WHY THIS MATTER IS BEFORE THE BOARD This item is before the Board as District Code changes and/or additions require Board approval. 2. HISTORY The District has been involved with the emergency of Plug -In Electric Vehicles (PEV's) for almost a decade. This includes the installation and operation of a charging station behind the District Office at Meadow Park using a California Energy Commission grant, the addition of a PEV Toyota Rav 4 to the District's fleet, and the recent presentation to the Board of a PEV public access charging project. In addition, our community is witnessing a dramatic increase of PEV's from both our local residents and visitors. In response to the increase in PEV's in our community and the District's plans to install PEV public access charging stations, it is now appropriate to include Plug -In Electric Vehicle Charging into District Code. This new draft section, Title 9 Plug -In Electric Vehicle Charging, addresses both Customer -Owned Plug -In Electric Vehicle Charging and District -Owned Plug -In Electric Vehicle Public Access Charging and creates the governance for establishing PEV charging rates and policies. Staff presented a draft version of Title 9 at the regularly scheduled District Board meeting on July 15, 2015. 3. NEW INFORMATION The proposed final Title 9 of District Code "Plug -In Electric Vehicle Charging ", which has not been changed since the Board workshop, is Attachment 1. 4. FISCAL IMPACT There is no direct fiscal impact with adding Title 9 Plug -In Electric Vehicle Charging to District Code. Future District expenditures on PEV public access charging stations will be funded by a combination of District rates, grants, and end -user fees. 5. Holley General Manager Attachment 1 TITLE 9 PLUG-IN ELECTRIC VEHICHLE CHARGING CHAPTERS: 9.01 General 90010010 General 9.019020 Definitions 9.02 Customer -owned plug-in electric vehicle charging 9.02.010 Residential 9.02.010 Commercial 9.03 District -owned plug-in electric vehicle public access charging )o03.010 PEV Public Access Charging Program 9.03.020 PEV public access charging station installation 9.03.030 PEV public access charging station End User rates 9.03.040 PEV public access charging station rules and parking enforcement 9.03.050 PEV public access charging station End User disputes CHAPTER 9.01 GENERAL 9.01.010 General These Plug -In Electric Vehicle (PEV) Charging Policies have been adopted by the District in the interest of efficiency, economy, reliability and safety in regulating and administrating the distribution of electricity to our Customers and End Users for PEV charging and for the District's ownership and operation of PEV public access charging stations. 9.01.020 Definitions The following definition will apply to all other chapters of the District Code where the terms are used whether capitalized or not: 9.01.020.1 "End User" End User is a Customer or member of the public who chooses to use the District's PEV public access charging stations. CHAPTER 9.02 CUSTOMER -OWNED PLUG-IN ELECTRIC VEHICLE CHARGING 9.02.010 Residential The electric service to residential customers for PEV charging shall be as per the requirements for residential electric service in District Code including Title 5 (Customer Relations) and Title 7 (Electric Service). 9.02.020 Commercial The electric service to commercial customers for PEV charging shall be as per the requirements for commercial electric service in District Code including Title 5 (Customer Relations) and Title 7 (Electric Service). CHAPTER 9.03 DISTRICT -OWNED PLUG-IN ELECTRIC VEHICLE PUBLIC ACCESS CHARGING 9.03.010 PEV Public Access CharFm FM Program This program will install District -owned PEV public access charging stations based on End User demand and the General Manager's evaluation of sufficient utilization, investment payback, and availability of funds. Initial funding will come from District rates, external grants, and public access charging users' (End User) charging revenue with the long-term goal of fully covering the costs of this program through End User and other external revenue sources. District funds will be allocated through the regular budget process and the General Manager's authority. Rates will be established for End Users along with rules for usage and parking enforcement. A process for End User disputes is established. 9.03.010.1 Allowable uses of PEV Public access charging stations The District's PEV public access charging stations shall only be used for PEV transportation charging and End Users may not use the them for any other purpose. 9.03.020 PEV Public access charging station installation 9.03.020.1 Charging Station License Agreement The District may install PEV public access charging stations on District -owned property or through agreements with land -owners. When working with land -owners, a Charging Station Lease Agreement shall be executed by the General Manager which describes the District's facilities and associated items and sets forth the terms of the agreement to locate PEV public access charging stations on the land -owner's property. 9.03.020.2 PEV public access charging station installation standards District -owned PEV public access charging stations are an extension of the District's electric distribution system and the installation, operation, and maintenance are subject to the applicable requirements from Title 7 (Electric Service). The District will operate and maintain the facilities to electric utility standards and may choose to sub -contract this function. 9.03.020.3 PEV public access charging station equipment and design The District will work collaboratively with other electric utilities and the PEV public access charging market to maximize the benefits of joint -action, to leverage existing designs and standards, and use best efforts to install facilities which may be used by the greatest number and variety of PEVs. 9.03.030 PEV Public access charging station End User rates The District shall independently establish rates for PEV public access charging users (End User). The rates shall be established with a long-term goal of fully covering the capital, operating, maintenance, and administration costs of the program through End User and other external revenue sources. 9.03.030.1 PEV public access charging non -collusion The District shall apply a policy of non - collusion with any other providers in the District's service territory in establishing its PEV public access charging rates. 9.03.040 PEV Public access charging station rules and parking enforcement The District will establish rules for PEV public access charging users (End User) to ensure that interest of efficiency, economy, reliability and safety are considered. The District will also work with land- owners and/or parking authorities to propose practical parking enforcement restrictions that will incentivize drivers to only use PEV public access charging station parking spaces for PEV charging, and to move their vehicle after they have had sufficient time to achieve a substantial charge of their vehicle's battery. Enforcement of these restrictions will ensure that PEV public access chargers are available to as many PEV drivers as possible and to optimize charger use. 9.03.050 PEV Public access charging station End User disputes In the event of a dispute resulting directly from the use of the public access charging station by an End User, the End User shall be given the ability to file a written complaint with the District's Conservation Manager. Should the End User wish to dispute the resolution of the complaint by the Conservation Manager, they may request an investigation of the dispute by the General Manager. After notification by the End User that an investigation is requested, the General Manager shall make m appropriate investigation and shall report the result to the End User within 10 working days or explain why the result will take longer to report and thereafter report the result to the End User. Disputes relating to the location of the PEV public access charging facility, the PEV charging equipment selected, the installation, or the rate charged to the End User will not be investigated.
