Home My WebLink AboutRES 2020-15 - Boardr:TRucKEEDONNERIPubITcUtitityDistrictResolutionNo.2020-15FixingandPlacingElectricandWaterStandbyChargesonCountyofNevadaTaxRollforCollectionWHEREAS,onFebruary18,1975,theBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictdulyadoptedOrdinanceNo.7501fixingElectricandWaterStandbyChargesonlandswithintheDistrictboundariesandprovidingameansforcollectionthereof;andWHEREAS,onAugust16,1982,theBoardadoptedResolutionNo.8240amendingOrdinance7501toincludePlaceraswellasNevadaCounty;andWHEREAS,onMarch18,1991,theBoardofDirectorsadoptedOrdinanceNo.9103amendingOrdinanceNo.7501andResolutionNo.8240totheextentthatsuchordinanceandresolutionconcernthefixingofwaterstandbychargesintheCountyofNevada;andWHEREAS,onMay20,2020,theBoardadoptedResolutionNo.2020-12and2020-13continuingandfixingelectricandwaterstandbychargespursuanttoOrdinances7501,9103and9105forthefiscaltaxyear2020-2021;andWHEREAS,theDistricthasnowdeterminedthelandsaffectedtherebyandthechargestobeassessed,leviedandcollectedonthelandsandparcels;andWHEREAS,byResolutionNo.9723adoptedNovember5,1997,theBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictapprovedexecutionofacontinuousStandardFormTaxCollectionServicesContractwiththeCountyofNevada.NOW,THEREFORE,BEITRESOLVEDbytheBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictasfollows:1.ThattheBoardofSupervisorsoftheCountyofNevada,StateofCalifornia,levytheStandbyChargesagainsttheparcelnumbers(APN)ofrecordlistedonthecomputeritemizationofunimprovedparcelskeptandmaintainedintheAdministrativeServicesDepartmentoftheDistrictandmadeaparthereofbyreference,andthattheCountyAuditorandTaxCollectorbeinstructedtolevyandcollectsaidchargesinthesamemannerasCountytaxesasbylawandinsaidordinanceprovided.UponcompletionandcorrectionofthecurrentlistthroughJune30,2020,acopywillbeforwardedtotheAuditorControlleroftheCounty.1 2.TheDistrictwarrantsandrepresentsthatchargesimposedbytheDistrictandbeingrequestedtobecollectedbyNevadaCountycomplywithallrequirementsofstatelaw,includingbutnotlimitedtoArticlesXlIlCandXlllDoftheCaliforniaConstitution(Proposition218).3.ThatacertifiedcopyofthisresolutionbeforwardedtotheCountyAuditoroftheCountyofNevada.PASSEDANDADOPTEDbytheBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictatameetingheldwithinsaidDistrictonMay20,2020bythefollowingrollcallvote:AYES:NOES:ABSENT:Directors:Laliotis,Ellis,VicePresidentFinn,andPresidentBenderDirectorAguera1’’hannaD.Kuhlemier,CMC,DistrictClerkTRUCKEEDONIPUBLICUTILITYDISTRICT2
