Home My WebLink AboutRES 2019-14 - Board*TRUCKEEDONNERPublicUtilityDistnctResolutionNo.2019-14RequestingCollectionofDonnerLakeAssessmentDistrictAnnualchargesonPlacerCountyTaxRollWHEREAS,theTruckeeDonnerPublicUtilityDistrictonMay2,2001adoptedResolutionNo.2001-09makingdeterminations,confirmingassessmentsandproceedings,orderingtheacquisitionandconstructionofimprovementsandtakingcertainotheractionsrelatingtoDonnerLakeWaterAssessmentDistrictNo.00-1;andWHEREAS,theTruckeeDonnerPublicUtilityDistrictrequeststheCountyofPlacercollectontheCountytaxrollscertainchargeswhichhavebeenimposedbytheDistrictforthefiscaltaxyear2019-2020;andWHEREAS,theCountyhasrequiredasaconditionofthecollectionofsaidchargesthattheDistrictwarrantthelegalityofsaidchargesanddefendandindemnifytheCountyfromanychallengetothelegalitythereof.NOW,THEREFORE,BEITRESOLVEDbytheBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictasfollows:1.TheAuditor-ControllerofPlacerCountyisrequestedtoattachforcollectionontheCountytaxrollsthoseassessmentsattachedhereto.2.TheDistrictwarrantsandrepresentsthattheassessmentsimposedbytheDistrictandbeingrequestedtobecollectedbyPlacerCountycomplywithallrequirementsofstatelaw,includingbutnotlimitedtoArticlesXIIICandXIIIDoftheCaliforniaConstitution(Proposition218).3.TheDistrictreleasesanddischargesCounty,anditsofficers,agentsandemployeesfromanyandallclaims,demands,liabilities,costsandexpenses,damages,causesofaction,andjudgments,inanymannerarisingoutofthecollectionbycountyofanyassessmentsonbehalfofDistrict.4.TheDistrictagreestoandshalldefend,indemnifyandholdharmlessthecounty,itsofficers,agentsandemployees(the“IndemnifiedParties”)fromanyandallclaims,demands,liabilities,costsandexpenses,damages,causesofaction,andjudgments,inanymannerarisingoutofthecollectionbyCountyofanyofDistrict’ssaid1 assessmentsrequestedtobecollectedbyCountyfordistrict,orinanymannerarisingoutofDistrict’sestablishmentandimpositionofassessments.Districtagreesthat,intheeventajudgmentisenteredinacourtoflawagainstanyoftheIndemnifiedPartiesasaresultofthecollectionofoneofDistrict’sassessmentstheCountymayoffsettheamountofthejudgmentfromanyothermoniescollectedbyCountyonbehalfofDistrict,includingpropertytaxes.5.TheDistrictagreesthatitsofficers,agentsandemployeeswillcooperatewiththeCountyinansweringquestionsreferredtoDistrictbyCountyfromanypersonconcerningtheDistrict’sassessmentsandthatDistrictwillnotrefersuchpersonstoCountyofficersandemployeesforresponse.6.TheDistrictagreestopaysuchreasonableandordinarychargesastheCountymayprescribetorecoupitscostsinplacingonthetaxrollsandcollectingtheassessmentsasprovidedbyGovernmentCodesection29304and51800.PASSEDANDADOPTEDbytheBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictatameetingheldwithinsaidDistrictonJune5,2019bythefollowingrollcallvote:AYES:Directors;Laliotis,Finn,Aguera,andVicePresidentBender,andPresidentEllis.NOES:None.ABSTAIN:None.ABSENT:None.TRUCKEEDONNERPUBLICUTILITYDISTRICTBy_______BobEllis,PresidentATTEST:hannaD.Kuhlemier,CMC,DistrictClerk2
