Holley Date: August 03, 2011 Subject: Discussion of the LAFCo Sphere of Influence Plan Update/Municipal Services Review 1. WHY THIS MATTER IS BEFORE THE BOARD The Board needs to be aware of Local Agency Formation Commission (LAFCo) matters. 2. HISTORY The District had received a proposed Sphere of Influence (SOI) to review from the Nevada County LAFCo in May. Based on a review of the proposed SOI, the District felt that LAFCo's proposal was not in the best interest of the District non its rate payers. As a result the Board awarded a contract to Baracco and Associates at the July 6th meeting to help the District develop a preferred SOI for both the electric and water utilities. There are four general issues in regards to Nevada County LAFCo, these include: Issue 1: The LAFCo staff proposed SOI and the District's preferred SOI are substantially different; Issue 2: There are parcels served by the District that were never annexed by the District and are therefor not within the District's service territory; Issue 3: There are four areas believed by District staff to be within the District's jurisdictional boundaries that LAFCo records show as outside the jurisdictional boundaries (un-annexed); Issue 4: There may be some parcels that should have voting rights in District elections that cannot currently vote and there are parcels that should not have voting rights that may be able to vote in District elections. These four issues were discussed at the July 6, 2011 Board meetinq. 3. NEW INFORMATION LAFCo held a special meeting on July 21, 2011 to continue discussion on the District's Sphere of Influence (SOI). District staff was able to present an abbreviated preferred SOI request. After much discussion the LAFCo Board agreed that LAFCo staff working with District staff would be able to resolve Issues 2-4, annexation of parcels, jurisdictional boundaries, voting issues. In regards to the substantially different SOIs, and the understanding that an SOI can be developed to include resources, the LAFCo Board directed LAFCo staff to proceed with CEQA documents based upon the proposed SOI. The next steps are as follows: 1) Resolution for annexation (approved tonight) 2) Submit an application for the annexation of parcels 3) Work with LAFCo staff to resolve jurisdictional boundaries 4) SOI out for 60 day review, comment period 4. FISCAL IMPACT There is no fiscal impact associated with this workshop item. 5. RECOMMENDATION Review and provide comment on this report. Michael D. Holley General Manager
