Kuhlemier, CMC, District Clerk RECOMMENDATION: Consideration to Accept the November 3, 2020 Election Results. DISCUSSION: The District consolidates our elections with Nevada and Placer Counties on even yes during the General Election. The consolidation of elections is done to ensure compliance with election law and provide cost saving measures for the rate payers. In the spring of 2020, the Board approved Resolutions 2020-16 and 2020-17 to consolidate with the respective counties. The District has three open seats; President Bender, Director Ellis, and Director Aguera. From July until August, perspective candidates pulled election papers with the counties to run for office. At that point, there were five candidates for the three positions. All three incumbents filed for re-election in addition, Kim Harris and Cathy Stewart. The Counties are required by election law to certify special district election results on the Monday prior to the first Friday in December. This requirement proceeds the law that requires special district's to seat their board on the first Friday in December. However, as discussed in past years, this law is in direct contradiction of the 30 day canvas law, which provides a time for the Registrar of Voters to canvas and certify the election results in 30 days. The Nevada County Registrar of Voters team completed the election count November 20, 2020, however is certifying by law on November 25, 2020. As of November 20, 2020, the Nevada and Placer County reported the three highest votes of Kim Harris 25.96%, Jeff Bender 25.75% and Joe Aguera 18.80% and Jeff Bender Page 2 of 2 25.81%, Kim Harris 25.72%, Bob Ellis 17.94%, respectively. In total the three candidates are Kim Harris, Jeff Bender, and Joe Aguera. At the end of this meeting, the new Board can be seated and take office December 4, 2020 at 12:00 p.m. 1.05.020 Objectives: 1. Responsibly serve the public FISCAL IMPACT: The Board approved FY20 budget for election expenses is estimated at $15,000. ATTACHMENTS: none.
