Wright, General Manager SUBJECT: Consideration for Approval of Electric and Water Utility Development Agreements for the Soaring Ranch Off-Site Infrastructure Improvements APPROVED BY_______________________________ Brian C. Wright, General Manager RECOMMENDATION: Authorize the General Manager to execute electric utility and water utility development agreements with J-MAR II, LLC. For the Soaring Ranch Off-Site Infrastructure Improvement project. DISCUSSION: District Codes 6.04.030.1/7.12.030.1 New Construction and Upgrades specifies that applications for new construction and upgrades of water and/or electric services totaling more than $400,000 require a development agreement presented to the Board for approval. Staff has received development applications from the developer group J-MAR II, LLC for the completion of off-site electric and water utility infrastructure associated with Soaring Ranch Phase 2. Developer intends to construct within the Town of Truckee right of way, “off-site infrastructure improvements to support the Joerger Ranch Specific Plan by completing an electric line loop from the Soaring Way/Joerger Drive intersection to the TTUSD Bus Barn”, and a water line loop from the Soaring Way/Joerger Drive intersection to the TDPUD’s existing water line located adjacent to Riverview Park, hereafter referred to as the "Project." The Project is to be built in conjunction with a mixed-use development located within the Page 2 of 3 Joerger Ranch Specific Plan area known as Soaring Ranch Phase 2. Soaring Ranch Phase 2 will consist of approximately thirty-three thousand (33,000) sq. ft. of ground level commercial space and sixty-nine (69) multi-family rental apartments to be located immediately to the southeast of Soaring Ranch Phase 1. District and Developer entered into Electric and Water Development Agreements executed by them on June 5, 2019, pursuant to which Developer agreed to construct and the District agreed to accept an electric and water distribution system for Developer’s Phase 1 of a commercial center including Raley’s grocery market and additional retail which is included within the area subject to the Joerger Ranch Specific Plan. That electric and water distribution system for Phase 1 has been constructed by Developer and accepted by the District. The off-site Project is necessary not only to support the future development within the area subject to the Joerger Ranch Specific Plan as well as other adjoining areas including the Truckee Tahoe Airport District; it is necessary to provide resilience and reliability to the electric and water distribution systems constructed for Developer’s Phase 1 of a commercial center including Raley’s grocery market and additional retail on Developer’s property. Completed plans and specifications for the Project have been submitted by the developer and have been reviewed and approved by TDPUD staff in accordance with District requirements. District Counsel has conducted a legal review of the proposed development agreements. Staff has reviewed and approved the terms of the agreements.
