HomeMy WebLinkAboutRES 2016-28 - BoardResolutionNo.2016-28andTRUCKEEDONNER•dPublicUtilityDistrictAPPROVINGTHEMARTISVALLEYGROUNDWATERBASINSUSTAINABLEGROUNDWATERMANAGEMENTACTALTERNATIVESUBMITTALWHEREAS,theSustainableGroundwaterManagementAct(SGMA”),asamendedandcodifiednCaliforniaWaterCode§10720,etseq.,appliestoallgroundwaterbasinsintheStateofCalifornia;WHEREAS,ThelegislativeintentofSGMAistoprovidesustainablemanagementofgroundwaterbasins,toenhancelocalmanagementofgroundwater,toestablishminimumstandardsforthesustainablegroundwatermanagement,andtoprovidelocalgroundwateragencieswiththeauthorityandthetechnicalandfinancialassistancenecessarytosustainablymanagegroundwater;andWHEREAS,SGMArequires“sustainablegroundwatermanagement”forallgroundwaterbasinsorsub-basinsthataredesignatedashigh-ormedium-prioritybasinsbytheDepartmentofWaterResources(Department”)intheDepartment’sreportentitled“California’sGroundwater:Bulletin118”(“Bulletin118”);andWHEREAS,TheMartisValleyGroundwaterBasin(‘MVGB”)islocatedinbothNevadaCountyandPlacerCountyandhasbeendesignatedbytheDepartmentasBasinNo.6-67andiscurrentlydesignatedamedium-prioritybasin;andWHEREAS,SGMAdefinesa‘localagency”asalocalpublicagencythathaswatersupply,watermanagement,orlanduseresponsibilitieswithinagroundwaterbasin;andWHEREAS,thereareatotalofsixqualifyinglocalagencieswithjurisdictionoverMVGB,whichincludetheCountyofNevada,theCountyofPlacer,theTownofTruckee,theTruckeeDonnerPublicUtilityDistrict,thePlacerCountyWaterAgencyandtheNorthstarCommunityServicesDistrict,collectivelyreferredtoas“Partners”andwhowishtocooperateinsustainablegroundwatermanagementandcompliancewithSGMA;andWHEREAS,SGMAprovidesthatanylocalagencyorcombinationoflocalagenciesoverlyingagroundwaterbasinhavediscretiontobecomeagroundwatersustainabilityagency(“GSA”)forthatbasin;andWHEREAS,SGMArequiresthateither:(1)agroundwatersustainabilityplan(“GSP”)bedevelopedandimplementedbytheGSA;OR(2)ifalocalagencyorcombinationoflocalagenciesbelievesthatanalternativetoaGSPsatisfiestheobjectivesofSGMA,thelocalagencymaysubmitthealternativetotheDepartmentforevaluationandassessmentnolaterthanJanuary1,2017,andeveryfiveyearsthereafter;andWHEREAS,thePartnersbelievethatanalternativetoaGSPwillsatisfytheobjectivesofSGMAbecausethebasinhasbeenoperatedwithinsustainableyieldforatleastthelastI0years,afactthathasbeendocumentedbyahydrogeologistregisteredintheStateofCalifornia;andWHEREAS,thePartnerswishtocollectivelysubmitanalternativetitledMartisValleyGroundwaterBasinSustainableGroundwaterManagementActAlternativeSubmittal(“AlternativeSubmittal”)totheDepartment;andWHEREAS,theTruckeeDonnerPublicUtilityDistricthasledthepreparationoftheAlternative Submittal,withinputandreviewbyallPartnersandahydrogeologistregisteredintheStateofCalifornia;andWHEREAS,theAlternativeSubmittalleveragestheMartisValleyGroundwaterManagementPlanadoptedin2013,theTruckeeRiverOperatingAgreement,enactedunderFederalLawtorestrictandmonitorsurfacewaterandgroundwateruse,andabodyofscientificworkthatdemonstratestheexistenceofsustainablegroundwatermanagementinMVGBforatleastI0years;andWHEREAS,theAlternativeSubmittaladdressesthesixundesirableresultsthathavebeenidentifiedbytheDepartmentandisbelievedbythePartnerstobefunctionallyandsubstantiallycompliantwithSGMAandapplicablerequirementsoftheDepartment;andWHEREAS,basedontheabovefindings,thePartnersintendtosubmittheAlternativeSubmittaltotheDepartmentbytheduedatesetbySGMAofJanuary1,2017,and,subjecttoapprovaloftheDepartment,intendtocontinuesustainablegroundwatermanagementoftheMVGBinaccordancewiththeAlternativeSubmittalandwithoutformationofaGSAorpreparationofaGSP.NOW,THEREFORE,THEBOARDOFDIRECTORSOFTHETRUCKEE-DONNERPUBLICUTILITYDISTRICTDOESRESOLVEASFOLLOWS:Section1.TheAlternativeSubmittalhasbeenreviewedbytheTruckeeDonnerPublicUtilityDistrictandisfoundtoprovideforthelegislativeintentofSGMAandqualifytheMVGBaseligibleforanalternativetoaGSP.Section2.TheAlternativeSubmittal,insubstantiallythesameformasattachedtothisResolution,isOapprovedbytheTruckeeDonnerPublicUtilityDistrictanditisrequestedthattheAlternativeSubmittalbesubmittedtotheDepartmentforreviewandapprovalbytheDistrictonbehalfofallPartners.Section3.SubjecttotheDepartment’sapprovaloftheAlternativeSubmittal,theTruckeeDonnerPublicUtilityDistrictwishestocontinueparticipationinsustainablegroundwatermanagementwiththePartners.Section4.ApprovalofthisResolutionandtheAlternativeSubmittalareexemptfromtheCaliforniaEnvironmentalQualityActbasedonalegislativeexemptionprovidedinSGMA,WaterCodeSection10728.6,andforpurposesofprotectionofnaturalresourcesandtheenvironment,perCEQAguidelinesSections15307and15308.PASSEDANDADOPTEDbytheBoardofDirectorsatameetingdulycalledandheldwithintheDistrictontheseventhdayofDecemberof2016bythefollowingrollcallvote:AYES:Directors:Ellis,Bender,Warmerdam,Laliotis,andPresidentAguera.NOES:None.ABSENT:None.TRUCKEEDONNERPUBLICUTILITYDISTRICTJ.e.tLBerrder,PresidentATTEST:tgMichaelD.Holley,DistrictClerk
