Subject: Consideration to Accept the November 8, 2016 Election Results
1. WHY THIS MATTER IS BEFORE THE BOARD
District Board elections are held every two years, during even years, to elect the
Truckee Donner Public Utiltiy District's Board of Directors.
2. HISTORY
On even years during the General Election, the District consolidates our elections with
Nevada and Placer Counties. The consolidation of elections is done to ensure
compliance with election law and saving money for the rate payers.
In the spring of 2016, the Board approved resoultions to consoldiate with the
respective counties. The District had three open seats; Joe Aguera, Bob Ellis, and
Jeff Bender.
July until August, perpective candidates pulled papers with the counties to run for
office. At that point, there were four candidates for the three positions. All three
encombunts filed for re-elelction in addition, Jim Hemig filed.
3. NEW INFORMATION
The Counties are required by election law to certify special district election results on
the Monday prior to the first Friday in December (November 28, 2016). This
requirement proceeds the law that requires special district's to seat their board on the
first Friday in December (December 2, 2016),
On November 8, 2016, a General Election was held. That evening election results
were posted with only about 45% of the vote being counted at the poles. Placer
County tallied the votes and there were only 13 votes between Jim Hemig and Joe
Aguera, Nevada County talled the votes at there were 34 votes between the same
candidates. During the subsequent weeks, mail in ballots and absentee ballots were
counted.
The County certifies the election to the state after a 30 day canvas (December 6,
2016, this year), and this year it so happens that the special district election law
proceeds the 30 day canvas and the fact that election day fell on the 8th causing a
perfect storm and a strain on both Nevada and Placer Counties.

As of the start %J the week, November 28th, both Couties were starting the count on
provisional ballots. Provisional ballots are ballots where voters are allowed to vote
even though there is an inconsistency with the voter record (i.e. address changes, or a
person is not registered to vote to name a couple inconsistencies). Those ballots
need to be counted prior to the certification of the elections. Placer County had over
8,000 provisional ballots to be counted, they could not give us a count for our race.
The anomaly of the dates and the closeness of the District's race has perplexed
election officials in both counties, neither knowing what to do with the election code
regarding special districts. Placer County deciding to not call the special district race
until December 6, 2016. Nevada County deciding to determain the race on December
2, 2016, and of course keeping in compliance with certiying the election to the
Secretary of State. Thus creating a state of uncertainty for our third and fouth place
candidates.
So after a long drawn out election season, the County of Nevada including Placer
County votes, has provided a declaration of determination that, Jeff Bender, Bob Ellis,
and Joe Aguera were elected to serve four year Board terms.
4. FISCAL IMPACT
Sufficient funds exist for the election in the FY16, and is estimated to be $15,000.00.
5. RECOMMENDATION
Accept and direct staff to file the November 8, 2016 Election Results.
