HomeMy WebLinkAboutRES 2016-17 - Boardr”.rTRUCK.EEDONNERPubicUtilityDistrictResolutionNo.2016-17FixingandPlacingaSpecialTaxLevyonCommunityFacilitiesDistrictNo.04-1(Gray’sCrossing)forCollectionbytheCountyofNevadaWHEREAS,onJuly21,2004,theBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictdulyadoptedOrdinanceNo.2004-02,authorizingthelevyofaspecialtaxwithinsaidCommunityFacilitiesDistrictNo.04-1(GraysCrossing)andprovidingameansforcollectionthereof;andWHEREAS,byResolutionNo.9723adoptedNovember5,1997,theBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictapprovedexecutionofacontinuousStandardFormTaxCollectionServicesContractwiththeCountyofNevada;andWHEREAS,theDistricthasnowdeterminedthelandsaffectedtherebyandthechargestobeassessed,leviedandcollectedonthelandsandparcels;andWHEREAS,thetaxesoneachparcelshallbebilledonthesecuredtaxrollbillsforthefiscalyear2016-2017.NOW,THEREFORE,BEITRESOLVEDbytheBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictasfollows:I.ThattheBoardofSupervisorsoftheCountyofNevada,StateofCalifornia,levyaspecialtaxagainsttheparcelsandownersofrecordlistedonthecomputeritemizationofparcelskeptandmaintainedintheAdministrativeServicesDepartmentoftheDistrictandmadeaparthereofbyreference,andthattheCountyAuditorandTaxCollectorbeinstructedtolevyandcollectsaidchargesinthesamemannerasCountytaxesasbylawandinsaidordinanceprovide.UponcompletionandcorrectionofthecurrentlistthroughJune30,2016,acopywillbeforwardedtotheAuditorControlleroftheCounty.2.TheDistrictwarrantsandrepresentsthatchargesimposedbytheDistrictandbeingrequestedtobecollectedbyNevadaCountycomplywithallrequirementsofstatelaw,includingbutnotlimitedtoArticlesXlllCandXIIIDoftheCaliforniaConstitution(Proposition218).1 3ThatacertifiedcopyofthisresolutionbeforwardedtotheCountyAuditoroftheCountyofNevada.PASSEDANDADOPTEDbytheBoardofDirectorsoftheTruckeeDonnerPublicUtilityDistrictatameetingheldwithinsaidDistrictonJune1,2016bythefollowingrollcallvote:AYES:NOES:ABSENT:Directors:Ellis,Bender,Warmerdam,Laliotis,andPresidentAguera.None.None.TRUCKEEDONNERPUBLICUTILITYDISTRICT,tMichaelD.Holley,DistrictClerkATTEST:2
