6/25/2018CodesDisplayTextbecomesthepropertyofthelocalagencyuponsubmittingproofsatisfactorytothetreasurer,unlesstheunclaimedmoneyisdepositedpursuanttoSection7663oftheProbateCode.(b)NotwithstandingSection50052,thetreasurermayreleaseunclaimedmoneydepositedwiththecountytreasurerpursuanttoSection7663oftheProbateCode,toanyadultbloodrelativeofeitherthedecedentorthedecedent’spredeceasedspouse.(c)NotwithstandingSection50052,thetreasurermayreleaseunclaimedmoneydepositedwiththecountytreasurerpursuanttoSection7663oftheProbateCodetotheparentwhohaslegalandphysicalcustodyofaminorwhoisabloodrelativeofeitherthedecedentorthedecedent’spredeceasedspousewithouttheneedtoappointalegalguardianfortheminorasfollows:(1)Ifthevalueoftheunclaimedmoneydepositedwiththecountytreasurerisfivethousanddollars($5,000)orless,thetreasurermayreleasethemoneyaccordingtoSection3401oftheProbateCode.(2)Ifthevalueoftheunclaimedmoneydepositedwiththecountytreasurerissixtythousanddollars($60,000)orless,andthemoneyisnotreleasedunderparagraph(1),theunclaimedmoneymaybereleasedbythetreasurertotheparentwhoshall,afterpaymentofanycostsincurredinmakingtheclaim,holdthemoneyintrust,tobeusedonlyforthecare,maintenance,andeducationortheminor,andtheparentshallbeliabletherefortotheminorunderthefiduciarylawsofthisstate.Themoneyheldintrustshallbereleasedtotheminorwhentheminorreachestheageofmajority.(d)Theclaimshallbepresentedtothecountytreasurerinaffidavitformandsignedunderpenaltyofperjury.NotwithstandingSection13101oftheProbateCode,theclaimant,tobeentitledtotheentireescheatedestate,needsonlytoestablishwithdocumentaryprooftheexistenceofabloodrelationshiptoeitherthedecedentorofthepredeceasedspouse,ifany,andthedocumentaryproof,ifregularonitsface,neednotbecertified.NotwithstandingSection13101oftheProbateCode,theclaimantshallnotberequiredtodeclarethatnootherpersonhasanequalorsuperiorclaimtotheescheatedestate.Thecountytreasurermayrelyingoodfaithontheswornstatementsmadeintheclaimandshallhavenodutytoinquireintothetruthorcredibilityofevidencesubmitted.Inpayingouttheescheatedestate,thecountytreasurershallbeheldharmlesstoall.Paymentshallactastotalacquittanceandshallcompletelydischargethecountytreasurerfromanyliability.Ifthecountytreasurerrejectsanyclaimmadehereunder,theclaimantmaytakehisorhergrievancetotheSuperiorCourtofthecountyholdingtheescheatedestate.Anyclaimpaidhereundershallbepaidwithoutinterest.(AmendedbyStats.2000,C/i.333,Sec.1.EffectiveJanuary),2001.)50053.Whenanysuchmoneybecomesthepropertyofalocalagencyandisinaspecialfund,thelegislativebodymaytransferittothegeneralfund.(AddedbyStats.1949,C/i.81.)50054,Wheneveranycityorcountyorcityandcountyrendersconstructionservicesorconstructspublicworksforanycity,county,cityandcountyoranyothergovernmentalagencybelowthelevelofthestategovernment,thepricechargedforsuchservicesorconstructionshallbesufficienttoreimbursethegovernmentalbodyperformingsuchservicesforthefullcostthereofincludinglabor,material,equipmentcostsorrentalsandareasonableallowanceforoverhead.Incomputingoverhead,withoutlimitationonotherfactorsproperlyincludable,thereshallbeallocatedtotheoverheadcostitsproportionateshareofindirectlaborandadministrativecosts,(AddedbyStats.1971,C/i.558.)50055.Anyotherprovisionofthisarticlenotwithstanding,anyindividualitemsoflessthanfifteendollars($15),oranyamountifthedepositor’snameisunknown,whichremainunclaimedinthetreasuryorintheofficialcustodyofanofficerofalocalagencyfortheperiodofoneyearoruponanorderofthecourtmaybetransferredtothegeneralfundbythelegislativebodywithoutthenecessityofpublicationofanoticeinanewspaper(AmendedbyStats.1996,C/i.89,Sec.1.EffectiveJuly),1996.)50056.Theresponsibilitiesofthetreasurerasprovidedunderthisarticlemaybedelegatedbythetreasurertotheagency,district,ordepartmentthatmaintainsthesupportingrecordsoftheunclaimedmoneybasedontheinitialreceiptordepositofthatmoneyorboth.(AddedbyStats.1984,Ch.866,Sec.4.).&chapter=1.&article3.2/3
