HomeMy WebLinkAboutRES 2011-15 - Board TRUCKEE 11 O � • l Resolution No. 2011 - 15 Application by Truckee Donner Public Utility District Requesting the Local Agency Formation Commission of Nevada County to Take Proceedings for the Annexation of Placer County Parcels WHEREAS, the Truckee Donner Public Utility District desires to initiate proceedings pursuant to the Cortese-Knox-Hertzberg Local Government Reorganization Act of 1985, commencing with Section 56000 of the California Government Code, for the annexation of Placer County Assessor's Parcels referred to in Exhibit "A"; WHEREAS, during the review of the Nevada County LAFCo proposed Sphere of Influence, the District identified and confirmed 45 parcels that are currently being served or are logical to serve by the District, but have never been annexed; WHEREAS, 26 of the identified parcels were extended both electric and water service from 1966 through 1988 with the understanding that the District may pursue annexation in the future; WHEREAS, annexation of the 26 parcels will provide for voting rights in District elections; WHEREAS, annexation of the remaining nineteen parcels would prove to be logical and provide a contiguous jurisdictional boundary; and NOW THEREFORE BE IT RESOLVED by the Board of Directors of the District as follows: 1. Application and proposal are hereby made to the Nevada County Local Agency Formation Commission for the annexation of certain territory to the Truckee Donner Public Utility District. The parcels constituting such territory are listed in Exhibit "A" attached hereto and made reference hereof. 2. The reason for this proposal is to annex parcels receiving service or are logical to serve, but not currently within the District's electric and/or water service territories. 3. This annexation is consistent with the sphere of influence adopted for the Truckee Donner Public Utility District by Nevada LAFCo in 1983. The District's sphere plan was updated in 1998 to comply with new Nevada LAFCo requirements. The District therefore requests that Nevada County LAFCo proceed with this proposal in consideration of the following: the 1 Resolution 2011-15 District documented that it provides sufficient and sustainable service to the parcels, the District serves adjoining properties and the District believes that the proposal is generally consistent with both Nevada and Placer LAFCo's policy objectives. 4. The District certifies that, pursuant to Government Code Section 56663, owners of 26 parcels within the affected territory consented to annexation through development agreements. The Truckee Donner Public Utility District, as the only agency that will gain or lose territory as a result of this annexation, hereby consents to a waiver of the final protest hearing by Nevada County LAFCo. 5. Truckee Donner Public Utility District staff is hereby authorized and directed to file a certified copy of this resolution with the Executive Officer of the County of Nevada Local Agency Formation Commission. EFFECTIVE DATE OF THE ORGANIZATION: December 18, 2014 l tg l Kristina Berry,W, ecu ' e er Date Placer Local Agency Formation Commission PLACER LOCAL AGENCY FORMATION COMMISSION Resolution No. 2012-1 Approving an Annexation to the Truckee Donner Public Utility District (LAFCO No. 2012-2—Truckee Donner Service Public Utility District Alignment) Whereas, an application was filed with the Executive Officer of the Placer Local i Agency Formation Commission in accordance with the Cortese-Knox-Hertzberg Local i Government Reorganization Act of 2000 (Government Code Section 56000 et seq.--the "Act") for the annexation of certain territory as described in Exhibits 1 and 2, attached hereto and incorporated herein by reference (the "Territory") to the Truckee Donner Public Utility District (the "District"); and, Whereas,.the application was filed by resolution of the Truckee Donner Public ! Utility District, which is a multi-purpose district providing electrical and water service with separate distinct boundaries within the district, and Whereas, the Executive Officer has reviewed the proposal and prepared a report, including recommendations thereon, the proposal and report having been presented to and considered by the Commission; and, Whereas, this Commission held a hearing and received all oral and written comments, objections, and evidence with respect to this proposal and, has considered the report of the Executive Officer and all other relevant evidence and information; and, Whereas, the matter has been duly considered by the Commission in accordance with the full requirements of the Act; Now, therefore, the Placer County Local Agency Formation Commission does hereby determine, resolve and order as follows: 1. The Territory is legally inhabited under Section 56046 of the Act in that more than twelve (12) registered voters reside in the territory. 2. The Territory is located within the existing sphere of influence for the District. 3. The Commission determines that this annexation is consistent with the Placer LAFCO Policies and the provisions of the Act, including but not limited to Section 56668 thereof. 4. In accordance with Government Code section 56886(t), the Territory shall assume and be subject to all previously authorized charges, fees, assessments or taxes levied by the Tahoe Donner Public Utility District as of the Effective Date. In accordance with Placer County Board of Supervisors Resolution No. 80-142 and agreement between the County and the District, there shall be no exchange of revenues i from the property tax base or the property tax increment. 9. This approval is subject to payment of all necessary fees and charges of Placer LAFCO and such requirements of other agencies. i 10. This approval is subject to the following terms and conditions: 11. 1. The nine parcels included as area 7" as shown in the attached map and legal description (Exhibit 1 and 2) shall be deleted from the proposal. 2: A revised map and legal description shall be submitted for review by the County Surveyor removing the nine parcels shown in area 7" as shown on the attached Exhibits 1 and 2. 12. The application was made pursuant to a resolution of the district, all registered voters and,landowners within the affected territory were provided written notice, and no subject- agencies has submitted written opposition to a waiver of protest hearings. Pursuant to the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000, Section 56663(d), the Commission waives the requirement for a protest hearing. 13. The Executive Officer is authorized upon satisfaction of all conditions of this approval to prepare and execute a Certificate of Completion in accordance with Government Code section 57200. .The date of issuance of the Certificate of Completion shall constitute the Effective Date of this change of organization.
