14 MOU with Tahoe Sierra IRWM Plan
AgendaItem#14TRUCKEEDONNERPublicUtilityDistrictCONSENTTo:BoardofDirectorsFrom:StevenPonceletDate:July17,2019Subject:ConsiderationofapprovalofaMemorandumofUnderstandingRegardingtheTahoeSierraIRWMPlan1.WHYTHISMATTERISBEFORETHEBOARDApprovalofaMemorandumofUnderstanding(MOU)regardingtheTahoeSierraIntegratedRegionalWaterManagement(IRWM)PlanrequiresBoardaction.2.HISTORYDistrictstaffhavebeenactiveintheTahoe-SierraIRWMgroupsince2008.TheregionalgroupisoneofmanyacrossCaliforniathathavebeenformedtocollaborativelypususeStatefundingforwaterrelatedprojects.Inmanycases,itisarequirementtobeaformalmemberofaIWRMgrouptobeeligibleforStatefundingandgrants.Todate,theDistricthasappliedforfundingforavarietyofwaterprojectsbuthavenotyetbeenawardedanyfunding.AccessingStatefundingthroughtheTahoeSierraIRWMgrouprequiresexecutingaMOUwhichtheDistricthasnotdone.3.NEWINFORMATIONTheTahoe-SierraIRWMgroupiseligibleforsomeStatefundingforwaterconservationprojectsandaportion($250,000)hasbeenallocatedtotheDistrict.Districtstaffhaveidentifiedaproject,workingcollaborativelywiththeTruckeeDonnerRecreationandParksDistrict(TDRPD)andtheTahoeTruckeeAirportDistrict,toreplacetheend-of-lifeirrigationsystematthecommunityPonderosaGolfCourse.Theproject,whichwouldberunbyTDRPD,isestimatedtocost$1MillionofwhichtheStategrantwouldcover$250,000.Thisprojectwouldhavesignificantwaterconservationbenefitsalongwithsomeenergysavingsduetoreducedpumpingandwateruse.TheenergysavingswouldbeeligibleforexistingDistrictenergyefficiencyrebatesandtheBoardapproveda$20,000energyefficiencyrebateforthispotentialprojectattheApril3,2019Boardmeeting.TherewouldalsobeotherenvironmentalbenefitsduetothelocationofthegolfcoursenexttotheTruckeeWetlandsComplex.TheTruckeeWetlandsComplexrunsfromHilltop,throughtheDistrict’spropertybytheRodeoGrounds,andeventuallyintotheTruckeeRiver.TheTruckeeRiverWatershedCouncil,withsurortfromthe Districtandotherlocalagencies,hasbeenconductingrestorationworkonthecomplexincludingtheDistrict’sproperty.TheDistrict,toaccesstheStatewatergrantfunds,mustformallyjointheTahoeSierraIRWMbyexecutingtheMOU.TheMOU,essentially,requirescollaborationamongstthesignatoriesbutdoesnotabridgeanydecision-makingauthoritynorisitanobligationoffunds.Therearealmost20currentsignatoriestotheMOUincluding:TownofTruckee;TruckeeRiverWatershedCouncil;PlacerCounty;TahoeCityPUD;NorthTahoePUD;andSouthTahoePUD.Districtstaffbelieve,shouldtherebeanyfuturefundingforthesignificantunfundedStatewaterconservationmandates,allorthevastmajorityoftheseStatefundswouldbeavailableonlythroughtheIRWMgroups.TheMOUhasbeenreviewedbyDistrictCounselandisincludedasAttachment1.4.FISCALIMPACTThereisnodirectfiscalimpacttotheDistrictinexecutingtheMOU.Ifsuccessfulinsecuringthe$250,000grant,thiswouldbeapass-throughtoTDRPD.TherehasbeenlimitedDistrictstaffandCounseltimeinreviewingtheMOUandworkignwiththeSierra-TahoeIRWMgroup.5.RECOMMENDATIONAuthorizetheGeneralManagertoexecutetheTahoeSierraIntegratedRegionalWaterManagementPlanMemorandumofUnderstandingasapprovedtoformbyDistrictCounsel.,1,/--.“M-‘t/I//StevenPonceletMichaelD.HolleyPublicInformation&StrategicAffairsDirectoiGeneralManager ATTACHMENT1MemorandumofUnderstanding(MOU)RegardingtheTahoeSierraIRWMPlan(integratedRegionalWaterManagementPlan)1.PurposeofMOUThesignatoriesofthisMemorandumofUnderstanding(MOU)recognizethevalueofcoordinatingwatermanagement,planningandimplementationactivitieswiththeTahoeSierraIntegratedRegionalWaterManagementPlanRegion(Region)asshowninExhibitA.ThisMOUisinreferencetotheintentoftheIRWMPr4ogramtoencourageintegratedregionalstrategiesformanagementofwaterresourcesandtoprovideamechanismtoapplyforfunding,throughcompetitivestateandfederalgrants,forprojectsthatprotectcommunitiesfromdrought,protectandimprovewaterquality,andimprovelocalwatersecurity.ThisMOUfacilitatestheimplementationoftheTahoeSierraIntegratedRegionalWaterManagementPlan(IRWMPlan),asetofcoordinatedstrategiesformanagementofwaterresourcesandfortheimplementationofprojectsthatprotectourTahoeSierracommunitiesfromdrought,protectandimprovewaterqualityandimprovelocalwatersecurity.2GoalsofIRWMPlanWatermanagementgoalswithintheTahoeSierraIRWMPlanincludebutarenotlimitedto:.AligningwithongoingIRWMrequirements.Supportingandimprovinglocalandregionalwatersupplyreliability;.Reducingconflictbetweenwaterusersandresolvingwaterrightsdisputes;.Contributingmeasurablytothelong-termattainmentandmaintenanceofwaterqualitystandards;.Eliminatingorsignificantlyreducingpollutioninimpairedwaters.Restoringandprotectingsensitivehabitatareas;.CoordinatewiththeLahontanRegionalWaterQualityControlBoardBasinPlan;.Implementingnon-pointsource(NPS)pollutionplans.The2014RevisedTahoeSierraIRWMPlancanbefoundat(http://tahoesierrairwm.com/).AllfuturerevisionsoftheTahoeSierraIRWMPlanwillalsobepostedatthislocation.Pagelof5RevisedTahoe-SierraMOU1211/14 TheimplementationprojectsaschosenbyalltheagenciesarelistedintheIRWMPlan.TheseprojectshavebeenevaluatedandrankedinimplementationorderbyallmembersoftheTahoeSierraIRWM.ItisexpectedthesignatoriesofthisMOUwillapplyforavailablefunding.Stakeholdersandprojectproponentswillbeinvitedatleastonceeverytwo-yearstosubmitadditionalprojectsforconsiderationtobeincludedintheIRWMPlanorprovideupdatestoprojectsalreadyincludedintheIRWMPlan,withoutformalamendmentoftheIRWMPlan.3.MutualUnderstandingsThisMOUdoesnotabridgeanydecision-makingauthoritiesofanysignatory.TheTahoeSierraIRWMPlanandimplementationguidelinesdevelopedunderthisMOUwillnotconflictwithanylegaloblationofanysignatory,includingthoseundercontracts,licenses,permits,regulationsandstatutes.ThisMOUisnotanobligationoffunds,anddoesnotcontrolorlimitpursuitoffundingforanyfutureprojectofanysignatory.ItisexpectedthatsignatoriestothisMOUwillcontributestafftimenecessarytomeetthegoalsofthisMOU.4.WithdrawalfromtheMOUAnypartytotheMOUmayenditsparticipationbyprovidingwrittennoticetothepartnershipleadattheirnormalbusinessaddress.5.SignatoriestotheMOUMOUSignatories:ThesignatoriestothisMOUrepresentaspectrumofpublicagencies,specialdistricts,non-profitorganizationsandeducationinstutionsthroughouttheTahoeSierraregion.ThesignatoriesofthisMOUwill:.Fosteracollaborativewatermanagementplanningenvironment;.Promoteintegrationofwatermanagementacrossgeographiesoftheregion;.Recommendprioritiesforimplementationprojects;.Cooperativelyapplyforandobtainfundingforimplementationprojects;.ReviseandupdatetheTahoeSierraIRWMPlanasneeded;.Communicatethebestavailableinformationtodecisionmakers,stakeholdersandthepublicWetheundersignedadopttheTahoeSierraIRWMPlanandwillacttoimplementittothebestofourabilityincompliancewithapplicablelegalrequirements.Page2of5RevisedTahoe-SierraMOU12/1/14
