DistrictAqendaItem#I12TRUCKEEDONNERjubticUtilityDistrictCONSENTTo:BoardofDirectorsFrom:ReginaWiseDate:June05,2019Subject:ConsiderationofAnnualResolutionsfortheDonnerLakeAssessmentDistrict1.WHYTHISMATTERISBEFORETHEBOARDThisitemconcernscollectingDonnerLakeAssessmentDistrictNo.00-1assessmentchargesinNevadaandPlacerCountiesbytheadoptionofstandardresolutions.2.HISTORYDistrictResolutionNo.9723adoptedonNovember5,1997authorizedtheexecutionofastandardformtaxcollectionservicescontractonbehalfoftheDistrictwiththeCountyofNevada.ThecontractstatesthattheDistrictmustadoptanannualresolutionrequestingplacementofspecialtaxes,specialassessmentsand/orparcelchargesontheCountyofNevadataxrolls.FinallistswillbeonrecordwithNevadaandPlacerCountiesandintheAdministrativeServicesDepartment.OnMay2,2001,theDistrictadoptedResolutionNo.2001-09makingdeterminations,confirmingassessmentsandproceedings,orderingtheacquisitionandconstructionofimprovementsandtakingcertainotheractionsrelatingtoDonnerLakeWaterAssessmentDistrictNo.00-1.3.NEWINFORMATIONThismattercomesbeforetheBoardeachyear.TheDistrictutilizesNevadaandPlacerCountiestocollectassessmentsandspecialtaxesaslineitemsontheannualpropertytaxbills..Attachment1isResolution2019-13fortheDonnerLakeAssessmentDistrictNo.00-1tocollecttheannualassessmentsforthefiscalyear2019-2020withNevadaCounty..Attachment2isResolution2019-14fortheDonnerLakeAssessmentDistrictNo.00-1tocollecttheannualassessmentsforthefiscalyear2019-2020withPlacerCounty. 4.FISCALIMPACTTheassessmentdistrictdollarscollectedaredepositedintotheDonnerLakecheckingaccountandareusedtopayprincipalandinterestpaymentsontheDepartmentofWaterResourcesStateRevolvingFundloanandotherassessmentdistrictexpenses.Theestimatedassessmentsforthe2019-2020assessmentperiodare$749,000forNevadaCountyand$71,000forPlacerCounty.5.RECOMMENDATION1)AdoptResolution2019-13requestingNevadaCountytocollecttheDonnerLakeAssessmentDistrictNo.00-1annualassessmentsforfiscaltaxyear2019-2020;and2)AdoptResolution2019-14requestingPlacerCountytocollecttheDonnerLakeAssessmentDistrictNo.00-1annualassessmentsforfiscaltaxyear2019-2020./‘ZOReginaWiseMichaelD.HolleyFinance&AccountingManagerGeneralManager t:TRUCKEEDONNERIPublicUtilityDistrictResolutionNo.2019-13FixingandPlacingDonnerLakeAssessmentDistrictAnnualChargesonDistrictTaxRollforCollectionbytheCountyofNevadaWHEREAS,theTruckeeDonnerPublicUtilityDistrictonMay2,2001adoptedResolutionNo.2001-09makingdeterminations,confirmingassessmentsandproceedings,orderingtheacquisitionandconstructionofimprovementsandtakingcertainotheractionsrelatingtoDonnerLakeWaterAssessmentDistrictNo.00-1;andWHEREAS,byResolutionNo.9723adoptedNovember5,1997,theBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictapprovedexecutionofacontinuousStandardFormTaxCollectionServicesContractwiththeCountyofNevada;andWHEREAS,theDistricthasnowdeterminedthelandsaffectedtherebyandthechargestobeassessed,leviedandcollectedonthelandsandparcels;andWHEREAS,theassessmentsoneachparcelshallbebilledonthesecuredtaxrollbillsforthefiscalyear2019-2020.NOW,THEREFORE,BEITRESOLVEDbytheBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictasfollows:1.ThattheBoardofSupervisorsoftheCountyofNevada,StateofCalifornia,levytheDonnerLakeAssessmentDistrictchargesagainsttheparcelsandownersofrecordlistedonthecomputeritemizationofparcelskeptandmaintainedintheAdministrativeServicesDepartmentoftheDistrictandmadeaparthereofbyreference,andthattheCountyAuditorandTaxCollectorbeinstructedtolevyandcollectsaidchargesinthesamemannerasCountytaxesasbylawandinsaidordinanceprovided.UponcompletionandcorrectionofthecurrentlistthroughJune30,2019,acopywillbeforwardedtotheAuditorControlleroftheCounty.2.TheDistrictwarrantsandrepresentsthatchargesimposedbytheDistrictandbeingrequestedtobecollectedbyNevadaCountycomplywithallrequirementsofstatelaw,includingbutnotlimitedtoArticlesXlllCandXIIIDoftheCaliforniaConstitution(Proposition218).1 ‘fRUCKEE:DONNERb1icUttyDistnctResolutionNo.2019-14RequestingCollectionofDonnerLakeAssessmentDistrictAnnualchargesonPlacerCountyTaxRollWHEREAS,theTruckeeDonnerPublicUtilityDistrictonMay2,2001adoptedResolutionNo.2001-09makingdeterminations,confirmingassessmentsandproceedings,orderingtheacquisitionandconstructionofimprovementsandtakingcertainotheractionsrelatingtoDonnerLakeWaterAssessmentDistrictNo.00-1;andWHEREAS,theTruckeeDonnerPublicUtilityDistrictrequeststheCountyofPlacercollectontheCountytaxrollscertainchargeswhichhavebeenimposedbytheDistrictforthefiscaltaxyear2019-2020;andWHEREAS,theCountyhasrequiredasaconditionofthecollectionofsaidchargesthattheDistrictwarrantthelegalityofsaidchargesanddefendandindemnifytheCountyfromanychallengetothelegalitythereof.NOW,THEREFORE,BEITRESOLVEDbytheBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictasfollows:1.TheAuditor-ControllerofPlacerCountyisrequestedtoattachforcollectionontheCountytaxrollsthoseassessmentsattachedhereto.2.TheDistrictwarrantsandrepresentsthattheassessmentsimposedbytheDistrictandbeingrequestedtobecollectedbyPlacerCountycomplywithallrequirementsofstatelaw,includingbutnotlimitedtoArticlesXlllCandXlllDoftheCaliforniaConstitution(Proposition218).3.TheDistrictreleasesanddischargesCounty,anditsofficers,agentsandemployeesfromanyandallclaims,demands,liabilities,costsandexpenses,damages,causesofaction,andjudgments,inanymannerarisingoutofthecollectionbycountyofanyassessmentsonbehalfofDistrict.4.TheDistrictagreestoandshalldefend,indemnifyandholdharmlessthecounty,itsofficers,agentsandemployees(the“IndemnifiedParties”)fromanyandallclaims,demands,liabilities,costsandexpenses,damages,causesofaction,andjudgments,inanymannerarisingoutofthecollectionbyCountyofanyofDistrict’ssaid1 assessmentsrequestedtobecollectedbyCountyfordistrict,orinanymannerarisingoutofDistrict’sestablishmentandimpositionofassessments.Districtagreesthat,intheeventajudgmentisenteredinacourtoflawagainstanyoftheIndemnifiedPartiesasaresultofthecollectionofoneofDistrict’sassessmentstheCountymayoffsettheamountofthejudgmentfromanyothermoniescollectedbyCountyonbehalfofDistrict,includingpropertytaxes.5.TheDistrictagreesthatitsofficers,agentsandemployeeswillcooperatewiththeCountyinansweringquestionsreferredtoDistrictbyCountyfromanypersonconcerningtheDistrict’sassessmentsandthatDistrictwillnotrefersuchpersonstoCountyofficersandemployeesforresponse.6.TheDistrictagreestopaysuchreasonableandordinarychargesastheCountymayprescribetorecoupitscostsinplacingonthetaxrollsandcollectingtheassessmentsasprovidedbyGovernmentCodesection29304and51800.PASSEDANDADOPTEDbytheBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictatameetingheldwithinsaidDistrictonJune5,2019bythefollowingrollcallvote:AYES:NOES:ABSENT:TRUCKEEDONNERPUBLICUTILITYDISTRICTByBobEllis,PresidentATTEST:ShannaD.Kuhlemier,CMC,DistrictClerk2
