Home My WebLink AboutRES 2020-14 - BoardTRUCKEEDONNERPublicUtilityDistrctResolutionNo.2020-14RequestingCollectionofElectricandWaterStandbyChargesonPlacerCountyTaxRollWHEREAS,theTruckeeDonnerPublicUtilityDistrictrequeststheCountyofPlacercollectontheCountytaxrollscertainchargeswhichhavebeenimposedbytheDistrictpursuanttoResolutionNo.2020-12and2020-13attached,andWHEREAS,theCountyhasrequiredasaconditionofthecollectionofsaidchargesthattheDistrictwarrantthelegalityofsaidchargesanddefendandindemnifytheCountyfromanychallengetothelegalitythereof.NOW,THEREFORE,BEITRESOLVEDbytheBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictasfollows:1.TheAuditor-ControllerofPlacerCountyisrequestedtoattachforcollectionontheCountytaxrollsthosetaxes,assessments,feesand/orcharges,attachedhereto;2.TheDistrictwarrantsandrepresentsthatthetaxes,assessments,feesand/orchargesimposedbytheDistrictandbeingrequestedtobecollectedbyPlacerCountycomplywithallrequirementsofstatelaw,includingbutnotlimitedtoArticlesXIIICandXlllDoftheCaliforniaConstitution(Proposition218);3.TheDistrictreleasesanddischargesCounty,anditsofficers,agentsandemployeesfromanyandallclaims,demands,liabilities,costsandexpenses,damages,causesofaction,andjudgments,inanymannerarisingoutofthecollectionbyCountyonthepropertytaxtollofanytaxes,assessments,feesand/orchargesonbehalfofDistrict;4.InconsiderationfortheCounty’scollectionofthechargethroughtheCounty’spropertytaxroll,theDistrictagreestoandshalldefend,indemnifyandholdharmlesstheCounty,itsofficers,agentsandemployees(the“IndemnifiedParties”)fromanyandallclaims,demands,liabilities,costsandexpenses,damages,causesofaction,andjudgments,inanymannerarisingoutofthecollectionbyCountyofanyofDistrict’ssaidtaxes,assessments,feesand/orchargesrequestedtobecollectedbyCountyforDistrict,orinanymanner1 arisingoutofDistrict’sestablishmentandimpositionofsaidtaxes,assessments,feesand/orcharges.Districtagreesthat,intheeventajudgmentisenteredinacourtoflawagainstanyoftheIndemnifiedPartiesasaresultofthecollectionofoneofDistrict’staxes,assessments,feesand/orcharges,theCountymayoffsettheamountofthejudgmentfromanyothermoniescollectedbyCountyonbehalfofDistrict,includingpropertytaxes;5.TheDistrictagreesthatitsofficers,agentsandemployeeswillcooperatewiththeCountyinansweringquestionsreferredtoDistrictbyCountyfromanypersonconcerningtheDistrict’staxes,assessments,feesand/orcharges,andthatDistrictwillnotrefersuchpersonstoCountyofficersandemployeesforresponse;and6.TheDistrictagreestopaytheCountyforthereasonableandordinarychargestorecoupitscostsofplacementandcollectiononthetaxrollsattheagreeduponrateof1%ofthetaxes,assessments,feesand/orcharges,asprovidedbyGovernmentCodesection29304and51800.PASSEDANDADOPTEDbytheBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictatameetingheldwithinsaidDistrictonMay20,2020bythefollowingrollcallvote:AYES:Directors:Laliotis,Ellis,VicePresidentFinn,andPresidentBenderNOES:ABSENT:DirectorAgueraTRUCKEEDONNERPUBLICUTILITYDISTRICTBy__JeffBen,iPTèsidentATST:ShannaD.Kuhlemier,CMC,DistrictClerk2
