Home My WebLink AboutRES 2020-08 - BoardTRUCKEEDONNER..:.PublicUtilityDistricJResolutionNo.2020-08RequestingCollectionofDonnerLakeAssessmentDistrictAnnualchargesonPlacerCountyTaxRollWHEREAS,theTruckeeDonnerPublicUtilityDistrictonMay2,2001adoptedResolutionNo.2001-09makingdeterminations,confirmingassessmentsandproceedings,orderingtheacquisitionandconstructionofimprovementsandtakingcertainotheractionsrelatingtoDonnerLakeWaterAssessmentDistrictNo.00-1;andWHEREAS,theTruckeeDonnerPublicUtilityDistrictrequeststheCountyofPlacercollectontheCountytaxrollscertainchargeswhichhavebeenimposedbytheDistrictforthefiscaltaxyear2020-2021;andWHEREAS,theCountyhasrequiredasaconditionofthecollectionofsaidchargesthattheDistrictwarrantthelegalityofsaidchargesanddefendandindemnifytheCountyfromanychallengetothelegalitythereof.NOW,THEREFORE,BEITRESOLVEDbytheBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictasfollows:1.TheAuditor-ControllerofPlacerCountyisrequestedtoattachforcollectionontheCountytaxrollsthoseassessmentsattachedhereto.2.TheDistrictwarrantsandrepresentsthattheassessmentsimposedbytheDistrictandbeingrequestedtobecollectedbyPlacerCountycomplywithallrequirementsofstatelaw,includingbutnotlimitedtoArticlesXlIlCandXIllDoftheCaliforniaConstitution(Proposition218).3.TheDistrictreleasesanddischargesCounty,anditsofficers,agentsandemployeesfromanyandallclaims,demands,liabilities,costsandexpenses,damages,causesofaction,andjudgments,inanymannerarisingoutofthecollectionbycountyofanyassessmentsonbehalfofDistrict.4.TheDistrictagreestoandshalldefend,indemnifyandholdharmlessthecounty,itsofficers,agentsandemployees(the“IndemnifiedParties”)fromanyandallclaims,demands,liabilities,costsandexpenses,damages,causesofaction,andjudgments,inanymannerarisingoutofthecollectionbyCountyofanyofDistrict’ssaid1 assessmentsrequestedtobecollectedbyCountyfordistrict,orinanymannerarisingoutofDistrict’sestablishmentandimpositionofassessments.Districtagreesthat,intheeventajudgmentisenteredinacourtoflawagainstanyoftheIndemnifiedPartiesasaresultofthecollectionofoneofDistrict’sassessmentstheCountymayoffsettheamountofthejudgmentfromanyothermoniescollectedbyCountyonbehalfofDistrict,includingpropertytaxes.5.TheDistrictagreesthatitsofficers,agentsandemployeeswillcooperatewiththeCountyinansweringquestionsreferredtoDistrictbyCountyfromanypersonconcerningtheDistrict’sassessmentsandthatDistrictwillnotrefersuchpersonstoCountyofficersandemployeesforresponse.6.TheDistrictagreestopaysuchreasonableandordinarychargesastheCountymayprescribetorecoupitscostsinplacingonthetaxrollsandcollectingtheassessmentsasprovidedbyGovernmentCodesection29304and51800.PASSEDANDADOPTEDbytheBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictatameetingheldwithinsaidDistrictonMarch4,2020bythefollowingrollcallvote:AYES:Directors:Laliotis,Ellis,VicePresidentFinn,andPresidentBenderNOES:ABSENT:DirectorAgueraTRUCKEEDONNERPUBLICUTILITYDISTRICTByJeffBqhdePFêsidentATTEST:_____2
