1.WHY THIS MATTER IS BEFORE THE BOARD
It is the Board’s purview to approve District Resolutions.
2.HISTORY
Staff has identified the need to update District code associated with the
implementation and management of the Water Utility’s Cross-Connection Control
Program.At the Board Meetings held on October 16,2019 and November 6,2019,
staff presented to the Board two workshops providing a high level overview of the
basic components of backflow conditions and protections,as well as outline of
regulations and requirements of Cross-Connection Control Programs under Title 17,
California Code of Regulations (Title 17,CCR).In the first workshop on October 16,
2019,the following topics were reviewed:
•Title 17,CCR requirements;
•Adoption of rules and ordinances;
•Site surveys and evaluation of hazards;
•Backf low protection standards;
•Personnel training and certifications;
•Establishment of District procedures;and
•Record maintenance requirements.
The second Workshop,held on November 6,2019,included a review of the following
topics:
•Definitions of cross-connection and backf low;
•Identifying conditions where backf low may exist;
•Components and functions of backflow prevention assemblies;and
•Basic components of a cross-connection control program.
3.NEW INFORMATION
Due to the significant growth with the inventory of backf low prevention assemblies
monitored within the District’s Cross-Connection Control Program,staff has
experienced proportional increases in the number of labor hours required to
implement and manage the program.The significant increase in the number of
backflow prevention assemblies included in the District’s program has been driven
primarily by residential fire suppression system code requirements.Residential
homes constructed within the District’s service territory are required to be equipped
with an acceptable fire suppression system.The manner in which most of these
residential fire systems operate creates a potential cross-connection hazard with the
District’s potable water distribution system,requiring the property owner to install and
maintain an approved backflow prevention assembly.In addition to the increase in
new single family residential construction,the District has also experienced an
increase in multi family and commercial construction,in which multiple backflow
assemblies are often required for compliance.
Staff has experienced an average increase of 90-95 new assemblies a year,with the
program total approaching 1,500.The demand on staff labor hours has increased as
well,with more than half of the Senior Water Quality Technician’s time being
dedicated to the responsibilities of implementation and management of the program.
These responsibilities include:
•New customer account registration;
•Database management;
•Issuing assembly test notifications;
•Test result data entry;
•Issuing assembly non-compliance and shut-off notifications;
•New construction site inspections;
•Site surveys;
•Return to service and compliance inspections;and
•Annual reporting.
While a large portion of staff’s labor associated with the Cross-Connection Control
Program is directly related to routine tasks and responsibilities,a growing segment of
program management has been the need to actively investigate and respond to out of
compliance assemblies and failed or delinquent test reports.This process often
includes repeated efforts to make contact with property owners and property
management companies,schedule site visits,or eventually issuing notices of non
compliance and service terminations.These efforts are further complicated by
seasonal occupancy,third party property management firms,and limited access
during the winter months.The costs associated with the additional labor hours
allocated to the implementation and management of the District’s Cross-Connection
Control Program are currently accounted for by the rates funded Water Operations
and Maintenance Budget.
District Code,Title 6 Water Service,Chapter 6.56 Backflow and Cross-Connections
outlines the components of the District’s Cross-Connection Control Program.District
code currently provides very general provisions for compliance with the program,as
well as defining customer and District responsibilities.In order to more effectively and
efficiently manage the District’s Cross-Connection Control Program,staff proposes the
amendment of District Code Title 6,Chapter 6.56 to include more comprehensive
direction and guidelines for both staff and water service customers.Additionally,staff
is proposing to the Board for consideration,new fees and charges to recover the costs
of specific Cross-Connection Control Program services provided by Water Utility

4.ASCAL IMPACT
The amendments to Distrcit Code,Title 6 Water Services,Chapter 6.56 Backf low and
Cross-Connections and the Miscellaneous Fees Schedule are intended to transfer the
costs associated with the Distrcit’s Cross-Connection Control Program from the rates
funded Water Operations and Maintenance Budget to fees and charges assessed to
property owners for the compliance of customer owned backflow prevention
assemblies.
5.RECOMMENDATION
Adopt resolution 2019-31 amending District Code,Title 6 Water Services and
Appendix C,Miscellaneous Fees Schedule as proposed.

ADOPTING AMENDMENTS TO THE DISTRICT CODE
TITLE 6
WHEREAS,the District Code provides rules and regulations intended to convey a comprehensive description
of the manner in which the District manages,operates,and provides water utility services;and
WHEREAS,the District has identified a need to provide a more comprehensive policy for the implementation
and management of Backf low and Cross-Connection Control;and
WHEREAS,workshops on the regulatory requirements in the State of California,District and customer
responsibilities,general provisions of a cross-connection control program and necessary revisions to Title 6,
6.56 Backtlow and Cross-Connection Control held at the October 16,2019 and November 6,2019 Board
meetings;and
WHEREAS,the Board of Directors of Truckee Donner Public Utility District has chosen to amend the District
Code Title 6.56;and
NOW,THEREFORE,THE BOARD OF DIRECTORS OF THE TRUCKEE-DONNER PUBLIC UTILITIES
DISTRICT DOES RESOLVE AS FOLLOWS:
Section 1.All previously adopted resolutions related to District Code Title 6.56 are hereby rescinded;and
Section 2.That the Board does hereby adopt the amended District Code,Title 6,6.56 related to the
Backf low and Cross-Connection Control Program;

6.56.010 P.~I of this policy is to:
1.Protect the District’s potable water supply from the possibility of contamination or
pollution by isolating within the customer’s internal distribution system(s)or the
customer’s private water system(s)any contaminants or pollutants which could
backflow into the public water systems.
2.Promote the elimination or control of existing cross-connections,actual or potential,
between the customer’s in-plant potable water system and non-potable water
system,plumbing fixtures and industrial piping systems.

4.The District shall have a backf low prevention and cross-connection control program
which moots or exceeds all State and Federal rules and regulations.
6.56.020 District Responsibilities The District shall be responsible for the protection of the
public potable wator distribution system from contamination or pollution due to thebackf low of
contaminants or pollutants through the water service connection.It is the responsibility of the
District to evaluate the hazards beyond the service connection in a customer’s water system
to determine whether pollutants or contaminants are,or may be,handled on the customer’s
premises in such a manner as to possibly permit contamination of the public water system.
The District has the right to disconnect service to any customer whose water system may
potentially harm the public water system.
When a hazard or potential hazard to the public water system is found or suspected,the
customer shall be required to install an approved backf low prevention assembly at each public
water service connection to the promises in accordance with District rules and regulations.
The District shall not be respensiblo for any loss or damage directly or indirectly resulting from
or caused by the proper,improper or negligent installation,operations,use,repair or
maintenance of,or interfering with,any protective device by any customer or any other person.

6.56.030 Customer Responsibilities
6.56.030.1 The customer shall bo required to furnish and install,in a manner approvod by the
District,and keep in good working order and safe condition,any and all backf low prevention
assemblios.All backflow prevention assemblies shall bo owned and maintained by the
customer.
6.56.030.2 All backf low prevention assemblies shall be tested at the time of installation and
annually thereafter.In the event of high hazard installations,the District may require more
frequent testing.Backf low prevention assemblies shall be tested by a certified backf low
prevention assembly tester and test reports shall be submitted to the District.
6.56.030.3 In the event that a backflow prevention assembly is found to be damaged,
defective or operating improperly,it shall be repaired or replaced by the customer.
6.56.030.4 The customer shall not bypass or render inoperative any backf low prevention
assembly.If a backf low prevention assembly is temporarily removed for repair or other reason,
the customer shall provide an approved backf low prevention assembly,tooted by a certified
backf low prevention assembly tester at the time of installation.
6.56.030.5 The customer is to maintain an adequate heat source to any backflow
preventionassembly housings in order to prevent cold weather from affecting the operation of
the assembly.
6.56.030.6 Once notified of the need to install a backf low prevention assembly,the customer
shall immediately install such approved assembly at the customer’s own expense.Failure,
refusal or inability on tho part of the customer to install,have tested and maintain said
assembly shall constitute sufficient grounds for disconnection of water service to the premises
until such requirements havo boen satisfactorily met.
6.56.040 Protective Devices Required The protection required to prevent backf low into the
public water system shall be commensurate with the degree of hazard that oxists on the
customers premises.The District shall determine the type of backf low prevention assembly.
6.56.050 Testing and Maintenance All backflow prevention assemblies shall be tested
annually to assure proper operation.In instances where a hazard is deemed great enough,
testing may be required at more frequent intervals.Such intervals shall be determined by the
District.The customer shall bear all costs of device testing.The cost of any maintenance
required as a result of inspections or testing is the responsibility of the customer.Maintenance

work shall be performed by private contract.Records of inspections,to6ting or repairs shall
be kept by the District and made available to the appropriato regulatory agencies.
Tho District shall notify the customer when tests are required and supply the necessary test
forms and instructions.These forms will be completed by the certified backf low-prevention
tester and returned to the District by the date indicated.
If a device is found to be in non compliance by inspection and/or testing,the customer shall
be notified in writing.The customer shall correct any deficiency within 15 calendar days of
notification,at which time the inspection shall be repeated.The District shall disconnect water
service if a backf low prevention device has failed to be tested properly or properly maintained
or installed.Notification of intent to terminate water service shall be commensurate with the
hazard to public health and may be delivered to the tenant,owner,or both as the situation
requires.
6.5&060 Fees and Charges Backf low prevention devices shall be subject to fees and
charges to allow the District to recover the costs of administering the backf low prevention
program.Such fees and charges shall be posted in a schedule approved by the District’s
Board of Diroctor’s.

6.56.010 Purpose The purpose of this rolicy is to:
1.Protect the public potable water supply served by the Truckee Donner Public Utility District
(TDPUD)from the possibility of contamination or pollution by isolating,within its customers
internal distrbution system,such contaminants or pollutants which could backf low or back
siphon into the public water system.
2 Promote the elimination or control of existing cross-connections,actual or potential,
between the customer’s in-plant potable water system,and non-potable water systems

3.Implement an effective and sustainable cross-connection control program in compliance
with the California Administrative Code,Title 17 and the Federal Safe Drinking Water Act.
4.Promote the education of TDPUD water utility customers in the presence or potential
presence of water contamination or pollution hazards.
6.56.020 Authority
1.The Federal Safe Drinking Water Act of 1974 identifies the water purveyor as having the
primary responsibility for preventing water from unapproved sources,or any other substances,
from entering the public potable water system.
2.The California Administrative Code,Title 17,subsection 7584 indicates that the water
supplier shall protect the public water supply from contamination by implementation of a cross-
connection control program.
2.The Truckee Donner Public Utility District,Rules and Regulations,adopted
6.56.030 Definitions For the purposes of this chapter,the following terms shall be defined
as:
(a)Air Gap Separation —a physical separation between the potable water supply line
and a receiving vessel.The separation distance shall be a minimum of twice the
diameter of the receiving vessel.
(b)American Water Works Association-Shall be synonymous with AWWA
(c)Approved Water Supply —potable water supplied and conveyed by the Truckee
Donner Public Utility District (TDPUD)
(d)Approved Backflow Prevention Assembly-An assembly that is accepted,at the
time of installation,by the University of Southern California Foundation for Cross-
Connection Control and Hydraulic Research based on a favorable field and
laboratory report;on the current USC-FCCCHR List of Approved List of Backflow
Prevention Assemblies at the time of installation.
(e)Atmospheric Vacuum Breaker Assembly-an assembly containing an air inlet
valve,a check seat and an air inlet port(s).The flow of water into the body causes
the air inlet valve to close the air inlet port(s).
(f)Auxiliary Water Supply —any water supply other than that received from the
Truckee Donner Public Utility District (TDPUD)
(g)AWWA Standard —official standard developed and approved by the American
Water Works Association (AWWA)
(h)Backf low-The undesirable reversal of flow of water or mixtures of water and other
liguids,gases or other substances into the distribution pipes of the potable water
supply of water from any source or sources.
(i)California-Nevada Section American Water Works Association-Shall be
synonymous with CA-NV AWWA
(j)Certified Backf low Prevention Assembly Tester-an individual who is certified by
the CA-NV AWWA to test backflow prevention assemblies in Nevada County
and/or Placer County.
(k)Contaminant-any substance that shall impair the quality of water,in such a way
as to create an actual hazard to the public health

(I)onstruction Water-any water,potable or otherwise,that is being utilized for
construction purposes (dust control,excavation,compaction,grading,etc.)
(m)Cross-Connection —an unprotected actual or potential connection between a
potable water system and any source or system containing unapproved water or
a substance that is not or cannot be approved as safe and potable.
(n)Cross-Connection Control Program Inspector —Representative designated by
the TDPUD,to review and approve the installation and testing of backflow
prevention assemblies,and to conduct cross-connection site surveys within the
TDPUD water service boundaries.
(o)Degree of Hazard-either a pollutant (non-health hazard)or a contaminant (health
hazard);derived from the assessment of the materials,which may come in contact
with the distribution system through a cross-connection.
(p)Direct Cross-Connection —A cross-connection which is subiect to
backsiphonage and back pressure.
(q)Distribution System —Shall be synonymous with TDPUD’s water distribution
system.
(r)District-Shall be synonymous with Truckee Donner Public Utility District (TDPUD)
(s)Double Check Valve Backf low Prevention Assembly (DC)—an assembly of at
least two independently acting,approved check va yes,including tightly closing
resilient seated test cocks.
(t)Health Agency-The California Department of Public Hea th
(u)Indirect Cross-Connection —A cross-connection that is subiect to backsiphonage
only.
(v)Non-potable Water —A water supply which has not been approved for human
consumption by the health agency having jurisdiction.
(w)Point of Service Connection —the terminal end of a service connection from the
public water system The point at which the TDPUD no longer maintains sanitary
control (downstream sde of the water meter,meter tube assembly,or service
valve box).
(x)Pollutant-any substance that shall impair the quality of the water to a degree
which does not create a hazard to the public health but which does adversely and
unreasonably affect the aesthetic qualities of the water for domestic use.
(y)Potable Water-Water which has been investigated by the Californ a Department
of Public Health and has been approved for human consumpton.
(z)Pressure Vacuum Breaker Backsiphonage Prevention Assembly
(aa)Readily Accessible-capable of being reached for testing and/or maintenance,
without the need of removing any access panel,door,or sim ar obstruction
(bb)Reduced Pressure Principle Backf low Prevention Assembly (RP)-an
assembly containing two independently acting approved check valves together
with a hydraulically operating,mechanically independent pressure differential relef
valve located between the check valves and at the same time below the first check
valve (USCFCCCHR)

6.56.040 Responsibilities
6.56.040.01 District Responsibility The TDPUD (Water Supplier)shall protect the public
water supply from contamination by implementation of a cross-connection control program.
The program,or any portion thereof,may be implemented directly by the TDPUD or by means
of a contract with an approved agency.The TDPUD’s cross-connection control program shall
for the purposes of addressing the requirements of California Administrative Code,Title 17,
Sections 7585 through 7605 include,but not be limited to,the following elements:
a.)The adoption of operating rules and/or ordinance to implement the cross-
connection program.
b.)The conducting of surveys to identify water user premises where cross
connections are likely to occur.
c.)The provisions of backflow protection by the water user at the user’s/owner’s
connection or within the user/owner’s premises or both
d.)The provision of at least one person trained in cross-connection control to manage
the cross-connection program.
e)The establishment of a backf low prevention assembly testing procedure or system
f.)The maintenance of records of locations,tests,and repairs of backflow prevention
assemblies.
When a hazard or potential hazard to the public water system is found or suspected,the
customer shall be required to install an approved backf low prevention assembly at each public
water service connection to the premises in accordance with the District rules and regulations.
The District shall not be responsjble for any loss or damage directly or indirectly resulting from
or caused by the proper,improper or negligent installation,operations,use,repair or
maintenance of,or interfering with any protective device by a customer or any other person.
6.56.040.2 Customer Responsibility The customer has the responsibility of preventing the
pollution or contamination of the private and/or public potable water system due to cross-
connection or backf low conditions.The customer’s responsibility begins at the point of service
connection,including the privately owned portion of his/her distribution system.The customer
shall be required to furnish and install,in a manner approved by the District,and keep in good
working order and safe condition,any and all backf low prevention assemblies.All backf low
prevention assemblies shall be owned and maintained by the property owner.Water user
and/or property shall be responsible for all costs associated with the installation,operation
and maintenance of the requred backflow prevention assembly,including but not limited to
necessary p umbing upgrades,vaults,pumps,and heating facTties.
6.56.050 Backf low Assembly Requirements

656.050.1 General Installation Requirements Backf low prevention assemblies are required
to be installed on all water service connections determined by the District’s Senior Water
Quality Technician/Inspector,or designated Cross-Connection Control Program Inspector,to
present an actual or potential backflow of a contaminant or pollutant into the distribution
system.The backtlow prevention assembly shall be installed according to the District
standards as a condition of new water service connections and continued water service.
Backf low prevention assemblies installed on new water service connections must be an
approved device and installed according to District Standards.The installation of backflow
prevention assemblies on existing service connection retrof its,or where existing construction
prevents installations according to District Standards must be approved by the District’s
Cross-Connection Control Inspector and will be handled on a case by case basis.
6.56.050.2 Approved Assemblies
Backf low prevention assemblies to be installed as service protection shall be listed on the
most current edition of the USC-FCCCHR,University of Southern California Lst of Approved
Backflow Prevention Assemblies.A current list of USC-FCCCHR approved assemblies shall
be made available by the District upon request.Backf low prevention assemblies must be
installed as approved,a complete unit,and in the correct alignment in order to be considered
a USC-FCCCHR approved assembly.
6.56.050.3 Installation Location Requirements
The installation location for all backflow prevention assemblies intended to provide TDPUD
water service protection must be approved by the District Cross-Connection Control Program
Inspector or Water System Engineer.
Backflow prevention assemblies installed to provide protection to a water utility connection
served by the District shall be installed at the point of connection,immediately downstream of
the meter and according to the most current edition of the USC Manual of Cross-Connection
Control,unless otherwise approved by the District due to special circumstances.
Double Check Valve Assemblies (DC)—shall be installed in a vault,immediately
downstream of the meter,or in the closest reasonable location as approved by the
District
Reduced Pressure Principle Assemblies (RP)—shall be installed a minimum of 12”
above grade,in a heated enclosure immediately downstream of the meter,or in the
closest reasonable location as approved by the District
The District may allow,at its sole discretion,special circumstances that will permit the
installation of a backflow prevention assembly in a location other than immediately
downstream of the point of connecton (meter).These special circumstances shall include
but are not urn ted to:
o Limited space due to pre-existing obstructions or right of ways
o Unable to provide heated enclosures or freeze protection

The installation location provides sufficient space and drainage for the operation,
testing and maintenance of the assembly
o Sufficient demonstration that there are no additional taps or service laterals from the
point of connection to the first backf low assembly
District access to the installation location upon request for the purposes of inspection
and/or assembly testing.
The District reserves the right to revoke the special circumstances due to real or perceived
changes in the private water system and require the water customer to install the appropriate
backflow prevention assembly at the point of connection,immediate y downstream of the
meter at the cost of the customer or property owner
6.56.060 Testing and Maintenance
6.56.060.1 Backf low Prevention Assembly Testing
All backf low prevention assemblies shall be tested in accordance with the District Code by a
technician with a valid backf low prevention assembly tester certification from the American
Water Works Association (AWWA)at the expense of the water service account holder or
property owner.Following the testing of each backflow prevention assembly,the water
service account holder or property owner shall submit a completed test report to the District’s
Cross-Connection Control Program Inspector,in accordance with the District’s Backflow
Prevention Assembly Test Instructions,prior to the testing deadline.A list of approved
backf low prevention assembly testers registered with the District shall be made available on
the District website.
Backf low prevention assembly tests are required:
1 Upon installation of a new device
2.Following the repair,replacement or relocation of a device
3.Annually (District will notify property owner of testing deadline)
4.Upon the reguest of the District’s Cross Connection Control Program inspector,based
on previous assembly test failures,real or perceived changes in conditions on
property,or result of site survey (District will deliver to property owner or water
customer a written request for updated test)
Completion of backflow assembly tests and submitting the testing report is a conditon of new
water service approval and/or the continuation of existing water service
6.56.060.2 Initial Test
Each backflow prevention assembly shall be tested by an approved tester upon installation.
The successful test results shall be submitted to the District Cross-Connection Control
Program Inspector within 10 days of the test completion.If the backf low prevention assembly
does not pass the initia test,it is the property owner’s responsibility to have the necessary
repairs made and assembly re-tested.Failure to submit a successful test report shall result
in the termination of water service as outlined in the District Code 6.56 080.
New Service:Each backf low prevention assembly installed for protection of a new
TDPUD water service shall be tested by an approved tester,at the expense of the
property owner or water customer,upon installation and prior to final approval of the

service connection.In addition to a successful test report,the final installation must
be inspected by the District Cross-Connection Control Program Inspector or the
District Water System Engineer prior to final approval and activation of the service
connection.If upon inspection the device is not compliant with District code a follow
up inspection by the District is subject to fees in accordance with the Dstrict’s
approved Miscellaneous Fees and Charges Schedule and service will be terminated
until compliance ‘s met
o Existing Service/Retrofit:Each backflow preventon assembly installed for
protection of an existing service retrofit shall be tested,at the expense of the customer,
by an approved tester and inspected by the District Cross-Connection Control
Program Inspector as a condition of continued water service.
6.56.060.3 Annual Test
Each backf low prevention assembly installed for protection of a TDPUD water service shall
be tested by an approved tester at a minimum annually.The District’s Cross-Connection
Control Program Inspector will provide water customers w th notfication of annual testing
requirements as follows:
1.FIRST NOTICE-The District shall provide notification of backf low prevention
assembly test requirement no less than forty five (45)days prior to due date.
2.SECOND NOTICE-Once the backf low assembly test report has become fifteen (15)
days past due,TDPUD will send a second notice,indicating submittal of a successful
test is past due.The second notice will provide fifteen (15)business days for
submittal of a successful test report.
3 THIRD NOTICE-When testing of the device is thirty (30)days past due,TDPUD shall
provide a third notice indicating non-compliance with the District’s annual backflow
assembly testing requirements,in addition to a late fee in accordance with the
District’s current Miscellaneous Fees and Charges Schedule.The notice will provide
five (5)business days for compliance,If the TDPUD does not receive a successful
test report within five business days,the water service requiring the backflow
prevention device may be terminated until a successful test report is received by the
District’s Cross-Connection Control Program Inspector.
6.56.060.3 Replacement or Repair of Backflow Prevention Assemblies
It is the property owner or water customer responsibility to provide the District Cross-
Connection Control Program Inspector with a successful test report from an approved
backf low prevention assembly tester,immediately following the replacement or repair of a
backflow prevention device installed to protect a water service connected to the TDPUD
distribution system.The successful test report shall include a description of the repairs and/or
parts replaced.Assemblies that have been repaired or replaced are deemed unapproved
assemblies until the District is in receipt of an updated report of a successful test by an
approved assembly tester.If the device fails the annual test the customer must notify to District
immediately.The customer will then have 30 days to repair or replace the device.
6.56.070 CONSTRUCTION WATER

6.56.070.1 District Construction Water Supply
The District Code requires that all service connections for non-potable use,including
construction water,be equipped with a backflow prevention assembly.The TDPUD may
provide water supply for construction purposes throuqh the use of the following sources:
Water Truck or Trailer-Mounted Tank Fill Site-Customers may acquire a District
permit,subiect to current applicable fees and restrictions,to fill a water truck or trailer-
mounted tank at a well site designated by the TDPUD.Permits shall be issued to a
specific water truck or trailer-mounted tank,for a specified period of time.All water
trucks and trailer-mounted tanks shall be equipped with a District approved air qap
and must be able to provide proof of valid perm t to any District employee upon
request.
Fire Hydrant Mounted Construction Meter (Subject to approval on a case by case
basis)-Customers may acquire a District permit,subject to cur ent app cable fees
and restrictions,to utilize a designated fire hydrant-mounted water meter for the
purposes of a construction water supply.Permits shall be issued to a specific water
truck or trailer-mounted tank,for a specific hydrant,and for a specified period of time.
All water trucks and trailer-mounted tanks shall be equipped with a District approved
air gap and must be able to provide proof of valid permit to any District employee upon
request.Permits for fire hydrant use will be evaluated on a case by case basis and
issued only in those circumstances where travel to and from the project and the District
well puts undue hardship on the contractor and/or public,and is subject to Water Utility
Director approval.
Permanent Commercial or Residential Water Meter-Customers may apply for
permanent metered service at the location the construction proiect is to take place.
The permanent service is subject to all applicable fees and construction standards as
required by the District’s Water System Engineer.The District does not germ t
temporary construction meters for residential or commercial water service
connections.
6.56.0 0 PROGRAM ENFORCEMENT
6.56.080.01 General Program Enforcement
The Truckee Donner Public Utility District is responsible for the protection of the public water
distribution system from contamination due to real or potential cross-connection conditions.
A component of this responsibility is the enforcement of District Code,relative to the District’s
Cross-Connection Control Program,throuqh prescribed enforcement actions as outlined
below:
1.Notification of Non-Compliance
2.Termination of Water Service
6.56.080.02 Notification of Non-Compliance
The District Cross-Connection Control Program Inspector will issue to the water customer or
property owner,a written notifications of non-compliance upon the discovery of a TDPUD
water service connection presenting a real or potential cross-connection conditon.Conditions
of non-compliance include but are not limited to:

1.An unprotected direct or indirect connection between the public water system and a
contaminant
2.A backf low prevention assembly that has been moved,replaced or retrofitted without
notifying the District Cross-Connection Control Program Inspector
3.A backf low prevention assembly that does not meet or exceed the level of protection
required for a hazard,as determined by the District Cross-Connection Control
Program Inspector
4.Installation of an unapproved backf low prevention assembly
5.Installation of a backflow prevention assembly in an unapproved location or an
unapproved alignment
6.Failure to submit a successful test report from an approved backflow prevention
assembly tester as required under District Code 6.56.060 Testing and Maintenance
The TDPUD will issue Notifications of Non-Compliance,identifying the corrective actions
required and the permitted timeline for full compliance.Notifications of Non-Compliance will
issued according to the following schedule:
1.FIRST NOTICE-TDPUD will issue a Notification of Non-Compliance,providing fifteen
(15)business days for fu compliance and the submittal of a successful test report
2.SECOND OTICE-TDPUD will issue a second Notice of Non-Compliance,providing
five (5)business days for fu comp ance and the submittal of a successful test report.
3.THIRD OTICE-TDPUD will provide a thjrd Notice of Non-Compliance and 48 Hour
Notice of Service Termination.If the TDPUD does not receive a successful test report
within 48 hours,the water service requiring the backf low prevention assembly may be
terminated until a successful test report is received by the District’s Cross-Connection
Control Program Inspector
6.56.080.03 Termination of Service
TDPUD staff may terminate a water service connection without notice upon the discovery of
a real or potential cross-connection condition presents an immediate hazard to the potable
water supply.Immediate terminat on of a water service connections may occur under one or
more of the following conditions.
1.Direct or indirect cross-connection exists between the public water system and a sewer
system
2.Unprotected direct or indirect cross-connection between the public water system and
a high hazard or lethal contaminant
3.Unprotected direct or indirect cross-connection between the public water system and
an approved water supply
6.56.090 FEES AND CHARGES
Water service connections required to furnish and maintain acceptable cross-connection
control assemblies in accordance with District Code,Chapter 6.56 shall be subject to the
associated fees and penalties as outlined in the District’s Miscellaneous Fees (District Code
Appendix C)

Code Title 6.56.
