DistrictAgendaItem#13TRUCKEEDONNERPublicUtilityDistrictCONSENTTo:BoardofDirectorsFrom:ReginaWiseDate:March04,2020Subject:ConsiderationofAnnualResolutionsfortheDonnerLakeAssessmentDistrict1.WHYTHISMATTERISBEFORETHEBOARDThisitemconcernscollectingDonnerLakeAssessmentDistrictNo.00-1assessmentchargesinNevadaandPlacerCountiesbytheadoptionofstandardresolutions.2.HISTORYDistrictResolutionNo.9723adoptedonNovember5,1997authorizedtheexecutionofastandardformtaxcollectionservicescontractonbehalfoftheDistrictwiththeCountyofNevada.ThecontractstatesthattheDistrictmustadoptanannualresolutionrequestingplacementofspecialtaxes,specialassessmentsand/orparcelchargesontheCountyofNevadataxrolls.FinallistswillbeonrecordwithNevadaandPlacerCountiesandintheAdministrativeServicesDepartment.OnMay2,2001,theDistrictadoptedResolutionNo.2001-09makingdeterminations,confirmingassessmentsandproceedings,orderingtheacquisitionandconstructionofimprovementsandtakingcertainotheractionsrelatingtoDonnerLakeWaterAssessmentDistrictNo.00-1.3.NEWINFORMATIONThismattercomesbeforetheBoardeachyear.TheDistrictutilizesNevadaandPlacerCountiestocollectassessmentsandspecialtaxesaslineitemsontheannualpropertytaxbills..Attachment1isResolution2020-07fortheDonnerLakeAssessmentDistrictNo.00-1tocollecttheannualassessmentsfortheFY20andFY21withNevadaCounty..Attachment2isResolution2020-08fortheDonnerLakeAssessmentDistrictNo.00-1tocollecttheannualassessmentsfortheFY20andFY21withPlacerCounty. Attachment1k1RucKEEDONNER-PublicUtilityDistrictResolutionNo.2020-07FixingandPlacingDonnerLakeAssessmentDistrictAnnualChargesonDistrictTaxRollforCollectionbytheCountyofNevadaWHEREAS,theTruckeeDonnerPublicUtilityDistrictonMay2,2001adoptedResolutionNo.2001-09makingdeterminations,confirmingassessmentsandproceedings,orderingtheacquisitionandconstructionofimprovementsandtakingcertainotheractionsrelatingtoDonnerLakeWaterAssessmentDistrictNo.00-1;andWHEREAS,byResolutionNo.9723adoptedNovember5,1997,theBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictapprovedexecutionofacontinuousStandardFormTaxCollectionServicesContractwiththeCountyofNevada;andWHEREAS,theDistricthasnowdeterminedthelandsaffectedtherebyandthechargestobeassessed,leviedandcollectedonthelandsandparcels;andWHEREAS,theassessmentsoneachparcelshallbebilledonthesecuredtaxrollbillsforthefiscalyear2020-2021.NOW,THEREFORE,BEITRESOLVEDbytheBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictasfollows:1.ThattheBoardofSupervisorsoftheCountyofNevada,StateofCalifornia,levytheDonnerLakeAssessmentDistrictchargesagainsttheparcelsandownersofrecordlistedonthecomputeritemizationofparcelskeptandmaintainedintheAdministrativeServicesDepartmentoftheDistrictandmadeaparthereofbyreference,andthattheCountyAuditorandTaxCollectorbeinstructedtolevyandcollectsaidchargesinthesamemannerasCountytaxesasbylawandinsaidordinanceprovided.UponcompletionandcorrectionofthecurrentlistthroughJune30,2020,acopywillbeforwardedtotheAuditorControlleroftheCounty.2.TheDistrictwarrantsandrepresentsthatchargesimposedbytheDistrictandbeingrequestedtobecollectedbyNevadaCountycomplywithallrequirementsofstatelaw,includingbutnotlimitedtoArticlesXIIICandXIIIDoftheCaliforniaConstitution(Proposition218).1
