East River) own three twenty-five foot parcels. To the
immediate east of the Carroll / Fickle parcels, Wally Stevens (APN 19-160-07, 10311 East River)
owns three twenty-five foot parcels. Carroll / Fickle and Stevens each have homes constructed, but
the problem is that their homes encroach upon the neighbor parcel to the west. In other words,
Carroll / Fickle encroach upon one of the District parcels and the Stevens home encroaches upon
one of the Carroll / Fickle parcels.
As I have already stated, this matter was discussed at length in 1992, but never resolved. The
solution being considered at that time was the District would sell one of its parcels to Dwayne
Haddock, who owned the Carroll / Fickle parcels at that time, and Haddock would sell his parcel
occupied by Stevens to Stevens. The devil is in the details.
Haddock is gone and Carroll / Fickle appear willing to participate in an arrangement like what was
discussed in 1992. The District has no plans to use the parcel it owns on East River Street. It was
used many years ago as a pipeline river crossing. That old pipe was removed over twenty years
ago.
A map showing the situation is attached. At the workshop on July 18, 1 was asked to consult with
surveyors Chuck Sage or Bob Coombs and find out what they know about the property owned by
the District. I was directed to determine if I could clarify the land owned by the District.
New information: I called both surveyors and Bob Combs had performed work that directly related
to the District parcels. He agreed to flag the parcels owned by the District, which he has now
done. The parcels are exactly what have been shown on the map. The Carroll / Fickle carport is
on District land.
Recommendation: I recommend that the Board adopt the resolution declaring Lots 13 and 14
(APN19-160-34) of the Moody's Extension at 10297 East River Street as surplus and authorize
staff to offer the parcel for sale or lease to the required public agencies.

Resolution No. 2007 - XX
Directing that certain District owned property be
declared surplus property
WHEREAS, the District owns the following parcel of real property in Truckee, Nevada County,
California: APN19-160-34 (Lots 13 and 14) located at 10297 East River Street of the Moody's
Extension, as shown on the map attached hereto as Exhibit"A" and,
WHEREAS, the above described parcel of real property has been identified in the District's Water
Master Plan and Electric Master Plan as not necessary for the District's use; and
WHEREAS, the District's Strategic Plan calls for the disposition of surplus real property so as to
provide funds for the expansion and enhancement of utility services by the District; and
WHEREAS,the District could dispose of the above described parcel and utilize the funds from the
sale of said parcel for other purposes.
WHEREAS,the District would like to resolve the encroachment problem that has occurred overthe
years in the Moody's Extension; and
NOW,THEREFORE, BE IT RESOLVED that the Board of Directors adopts the above recitals as its
findings; and
BE IT FURTHER RESOLVED that, for the reasons set forth above, the Board declares the above
described parcel of real property as surplus property; and
BE IT FURTHER RESOLVED that the District comply with the applicable statutory requirements for
the disposal of surplus property and actively pursue disposal of the above described parcel of real
property.
PASSED AND ADOPTED by the Board of Directors at a meeting duly called and held within the
District on the 15th day of August, 2007, by the following roll call vote:
