5.12.010.3TheLatePaymentReminderNoticewillinclude:5.12.010.3(A)Thenameandaddressofthecustomerwhoseaccountisdelinquent.5.12.010.3(B)Theamountofthedelinquency.5.12.010.3(C)Thedatebywhichpaymentorarrangementsforpaymentisrequiredinordertoavoidtermination.5.12.010.3(D)Theprocedurebywhichthecustomermayinitiateacomplaintorrequestaninvestigationconcerningserviceorcharges,exceptthat,ifthebillforservicecontainsadescriptionofthatprocedure,thenoticepursuanttoSection5.12.010.2isnotrequiredtocontainthatinformation.5.12.010.3(E)Theprocedurebywhichthecustomermayrequestamortizationoftheunpaidcharges.5.12.O1O.3(F)Theprocedureforthecustomertoobtaininformationontheavailabilityoffinancialassistance,includingprivate,local,state,orfederalsources,ifapplicable.5.12.010.3(G)ThetelephonenumberofarepresentativeoftheDistrictwhocanprovideadditionalinformationorinstitutearrangementsforpayment.5.12.010.45.12.010.4FinalNoticeofTerminationofService-TheDistrictwillmakeagood-faithefforttogivetheCustomeradvancenoticeofatleast48-hoursbeforediscontinuingservice.Additionally,theDistrictshallmakeareasonableefforttocontactanindividualwhoiseighteenyearsofageorolderresidingatthepremisesofthecustomerbytelephoneorpersonalcontact.Whentelephoneorpersonalcontactcannotbeaccomplished,theDistrictmaythoughisnotrequiredtopostinaconspicuouslocationatthepremises,anoticeofterminationofservice,atleast48hourspriortotermination.Atripchargetodeliverthe48-hourFinalNoticeofTerminationofServiceshallbeaddedtothecustomer’saccount.RefertotheMiscellaneousFeeScheduleforcurrentcharges.EverynoticeofterminationofserviceshallincludeitemsofinformationaslistedinSections5.12.010.3above.The48-hourFinalNoticeofTerminationofServicewillalsobeissuedtothirdpartiesandco-signers.5.12.010.4(A)TheDistrictshallmakeavailabletoallitsresidentialcustomersathirdpartynotificationservicewherebytheDistrictwillattempttonotifyapersondesignatedbythecustomertoreceivenotificationwhenthecustomer’saccountispastdueandserviceissubjecttotermination.Thenotificationshallincludeinformationonwhatisrequiredtopreventterminationofservice.TheresidentialcustomershallmakearequestforthirdpartynotificationonaformprovidedbytheDistrictandshallincludethewrittenconsentofthedesignatedthirdparty.Suchnotificationdoesnotobligatethethirdpartytopaytheoverduecharges,norshallitpreventordelayterminationof service.5.12.010.4(B)Ifthecustomerdoesnotmakeapayment,notifytheDistrictofadisputeofabill,ormakeotherarrangementsacceptabletotheDistrictbythelastdayforthepayment,theDistrictwillproceedonschedulewiththetermination.5.12.O1O.4(C)(1)Customerswillnotbeallowedtomakemorethantwo(2)paymentagreementswithinacalendaryear.5.12.O1O.4(C)(2)CustomersunabletomakepaymentbytheduedateoftheirFinalNoticeshallbeallowedtoreviewtheiraccountwithasupervisor.Suchreviewshallincludeconsiderationofwhetherthecustomershouldbepermittedtoamortizetheunpaidbalanceofhisaccountoverareasonableperiodoftimenottoexceed24months.Noterminationofserviceshallbeeffectedforanycustomercomplyingwithanamortizationagreement,ifthecustomeralsokeepstheaccountcurrentaschargesaccrueineachsubsequentbillingperiod.Ifthecustomerdoesnotcomplywiththeamortizationagreement,itwillbeconsiderednon-paymentandtheDistrictwillimmediatelymailaFinalNoticeofTerminationtothecustomerandproceedwithterminationaccordingtoSection5.12.010.4.5.12.010.4(D)Paymentsmadewithuncollectiblefunds(i.e.,non-sufficientfunds,closedaccount,etc.)toavoiddisconnectionorinordertohaveservicereconnected,willbeconsiderednon-paymentandtheserviceshallbesubjecttoimmediateterminationwithoutfurthernotice.Customerswhomakepaymentswithuncollectiblefundstoavoiddisconnectionorinordertohaveservicereconnectedwillbeplacedonacashonlybasisforaperiodof12months.5.12.010.4(E)Theemployeecarryingouttheterminationprocedurewillattempttocontactthecustomerattheserviceaddresspriortodisconnectingservice.Atripchargetodisconnectelectricand/orwaterservice(s)shallbeaddedtothecustomer’saccountregardlessofwhetherornotthedisconnectisactuallypertormed.5.12.010.4(E)(1)Customerssubjecttotheterminationprocedureandwhohavemeterscapableofremotedisconnectandreconnectshallbedisconnectedandreconnectedremotely.Feesshallapplyforremotedisconnects.CustomersenrolledinthePrepaidServiceprogramshallnotbesubjecttoremotedisconnectandreconnectfees.5.12.010.4(E)(2)Nopaymentarrangementswillbemadeinthefield.AllpaymentsmustbemadethroughtheDistrictofficeeitherbyphoneorinperson.OnceaDistrictemployeeissenttoterminateaservice,theservicewillbedisconnecteduntilsuchtimeasthecustomerhasmadeacceptablepaymentarrangementsthroughtheoffice.5.12.010.4(F)TerminationwillnotbemadeonanySaturday,Sunday,legalholidayoranytimeduringwhichthebusinessofficeoftheDistrictisnotopen.5.12.010.4(G)Incaseoftenantswhoseelectricand/orwaterserviceisinthelandlord’sname,the Districtshallmakeeverygoodfaithefforttoinformtheoccupantsbymeansofanotice,whentheaccountisinarrears,thatservicewillbeterminatedin10days.Inanysuchdelinquentsituation,theDistrictwillcomplywithCaliforniaPublicUtilitiesCode16481inimplementingthisterminationofserviceprocedure.5.12.010.4(H)Customerswhohavebeendisconnectedfornon-payment,madepaymentsagainstuncollectiblefunds(i.e.non-sufficientfunds,closedaccount,incorrectbankinformationetc.)toavoiddisconnectionortohaveservicereconnected,havemadearrangementstoamortizetheamountdueorhaveaskedforanextensiontopayapastdueamount,willberequiredtore-establishcreditbypayingthedepositrequiredbyChapter5.02.Alternately,eligiblecustomersmaysignupforthePrepaidServiceprogramoutlinedinchapter5.07.5.12.010.4(I)Acustomerwhotransfersservicefromoneaccounttoanotherandfailstopayhisfinalbillwithin30daysofthefinalbillingdateontheoldaccountwillbesubjecttothedisconnectprocedureathisnewaccount.5.12.015DiscontinuationofResidentialWaterServiceforNon-Payment5.12.015.1PurposeCaliforniaSB998(Stat.2018,Ch.891)amendstheHealthandSafetyCodetoaddresswaterutilityshutoffs(called“discontinuationofwaterservice”inthebill).SB998requiresurbanandcommunitywatersystemstodevelopawrittenpolicyoutliningtheprocessfordiscontinuationofresidentialwaterservicefornon-payment,includingspecificprovisionsforcustomernotificationsandadditionalconsiderations.ThissectionconstitutestheDistrict’swrittenpolicythatcomplieswithSB998.Thispolicyappliesonlytodiscontinuationofresidentialwaterservicefornon-payment.AllothercausesfordiscontinuationofserviceshallbeaddressedwithintheapplicablesectionsofDistrictCode.5.12.015.2NotificationofDelinquencyResidentialwaterserviceconnectionswithpaymentdelinquenciesof60daysorgreateraresubjecttodiscontinuationofservice.AnoticethatserviceissubjecttoterminationshallbeissuedbytheDistrictinaccordancewiththefollowingschedule:(a)Thefirstnoticeofpaymentdelinquencyshallbedeliveredbymailoremail(inaccordancewithcustomeraccountpreferences)nolessthan15dayspriortodiscontinuationofresidentialwaterservice.Iftheaddressspecifiedinthecustomeraccountpreferencesisnottheaddressofthepropertytowhichresidentialserviceisprovided,thenoticealsoshallbesenttotheaddressofthepropertytowhichresidentialserviceisprovided,addressedto“Occupant.”Ataminimum,thenoticeshallincludeallofthefollowinginformation:(i)Thecustomer’snameandaddress.(ii)Theamountofthedelinquency. (iii)Thedatebywhichpaymentorarrangementforpaymentisrequiredinordertoavoiddiscontinuationofresidentialservice.(iv)Adescriptionoftheprocesstoapplyforanextensionoftimetopaythedelinquentcharges.(v)Adescriptionoftheproceduretopetitionforbillreviewandappeal.(vi)Adescriptionoftheprocedurebywhichthecustomermayrequestadeferred,reduced,oralternativepaymentschedule,includinganamortizationofthedelinquentresidentialservicecharges.(b)Aminimumofsevendayspriortodiscontinuationofwaterservice,theDistrictshallprovideasecondnoticeofpaymentdelinquencyeitherbywrittennotice,inperson,ortelephone,orpersonalcontactwithanindividualeighteenyearsofageorolderatthecustomer’spremises,notifyingthecustomerofintenttodiscontinueservice.ThecustomershallalsobeinformedatthistimeoftheDistrict’salternativepaymentschedulesforqualifyingcustomers.(c)Thethirdandfinalnotificationofpaymentdelinquencyandintenttodiscontinuewaterserviceshallbeawrittennotice,physicallydeliveredtotheresidencenotlessthan48hourspriortoshutoff.5.12.015.3QualifyingEconomicHardshipandHealthConsiderationsAresidentialwaterserviceconnectionshallnotbediscontinuedifthecustomer,candemonstrateaqualifyingeconomichardshipandavalidhealthconcern.5.12.015.3(A)Forqualificationsunderthissection,acustomermustprovidetheDistrictwithdocumentationoffinancialhardshipandthecustomeroratenantofthecustomerprovideswrittenverificationfromaprimarycareproviderthatallofthefollowingconditionsaremet:1.Aprimarycareprovidercertifiesthatdiscontinuationofresidentialservicewillbelifethreateningorposeaseriousthreattothehealthandsafetyofaresident;and2.ThecustomerdemonstratesthatheorsheisfinanciallyunabletopayforservicewithintheDistrict’snormalbillingcycle.Thisincludes:a.Ifanymemberofthecustomer’shouseholdisacurrentrecipientofCaIWORKs,CalFresh,generalassistance,Medi-Cal,SupplementalSecurityIncome/StateSupplementaryPaymentProgram,orCaliforniaSpecialSupplementalNutritionProgramforWomen,Infants,andChildren;orb.Thecustomerdeclaresthatthehousehold’sannualincomeislessthan200percentofthefederalpovertylevel.3.Thecustomeriswillingtoenterintoanalternativepaymentschedulewithrespecttoalldelinquentcharges. 5.12.015.3(B)Residentialwaterservicecustomersunderthetermsofanexistingalternativepaymentschedulearesubjecttodiscontinuationofwaterserviceifoneormoreofthefollowingoccur:1.Thecustomerfailstocomplywiththetermsofthealternativepaymentschedule;or2.Thecustomerbecomesmorethan60daysdelinquentonasubsequentwaterutilitybillwhileunderthetermsofanexistingalternativepaymentschedule.5.12.015.4CustomerswithHouseholdIncomeBelow200%oftheFederalPovertyLineConsiderationsForaresidentialcustomerwhodemonstrateshouseholdincomebelow200percentofthefederalpovertyline,theDistrictshalldobothofthefollowing:5.12.015.4(A)Setareconnectionofservicefeeforreconnectionduringnormaloperatinghoursatfiftydollars($50),butnottoexceedtheactualcostofreconnectionifitisless.ReconnectionfeesshallbesubjecttoanannualadjustmentforchangesintheConsumerPriceIndexbeginningJanuary1,2021.Forthereconnectionofresidentialserviceduringnonoperationalhours,thereconnectionofservicefeeshallbeonehundredfiftydollars($150),butnottoexceedtheactualcostofreconnectionifitisless.ReconnectionfeesshallbesubjecttoanannualadjustmentforchangesintheConsumerPriceIndexbeginningJanua1,2021.5.12.015.4(B)Waiveinterestchargesondelinquentbillsonceevery12months.5.12.015.4(C)Aresidentialcustomershallbedeemedtohaveahouseholdincomebelow200percentofthefederalpovertylineifanymemberofthehouseholdisacurrentrecipientofCaIWORKs,CalFresh,generalassistance,Medi-Cal,SupplementalSecurityIncome/StateSupplementaryPaymentProgram,orCaliforniaSpecialSupplementalNutritionProgramforWomen,Infants,andChildren,orthecustomerdeclaresthatthehousehold’sannualincomeislessthan200percentofthefederalpovertylevel.5.12.015.6RestoringResidentialServiceReconnectionofresidentialwaterserviceshallbefacilitatedinaccordancewithDistrictCode,Section5.12.050.5.12.015.67LandlordandTenantConsiderationsIncircumstanceswherealandlordorpropertymanagerareresponsibleforresidentialwaterservicepayment,andthepaymenthasbecomedelinquent,theDistrictshallmake“goodfaitheffort”tonotifytheresident(s)ofthepaymentdelinquencyandintenttodiscontinueservicenotlessthan10dayspriortowaterserviceshut-off.5.12.015.7(A)Priortodiscontinuationofwaterservicefornon-payment,theDistrictshallprovideaqualifyingtenant/rentertheoptiontoestablishanewaccountforwaterservicewithoutbeingrequiredtopayanyamountwhich maybedueonthedelinquentaccount.Thenewwaterserviceaccountholdershallnotberesponsibleforthepreviouslydelinquentaccountbalances.Qualifyingtenants/rentersmustagreetothetermsandconditionsofserviceandprovidedocumentationdemonstratingproofofresidencyandacurrentlease/rentalagreementingoodstanding.5.12.015.8ReportingDistrictstaffshallreportthenumberofannualdiscontinuationsofresidentialserviceforinabilitytopayontheDistrict’sInternetWebsiteandtotheBoard.TheBoardshallpostonitsInternetWebsitetheinformationreported.5.12.015.9ReconnectionFees(TBD)ReconnectionofwaterserviceshallbeadministeredinaccordancewithDistrictCode5.12.050.5.12.015.10AppealsActiontakenunderDistrictCodeChapter6.70maybeappealedinwritingbythewaterutilityserviceaccountholder.WrittenappealsmustbeaddressedtotheDistrict’sGeneralManagerandreceivednolaterthansevendaysfollowingreceiptofthediscontinuationofservicenoticetoavoidwaterserviceshut-offs.TheresidentialwaterserviceinquestionshallremaininserviceuntiltheDistrictrendersadecision.5.12.015.11ApplicabilityThissectiondoesnotapplytotheterminationofaserviceconnectionduetoanunauthorizedactionofacustomer.5.12.015.12PolicyandNoticesThissectionandallwrittennoticesrequiredunderthissectionshallbeprovidedinEnglishSpanish,Chinese,Tagalog,Vietnamese,andKorean.5.12.015.13PostingonWebsiteThissectionshallbepostedontheDistrict’sInternetWebsite.5.12.020Customer’sRequestforDisconnectionofService—Electricand/orWater5.12.020.1TheDistrictshallpermitaphysicaldisconnectionfromtheelectricsystemwhennecessary(1)topermitthecustomertoperformrepairs,modificationsorserviceupgradesonthecustomerpremisesor(2)whenthecustomerwishespowertoremainoffforanextendedperiod.5.12.020.2TheDistrictshallpermitaphysicalwaterdisconnection(shutoffatthewaterbox)onatemporarybasiswhennecessary(1)topermitthecustomertoperlormrepairs,modificationsorserviceupgradesonthecustomerpremisesor(2)whenthecustomerpremisesisnotequippedwithanappropriateshut-offvalveandphysicaldisconnectionisnecessarytoavoidfrozenwaterpipes.Aphysicaldisconnectshallnotbepermittedforanyotherreason.CustomersmayarrangefordisconnectionofservicebygivingadvancenoticetotheDistrict.Customerswillnotbebilledforelectricservicewhiledisconnected. intenttodefraudtheDistrict.5.12.040.2(D)CrossConnection-theDistrictfindsadangerousunprotectedcross-connectionbetweentheDistrict’swatersupplyandanyunapprovedsourceofwater.5.12.040.2(E)Inactiveandforeclosedaccounts—Intheeventallthreeoftheconditionsstatedin5.12.040.2(E)(1)through5.12.040.2(E)(3)existforacustomeraccount,servicemaybedisconnectedandallfuturebillings,includingwater,maydiscontinue.TheDistrictmaydiscontinuebillinguponbecomingawareofthosethreeconditions,however,itisthecustomer’sresponsibilitytonotifytheDistrictandprovidesufficientevidence.Billswillnotbeadjustedretroactivelyandnorefundswillbeissued.AreconnectfeeequivalenttotimeandmaterialsmaybechargedatthetimeofreconnectionpursuanttotheMiscellaneousFeeSchedule.5.12.040.2(E)(1)Thecustomer’sservicelocationisintheprocessofforeclosure,asevidencedbycountyrecordsofanoticeofdefaultornoticeofatrustee’ssale.5.12.040.2(E)(2)Theservicelocationisvacantandunoccupied.5.12.040.2(E)(3)Noelectricandwaterusewasrecordedduringthemostrecentbillingperiod.5.12.040.2(F)FailuretocomplywiththeDistrict’srules-theDistrictmaydisconnectorrefuseserviceifthecustomerdoesnotcomplywiththeDistrictrules,regulations,and/orcodesforreceivingelectricand/orwaterservice.5.12.040.2(G)Abandonedbuildingorresidence-theDistrictmaydisconnectorrefuseservicetoanybuildingwiththeappearanceofbeingabandoned(i.e.,alookofbeingdeserted,windowsbroken,doorsindisrepair,orthegeneralappearanceofnotbeinglivedin,etc.).Suchdisconnectwillremainineffectuntilallconditionsaremetandfeesarepaidregardinganewservice,andtheserviceisinspectedandapprovedbytheproperbuildingauthorities.5.12.040.2(H)Condemnedbuildingorresidence-theDistrictmaydisconnectorrefuseservicetoanybuildingthathasbeencondemnedbytheproperstate,countyorlocalgovernmentalauthorities.Suchdisconnectionwillremainineffectuntilallconditionsaremetandfeesarepaidregardinganewservice,andtheserviceisinspectedandapprovedbytheproperbuildingauthorities.5.12.040.3InthoseinstanceswheretheDistrictdisconnectselectricorwaterservicetoanycustomerwithoutnotice,theDistrictshallnotifythecustomerofthereasonsforthedisconnectionofserviceandthecorrectiveactiontobetakenbycustomerbeforeservicecanbereconnected.5.12.050ReconnectionofElectricand/orWaterService 5.12.050.1Inthoseinstanceswheretheservicetoacustomerhasbeendisconnected,withorwithoutnotice,serviceshallnotbereconnecteduntilsuchtimeasthecustomerhastakenanynecessarycorrectiveaction,asdeterminedbytheDistrict,andpaidallbillsandchargesduetheDistrict,inadditiontoreconnectionchargesasestablishedinthecurrentMiscellaneousFeeSchedule,AppendixC.5.12.050.1(A)Accountsthathavebeendisconnectedfornon-paymentofpastduebalances,failuretomeetthetermsofapaymentagreementorfailuretomeetthetermsofaNoticetoComplywillnotbeeligibleforreconnectonweekends,holidaysorafter4:00p.m.onregularbusinessdays.Arrangementstoreconnectmustbemadethroughthebusinessofficeduringregularbusinesshours.Reconnectionforaccountspaidafter4:00p.m.willbeprocessedonthenextbusinessday.ThisdoesnotincludePrepaidServicecustomers.5.12.050.1(B)PrepaidServicecustomersmayrechargetheiraccountsbymakingapaymentatanytimepursuanttoDistrictprocess.5.12.050.1(B)WhereDistrictpersonnelmustreconnectonsite,uponreconnectoftheelectricmeterthemainbreakerwillbeleftintheoffposition.Itisthecustomer’sresponsibilitytomovethemainbreakertotheonposition.5.12.050.2Customersortheiragentsmayrequestreconnectionofelectricand/orwaterservicesforamaximum48hourperiodinordertoconductinspectionsonaresidence/businessforsale.ThistemporaryreconnectionshallrequireaminimumdepositasprescribedinChapter5.02.NewAccountfeesasestablishedintheMiscellaneousFeesScheduleAppendixCshallalsoapply.Customerswithbalancesowingshallalsoberequiredtopaytheentirebalanceowingpriortoreconnect.5.12.050.3Withinfiveyears,samesizeservice:Ifserviceofthesamesizeisreestablishedwithinfiveyearsofthedateofdisconnect,thecustomershallmakenormalapplicationforserviceasperTitle6.04and/orTitle7.12andpayreconnectfeesbasedontheMiscellaneousFeeScheduleAppendixC,providedtheservicehasnotbeendamaged.Iftheservicehasbeendamaged,thecustomerwillbebilledtheactualcosttoreconnectservice.5.12.050.4Withinfiveyears,upgradeofservice:Ifserviceisre-establishedwithinfiveyearsofthedateofdisconnectandthecustomerrequestsanupgradeoftheservice,thecustomershallmakenormalapplicationforserviceasperTitle6.04and/orTitle7.12.CustomershallpayreconnectfeesbasedontheMiscellaneousFeeScheduleAppendixC,providedtheservicehasnotbeendamaged.Iftheservicehasbeendamaged,thecustomerwillbebilledtheactualcosttoreconnectservice.Additionalconnectionfeesmayapply.Facilitiesfeesshallbechargedforanincreaseinsizeofthenewservicewhencomparedtothepreviousservice. 5.12.050.5Afterfiveyears:Ifserviceisre-establishedafterliveyearsfromthedateofdisconnect,thecustomershallmakenormalapplicationforserviceasperChapter6O4and/orTitle7.12.Customershallberesponsibleforpaymentofcurrentconnectionandfacilitieslees.Nocreditwillbegivenforpreviousfacilitiesfeespaid.TheGeneralManagerisauthorizedtocreditconnectionleesforexistingandoperationalfacilities.5.12.050.6IIconditionsrequiretheuseolabackhoeorotherequipmenttoeflectthedisconnectand/orreconnect,thecustomershallberequiredtopaytheactualcharges,includinglabor,material,equipmentandapplicableoverheadsinlieuolthecustomaryleesetlorthintheMiscellaneousFeeScheduleAppendixC.5.12.050.7Shouldacustomerdecidetoabandonthewaterservicetoavacantparcelortoaparcelwheretheresidence/buildinghasbeendemolished,thecustomershallsignastatementindicatinghisdecisionandagreeingthat,shouldheoranewowner/developerdecidetoreinstatethewaterservice,hewillbesubjecttopayinganyandallconnectionandfacilitiesleesinplaceatthetimeolreinstatement.Theseaccountswillbetreatedasnewconstructionwithnocreditstowardtheirpriorlees.Wherethewaterservicehasbeenabandoned,theparcelwillbeassessedawaterstandbychargeuntilanewserviceisestablishedwiththeDistrict.5.12.060Customer’sResponsibilitywhenElectricand/orWaterServiceisDisconnectedIntheeventacustomer’selectricand/orwaterserviceisdisconnectedasaresultolvoluntarytermination,terminationbrfailuretopaybillsoranyotherreasonsstatedinSections5.12.040.1or5.12.040.2,itshallbethecustomer’sresponsibilitytotakenecessaryprecautionsagainstanyandalldamagetothecustomer’spipes,fixturesandapplianceswhichcouldresultfromsuchtermination.TheDistrictshallnotbeliableforanysuchdamage.Section3.ThatthisresolutionshallremainineffectuntilsupersededbyanotherresolutionamendingDistrictCodeTitle5.12.010or5.12.075.PASSEDANDADOPTEDbytheBoardofDirectorsatameetingdulycalledandheldwithintheDistrictonthefourthdayofDecember,2019bythefollowingrollcallvote:AYES:Directors:Aguera,Finn,Laliotis,VicePresidentBenderandPresidentEllis.NOES:None.ABSENT:None.ABSTAIN:None.TRUCKEEDONNERPUBLICUTILITYDISTRICTByBobEllis,President
