HomeMy WebLinkAboutRes 8168RESOLUTION NO. 8168 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT ,10 I ORDERING ANNEXATION OF LAND TO SAID DISTRICT - C.S.A. 19 ANNEXATION - PLACER COUNTY - WHEREAS, heretofore the owners of the land and property hereinafter described petitioned the Truckee Donner Public Utility District and Placer County Local Agency Formation Commission for the annexation of said land and property to the Truckee Donner Public Utility District, and said petition was heretofore filed with the Executive Officer of the Placer County Agency Formation Commission; and I WHEREAS, said petition complied with the requirements of law,, and notice of the filing of said petition was duly given in the manner required by law; and WHEREAS, the Executive Officer of said Placer County Local Aqency Forma- tion Commission has reviewed said petition and a hearing by said Commission was held in accordance with and as required by law; and WHEREAS, said Local agency Formation Commission, by Resolution No. 1-81 has approved and ordered said annexation of the property hereinafter described (copy of said Resolution being attached hereto as Exhibit "A", and made a part hereof) j NOW, THEREFORE, BE IT RESOLVED by the Board of Directors that there be and there is hereby annexed to the Truckee Donner Public Utility District all that certain land and property situated in the County of Placer, State of California, and more particularly bounded and described as follows, to wit: See Exhibit "B" attached hereto BE IT FURTHER RESOLVED by the Board of Directors of the Truckee Donner Public Utility District that said annexation is subject to the following terms and conditions: 1. Said land shall be subject to District rules and regulations, charges made, and assessments levied pursuant to the provisions of the Irrigation Dis- trict law to pay for outstanding obligations of District, and also shall be subject to all assessments, tolls, charges and standby charges hereinafter levied by District for any District purpose. 2. The land will be entitled to water from the District. Such service will be subject to the rules and regulations of the District regulating water service and payment of tolls and charges established by the District for such service. 3. All items on the specific deficiency list prepared by District Staff in response to a May 1, 1980, inspection shall be corrected at the sole cost of C.S.A. 19. 4. C.S.A. 19 shall pay to Truckee Donner Public Utility District a set- up charge of $25.00 for each active service at the time of annexation. I 5. All accounts shall be current at the time of annexation. 6. Any and all pending service applications shall fully comply with the standards of the Truckee Donner Public Utility District. 7. Any and all pending developments shall be reviewed and be approved by the Truckee Donner Public Utility District prior to construction start. 8. The County of Placer shall transfer to the Truckee Donner Public Utility District accumulated maintenance funds in the approximate amount of $21,000.00 upon completion of the annexation procedings. BE IT FURTHER RESOLVED by the Board of Directors of the Truckee Donner Public Utility District that the Secretary of the Board cause copies of the AV \ order, certified by the Secretary of the Board of Directors, to be mailed to the Executive Officer of the Local Agency Formation Commission of the County of Placer for filing with the Offices of the Recorders of the Counties of Nevada and Placer, State of California. PASSED AND ADOPTED at a regular meeting of the Board of Directors of the Truckee Donner Public Utility District duly called and held in said District on the 8th day of September, 1981, by the following roll call vote: AYES: Corbett, Duffy, Kuttel and Haass.
