Home My WebLink AboutRES 2020-06 - BoardResolutionNo.2020-06fmucDONNERPublicUtilityDistnctFixingandPlacingaSpecialTaxLevyonCommunityFacilitiesDistrictNo.04-1(Gray’sCrossing)forCollectionbytheCountyofNevadaWHEREAS,onJuly21,2004,theBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictdulyadoptedOrdinanceNo.2004-02,authorizingthelevyofaspecialtaxwithinsaidCommunityFacilitiesDistrictNo.04-1(GraysCrossing)andprovidingameansforcollectionthereof;andWHEREAS,byResolutionNo.9723adoptedNovember5,1997,theBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictapprovedexecutionofacontinuousStandardFormTaxCollectionServicesContractwiththeCountyofNevada;andWHEREAS,theDistricthasnowdeterminedthelandsaffectedtherebyandthechargestobeassessed,leviedandcollectedonthelandsandparcels;andWHEREAS,thetaxesoneachparcelshallbebilledonthesecuredtaxrollbillsforthefiscalyear2020-2021.NOW,THEREFORE,BEITRESOLVEDbytheBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictasfollows:1.ThattheBoardofSupervisorsoftheCountyofNevada,StateofCalifornia,levyaspecialtaxagainsttheparcelsandownersofrecordlistedonthecomputeritemizationofparcelskeptandmaintainedintheAdministrativeServicesDepartmentoftheDistrictandmadeaparthereofbyreference,andthattheCountyAuditorandTaxCollectorbeinstructedtolevyandcollectsaidchargesinthesamemannerasCountytaxesasbylawandinsaidordinanceprovide.UponcompletionandcorrectionofthecurrentIistthroughJune30,2020,acopywillbeforwardedtotheAuditorControlleroftheCounty.2.TheDistrictwarrantsandrepresentsthatchargesimposedbytheDistrictandbeingrequestedtobecollectedbyNevadaCountycomplywithallrequirementsofstatelaw,includingbutnotlimitedtoArticlesXIIICandXIIIDoftheCaliforniaConstitution(Proposition218).1 3.ThatacertifiedcopyofthisresolutionbeforwardedtotheCountyAuditoroftheCountyofNevada.PASSEDANDADOPTEDbytheBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictatameetingheldwithinsaidDistrictonMarch4,2020bythefollowingrollcallvote:AYES:NOES:ABSENT:Directors:Laliotis,Ellis,VicePresidentFinn,andPresidentBenderDirectorAgueraTRUCKEEDONNERPUBLICUTILITYDISTRICTByJeffATTEST:SannaD.Kuhlemier,CMC,DistrictClerk2
