Conduct a Public Hearing on Proposed Water Rates
1. WHY THIS MATTER IS BEFORE THE BOARD
Conduct a public hearing to consider setting water rates for FYI through FY20.
2. HISTORY
California's Proposition 218 was adopted in 1996 and became effective in 1997. It is
also known as the "Right to Vote on Taxes Act."
The adoption of new water rates is subject to the requirements of Proposition 218.
• Rates must be based on actual cost of service (HDR Engineering, Inc water
rate study completed);
• On June 29, 2015, the District mailed
owners of proposed changes in rates;
• Tonight, the District is holding a public
the mailing of the notices;
• Rates can be adopted for five years;

• The proposed change in rates is considered rejected if written protests are
received from a majority of the affected rate payers and property owners; and
• The ordiance will become effective 30 days after adoption and implemented

The District hired HDR Engineering to complete an update to the 2013 water rate
study.
On May 20, 2015, Shawn Koorn, HDR Engineering presented to the Board the water
rate update study including 5-year rate adjustment to prudently fund operating and
capital needs, maintain minimum reserve targets, and fund state mandated
conservation impacts. The Board directed staff to proceed with a the Proposition 218
process to consider the proposed maximum water rate structure of: increases of 6% in
2016, 5% in 2017, and 3% in 2018, 2019, and 2020.
On June 3, 2015, the Board approved the notice of proposed water rates maximums
for 2016 through 2020 and set a public hearing for August 19, 2015, at 6:OOpm to
receive and consider public input.
On July 15, 2015, staff presented the Water Department's Capital Improvement
Program.
On June 29, 2015, public hearing notices mailed to water customers and property
owners.
On August 5, 2015 and August 12, 2015, a legal notice of the public hearing was
published in Sierra Sun.
3. NEW INFORMATION
The remaining steps to complete the requirements of Proposition 218 and the
District's policies regarding adoption of an ordinance are:
• Hold the public hearing on increasing water rates for 2016 through 2020
(tonight);
• Consider the public comments; as of August 14, 2015, five written protests
(Attachment 1) were received by the District;
• Consider adopting the water rate increase ordinance (tonight - Action Item 15)
4. FISCAL IMPACT
There is no fiscal impact with this agenda item.
5. RECOMMENDATION
Conduct a public hearing to consider maximum water rates for 2016 through 2020.

and I am the rate payer.

I am against the rate increase and wish to enter a prop 218 NO vote.
As a side note, I am distressed that you hired HDR Engineering, Inc. to substantiate
another rate increase. I am familiar with their dealings, since early 2013, with
Sacramento Suburban Water District (SSWD). HDR Engineering has a record of
inaccuracies. They are highly biased, use unrealistic basic premises, and are
prone to exaggerated projections. At the conclusion of their consultation, SSWD
elected to modify HDR Engineering's recommendations. Two years later, HDR
Engineering's predictions for SSWD have proven inaccurate.

Subject: Water rate increases
This letter is in opposition to the proposed water rate increases.
My first concern it the fact that you are asking fora 20% increase in our water rates over the next five
years. This is excessive.
Nay second concern is being a second home owners we almost never exceed our monthly minimum charge
in water usage. It is unfair to penalize those of us that use the least amount of water.

We are protesting the proposed water rate increase for 2016 through 2020.
We have owned a vacation home in Tahoe Donner since 1991 and are able to use our home
about three to four weeks each year.
It is our understanding that 80% of the homes in Tahoe Donner are not occupied full time
yet these owners are responsible for paying a monthly rate of $57.28 which equates to
paying $687.36 per year for water that is not used.
If you wish to be fair and equitable to all homeowners in Tahoe Donner, as well as other
vacation home developments in Truckee, water rate should be based on the amount of
water used.
Those who live in the Truckee area part time should not be forced to subsidize the water
rate increase for the 20% that live there full time
