RESOLUTION NO. 8115
OF THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
APPROVING SPECIFICATIONS AND
AUTHORIZING THE SOLICITATION OF PROPOSALS
OF INSURANCE

WHEREAS, the Board of Directors of the Truckee Dormer Public Utility
District has determined thai it is in the best interest of the District to
continue to be insured with respect to all of its activities; and
WHEREAS, the Board of Directors of the Truckee Donner Public Utility
District has determined that it should obtain the broadest form of coverage
at the least expense possible;
NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the Truckee
Donner Public Utility District does hereby approve specifications for insurance
needs as described in Exhibit "A" attached hereto and made a part hereof.
BE IT FURTHER RESOLVED that the President of the Board of Directors of the
Truckee Donner Public Utility District is hereby directed to solicit proposals
of insurance based on the specifications as described in Exhibit "A" and that
the date and time established for the bid opening is March 6, 1981, at 4:00 P.M.
PASSED AND ADOPTED by the Board of Directors of the Truckee Donner Public
Utility District at a meeting held within said District on the 2nd day of
February, 1981, by the following roll call vote;
AYES: Duffy, Kuttel, Maass and Huber.
NuES: None.
ABSENT: Sutton.

TO WHOM IT MAY CONCERN.
The Truckee Dormer Public Utility District desires to receive quotations for
insurance as detailed in specifications which may be obtained by contacting
Mary Chapman, Office Manager at the above address.
In order to receive consideration, proposals shall be submitted on or before
4:00 P.M., March 6, 1981, in a sealed envelope clearly marked "Insurance *Pro-
posals, ■' for implementation on March 11, 1981. Proposals must be made on
Proposal Sheets made a part of the specifications.
This is an informal request for proposals, and award may be made on factors
other than cost, if in the opinion of the Truckee Donnor Public Utility Dis-
trict the best interests of the District will be served.
The information outlined in the specifications has been assembled for the con-
venience of the parties making proposals and is to our knowledge complete and
accurate, but any errors or omissions will not operate to the prejudice of the
Truckee Donne* lubii•: Utility District. It will be assumed that those making
proposals have made investigations as to be fully informed as to the extent
and character of the hazards and of the requirements of the specifications.
The statistics wera compiled as of January, 1981. If Brokers, Agents or
Companies wish to inspect the properties, arrangement can be made to do so
by calling Mrs. Chapman at (916) 587-3896.
PLEASE NOTE: Proposals are to bo made on Proposal Sheets.
Any deviations from the specifications are to be
clearly set forth.
ATTACH SPECIMEN COPY OF POLICIES TO P.E USED TO
PROVIDE COVERAGE. This includes all Endorsements
that will be attached to the policy form that in
any way expands or restricts the policy form terms
and conditions.

II. LIAPILTTY CO'/FPAGES - Including Automobile Physical Damage.
I
Currently the District has a Comprehensive General and Automobile Liability
policy with no deductible. The District wishes to investigate the addition
of Public Ehtity Coverage to include Errors and emissions. In order to
obtain this coverage the District is requesting a quotation on a Special
Public Entity Difference in Conditions form to be paired with the Comprehensive
Liability policy. In this way coverage will be provided for Errors and
emissions and Liability imposed by law including Chapter 1681 of the
California Statutes of 1963.
If for some reason you (the Broker or Agent) are unable to obtain a quotation
for this coverage, permission is granted to make a proposal with only Comprehen-
sive General and Automobile Liability coverages, but you do so with the under-
standing that Public Entity coverage is more desirous and that this will be
a factor in dec Ming amoung proposals.

A. COMPREHENSIVE GENERAL LIABILITY - applying to Bodily Injuries, Personal
Injuries and Property Damage.
The following changes must be made to the form:
1. Definition of "occurrence" shall read: The word "occurrence" means
an event or a continuous or repeated exposure to conditions which
causes Injury to person(s) or damage to property during the policy
period that is neither knowingly or intentionally caused by or at
the direction of the insured.
?. Definition of Insured shall be changed to read:

Each of the following
(a) the named insured;
(b) any officer, servant or employee of the named insured;
(c) any member of the governing body of the named insured;
(d) pny member of boards or commissions of the named insured.
3. Notice of Occurrence shall be changed to read:
"Upon the happening of an occurrence,written notice shall be given
by or on behalf of the insured to the company or any of its autho-
rized representatives as soon as practicable after an officer or
an employee in charge of reporting such occurrences to the insurance
companies shall have knowledge of such occurrence. Such notice
shall contain particulars sufficient to indentify the insured and
also reasonably obtainable information with respect to the time,
place and circumstances of the occurrence, the names and addresses
of the injured and ofavailable witnesses.

Cancellation Clause shall be changed to provide 90 days written notice
of cancellation 5f ^nrooiied by ihe Company.
Territory: Coverage shall be worldwide.
Limits of Liability shall be changed to provide single limit coverage.
Proad Form Property Damage Endorsement shall be attached and the
exclusion of damage to leased promises shall be modified to provide
that "property rented to or leased to the Insured is not covered
if the insured has assumed liability for damage to or destruction
of such property, unless the Insured would have boon liable in the
absence of such assumption of liability."
Definition of "incidental contract" shall be expanded to include any
written contract.
Liquor law exclusion shall be ELIMINATED.
Products and Completed Operations will be covered.
Exclusions relating to Property Damage from explosion, collapse and
underground, coming within the "xcu" classifications, shall bo
ELIMINATED.
Personal Injury Ehdorsement exclusions relating to Contractual Liability
(a) and Employees (c) shall be ELIMINATED.

FOLLOWING FOR!! excess of Primary Single Limit en the Underlying coverages.
Coverage in to be excess of the Comprehensive General Liability, Compre-
hensive Automobile Liability and Special Public Entity Difference in
Conditions. If your proposal is for an Umbrella form provide a retained
limit of $10,000 any uninsured exposure. Deductible shall not be applicable
to the defense of any uninsured exposure.
**Please note that this excess coverage is to be "FOLLOWING FORM."**
That means same terms and conditions as the underlying policies with
no exclusions ov limitations of coverage not on the underlying policies.
