ReportCONSENTBoardofDirectorsBrianWrightMay01,2019IAgendaItem#10TRuCKEEDONNERPublicUtilityDistrictSubject:ConsiderationScheduleaPublicHearingDistrictsWaterUtilityAnnualPublicHealthGoalsReport1.WHYTHISMATTERISBEFORETHEBOARDThepublichearingisrequiredinorderfortheBoardtoapprove/adopttheDistrict’sWaterUtilityAnnualPublicHealthGoalsReport.2.HISTORYTheCaliforniaSafeDrinkingWaterActof1996,theCaliforniaCodeofRegulationsandSB1307includeprovisionsfortheOfficeofEnvironmentalHealthHazardAssessment(OEHHA)todevelopPublicHealthGoals(PHG)associatedwithdrinkingwatercontaminants.PHGsaredevelopedforcontaminantsthatdonotposesignificanthealthriskandthereforearenotconsideredenforceable.ContaminantsforwhichPHGshavebeenestablishedareevaluatedbasedon“on-in-a-million”riskforcontinuousandprolongedexposuresof70+years.InaccordancewithSB1307,publicwatersystemswithgreaterthan10,000serviceconnectionsarerequiredtoprovideaPublicHealthGoalReporteverythreeyears.Thisreportshallincludeanoverviewofcontaminants,forwhichwaterqualitytestinghasbeenidentifiedasexceedingPHGlevelsduringthepreviousthreeyearperiod.InadditiontoidentifyingcontaminantsexceedingPHGlevels,thereportmustalsoincludeproposedmitigationplansandpotentialfiscalimpacts.SB1307requiresthatpublicwatersystemspresentthereportintheformofapublichearing,providingopportunityforcustomerinput.Previously,theTDPUD2016WaterUtilityPublicHealthGoalReportwaspresentedatapublichearingheldattheDistrict’sJune,20163.NEWINFORMATIONTheTruckeeDonnerPublicUtilityDistrict2019PublicHealthGoalsRepothasbeenpreparedforpublication.ThereporthasbeensubmittedtotheStateWaterResourcesControlBoardforreview,incompliancewithSB1307,andisreadyforpublicinput.4.FISCALIMPACTThereisnodirectfiscalimpactassociatedwiththisitem.To:From:Date: :;TruckeeDonnerPublicUtilityDistrictDirectorsJosephR.AgueraJeffBenderBobEllisChristaFinnTonyLaliotisGeneralManagerMichaelD.HolleyTRUCKEEDONNERPUBLICUTILITYDISTRICT2019PUBLICHEALTHGOALSREPORTBackgroundProvisionsoftheCaliforniaHealthandSafetyCodespecifythatlarger(>10,000serviceconnections)waterutilitiesprepareaspecialreportbyJuly1,2019ifwaterqualitymeasurementshaveexceededanyPublicHealthGoals(PHGs).PHGsarenon-enforceablegoalsestablishedbytheCaliforniaEnvironmentalProtectionAgency’s(Cal-EPA)OfficeofEnvironmentalHealthHazardAssessment(OEHHA).TheregulationalsorequiresthatwhereOEHHAhasnotadoptedaPHGforaconstituent,thewatersuppliersaretousetheMaximumContaminantLevelGoals(MCLG)adoptedbytheUnitedStatesEnvironmentalProtectionAgency(USEPA).OnlyconstituentswhichhaveaCaliforniaprimarydrinkingwaterstandardandforwhicheitheraPHGorMCLGhasbeensetaretobeaddressed.ThereareafewconstituentsthatareroutinelydetectedinwatersystemsatlevelsusuallywellbelowthedrinkingwaterstandardsforwhichnoPHGnorMCLGhavebeenadoptedbyOEHHAorUSEPAincludingTotalTrihalomethanes.ThesewillbeaddressedinafuturerequiredreportafteraPHGhasbeenadopted.Theregulationspecifieswhatinformationistobeprovidedinthereport.IfaconstituentwasdetectedintheTruckeeDonnerPublicUtilityDistrict’s(TDPUD)watersupplybetween2016and2018,atalevelexceedinganapplicablePHGorMCLG,thisreportprovidestheinformationrequiredundertheregulation.IncludedisthenumericalpublichealthriskassociatedwiththeMaximumContaminantLevel(MCL)andthePHGorMCLG,thecategoryortypeofrisktohealththatcouldbeassociatedwitheachconstituent,thebesttreatmenttechnologyavailablethatcouldbeusedtoreducetheconstituentlevel,andanestimateofthecosttoinstallthattreatmentifitisappropriateandfeasible.WhatArePHGs?PHGsaresetbytheCaliforniaOfficeofEnvironmentalHealthHazardAssessment(OEHHA)whichispartofCal-EPAandarebasedsolelyonpublichealth2019PublicHealthGoalReportTruckeeDonnerPublicUtilityDistrict riskconsiderations.Noneofthepracticalrisk-managementfactorsthatareconsideredbytheUSEPAortheCaliforniaDepartmentofHealthServices(CDHS)insettingdrinkingwaterstandardsareconsideredinsettingthePHGs.Thesefactorsincludeanalyticaldetectioncapability,treatmenttechnologyavailable,benefitsandcosts.ThePHGsarenotenforceableandarenotrequiredtobemetbyanypublicwatersystem.MCLGsarethefederalequivalenttoPHGs.WaterQualityDataConsideredAllofthewaterqualitydatacollectedbytheTDPUDwaterutilitybetween2016and2018,forpurposesofdeterminingcompliancewithdrinkingwaterstandardswasconsidered.Thisdatawasallsummarizedinour2016,2017,and201$AnnualWaterConsumerConfidenceReportswhichwerepostedontheTDPUDwebsiteforcustomerstoreviewbyJuly1stofeachsubsequentyear.GuidelinesFollowedTheAssociationofCaliforniaWaterAgencies(ACWA)formedaworkgroupwhichpreparedguidelinesforwaterutilitiestouseinpreparingthesenewlyrequiredreports.TheACWAandCaliforniaDepartmentofPublicHealthguidelineswereusedinthepreparationofthisreport.BestAvailableTreatmentTechnologyandCostEstimatesBoththeUSEPAandCDHSadoptwhatareknownasBATsorBestAvailableTechnologieswhicharethebestknownmethodsofreducingcontaminantlevelstotheMCL.Costscanbeestimatedforsuchtechnologies.However,sincemanyPHGsandallMCLGsaresetmuchlowerthantheMCL,itisnotalwayspossiblenorfeasibletodeterminewhattreatmentisneededtofurtherreduceaconstituentdownwardtoornearthePHGorMCLG,manyofwhicharesetatorclosetozero.Estimatingthecoststoreduceaconstituenttozeroisdifficult,ifnotimpossiblebecauseitisnotpossibletoverifybyanalyticalmeansthatthelevelhasbeenloweredtozero.Insomecases,installingtreatmenttotryandfurtherreduceverylowlevelsofoneconstituentmayhaveadverseeffectsonotheraspectsofwaterquality.ConstituentsDetectedThatExceedaPHGoraMCLGThefollowingisadiscussionofconstituentsthatweredetectedinoneormoreoftheTDPUD’sdrinkingwatersourcesatlevelsabovethePHG,orifnoPHG,abovetheMCLG.Arsenic:TheMCLforarsenicis10partsperbillion(ppb),thePHGandMCLGforarsenicis0.OO4ppb.Wehavedetectedarsenicin6ofour12wells,GlenshireDriveWellatl0ppb,MartisValleyWellatl0ppb,AirportWellat9.$ppb,OldGreenwoodWellat7.9ppb,ProsserVillageWellat6.6ppb,andSandersWellat8.$ppb.ItisimportanttonotethattheGlenshireDriveWell,OldGreenwoodWellandProsserVillageWellare2019PublicHealthGoalReportTruckeeDonnerPublicUtilityDistrict deliveredthroughaCaliforniaStateWaterResourcesControlBoard(SWRCB)approvedblendingpermitmaintainingpostblendwaterdeliverieswitharsenicconcentrationsbelowtheMCL.Thecategoryofhealthriskassociatedwitharsenic,andthereasonthatadrinkingwaterstandardwasadoptedforit,isthatcontinuouslongtermexposurestodrinkingwatercontainingarseniclevelsabovetheMCLmayincreasetheriskofcancer.TheCaliforniaOfficeofEnvironmentalHealthHazardAssessment(OEHHA)hassetthePHGatO.OO4ppb.ThePHGisbasedonalevelthatwillresultinnotmorethan1excesscancerin1millionpeoplewhodrink2litersdailyofthiswaterfor70years.Theactualcancerriskmaybelowerorzero.TheBATthatweareusingforthisreporttolowerthelevelbelowtheMCLto.OO4ppbisfixedbedadsorptionsystem.Theestimatedcosttoinstallandoperatesuchatreatmentsystemonall6WellsthatwouldreliablyreducetheArseniclevelto.OO4ppbwouldbeapproximately$8,100,000initialconstructioncostwithadditionalestimatedO&Mcostofan$6,900,000peryear.Thiswouldresultinanassumedincreasedcostforeachcustomerofapproximately$592peryear.RECOMMENDATIONSFORFURTHERACTIONThedrinkingwaterqualityoftheTruckeeDonnerPublicUtilityDistrictatthistimemeetsallCaliforniaStateWaterResourcesControlBoardandUSEPAdrinkingwaterstandardssettoprotectpublichealth.Tofurtherreducethelevelsoftheconstituentsidentifiedinthisreportthatarealreadybelowthehealth-basedMCLsestablishedtoprovide“safedrinkingwater”,additionalcostlytreatmentprocesseswouldberequired.Theeffectivenessofthetreatmentprocessestoprovideanysignificantreductionsinconstituentlevelsatthesealreadylowvaluesisuncertain.Thehealthprotectionbenefitsofthesefurtherhypotheticalreductionsarenotatallclearandmaynotbequantifiable.Therefore,noactionisproposed.Themoneythatwouldberequiredfortheseadditionaltreatmentprocessesmightprovidegreaterpublichealthprotectionbenefitsifspentonotherwatersystemoperation,surveillance,andmonitoringprograms.2019PublicHealthGoalReportTruckeeDonnerPublicUtilityDistrict
