Subject: Consideration of a Resolution to Adopt Revisions to the District's
Conflict -of -Interest Code
1. WHY THIS MATTER IS BEFORE THE BOARD
This matter involves conducting the mandated biennial review of the District's Conflict -
of -Interest Code and amending the Code. Board action is required to make changes to
the Code.
2. HISTORY
At the September 5, 2012 Board meeting, a revised Conflict -of -Interest Code was
presented to the Board. The California Political Reform Act requires every multi -county
agency to review and amend its Conflict -of -Interest Code every two years if
circumstances require. An amendment was needed to add the new position of
IT/SCADA Engineer and change the title for the Geographic Information System
Coordinator to IT/GIS Operations Manager.
A 45 day comment period was established as of September 5, 2012, and a public
hearing date was set for November 7, 2012. The original draft amendment and notice
of intention to amend were filed with the Fair Political Practices Commission (FPPC).
On October 30, 2012, the FPPC informed the District that additional changes were
required to prevent people from having to disclose financial interests that are beyond
the scope of their duties and responsibilities with the District. The law requires that any
District positions which involve the making or participation in the making of decisions
which may foreseeably have a material financial effect on any financial interest need to
be designated positions within the Code.
At the November 7, 2012 meeting, the Board established a new 45 day written
comment period for the additional revisions to the Conflict -of -Interest Code. A Public
Hearing was not required. A copy of the revised Conflict -of -Interest Code was made
available to each employee affected by the draft code and to interested persons.
3. NEW INFORMATION
The District's 45 day comment review period ended on December 22, 2012. The
FPPC's 45 day comment period ran through December 31, 2012. The District received
the FPPC formal notification of approval for the Revised Conflict -of -Interest Code.
The revised red lined Conflict -of -Interest Code is included as Attachment 1 and final
version as Attachment 2. The revisions were as follows:
• Deleted section 2.52.005, Financial Interests of Employees
• Formatting changes to conform with FPPC
• Add new position of IT/SCADA Engineer
• Change in title of the Geographic Information Systems Coordinator to IT/GIS
Operations Manager
• Disclosure category reclassifications for Finance & Accounting Manager,
Contract Administrator, Customer Services Manager, IT/GIS Operations
Manager, IT/SCADA Manager and Senior Accountant/Analyst
The resolution adopting amendments to the District's Conflict -of -Interest Code is
included as Attachment 3.
4. FISCAL IMPACT
There is no fiscal impact in this matter.
5. RECOMMENDATION
Adopt Resolution 2013-02 amending the District's Conflict -of -Interest Code in District
Code Title 2.
