HomeMy WebLinkAboutRes 8170RESOLUTION NO. 8170 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT $ I ORDERING ANNEXATION OF LAND TO SAID DISTRICT PONDEROSA RANCHOS ANNEXATION - PLACER COUNTY WHEREAS, heretofore the owners of the land , petitioned the Truckee Donner Public Utility Dii Agency Formation Commission for the annexation ■ Truckee Donner Public Utility District, and sail with the Executive Officer of the Placer County sion ; and nd pi petty hereinafter described trict and Placer County Local t slid land and property to the petition was heretofore filed Local Agency Formation Commis- WHEREAS, said petition complied with the requirements of law, and notice of the filing of said petition was duly given in the manner required by law; and WHEREAS, the Executive Officer of said Placer County Local Agency Formation Commission has reviewed said petition and a hearing by said Commission was held in accordance with and as required by law; and WHEREAS, said Local Agency Formation Commission, by Resolution No. 8-81 has approved and ordered said annexation of the property hereinafter described (copy >f said Resolution being attached hereto as Exhibit "A", and made a part of this order; • NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public Utility District that there be and there is hereby annexed to the Truckee Donner Public Utility District all that certain land and property situated in the County of Placer, State of California, and more particularly bounded and described as follows, to wit: See Exhibit "B" attached hereto BE IT FURTHER RESOLVED that said annexation is subject to the following terms and conditions: 1. Said land, shall be subject to District rules and regulations, charges made, and assessments levied pursuant to the provisions of the Irrigation Dis- trict law to pay for outstanding obligations of District, and also shall be subject to all assessments, tolls, charges and standby charges hereinafter levied by District for any District purpose. I 2. The land will be entitled to water from the District. Such service will be subject to the rules and regulations of the District regulating water service and payment of tolls and charges established by the District for such service. 3. The developers of the Ponderosa Ranchos Subdivision accomplish the following or provide the equivalent: a) Refit the Ponderosa Palisades Booster to provide greater capacity in accordance with the full development demands of the proposed subdivision. b) Refit the Ponderosa Palisades Booster to provide greater capacity in accordance with the full development demands of the proposed subdivision. c) Provide a loop tie between Ponderosa Drive and Evergreen Circle to provide additional distribution system capacity. d) Provide an 8" diameter loop construction between the pro- posed developments and Silvertip Drive. e) Provide a 100,000 gallon surface mounted storage tank at an approximate elevation of 6,390 MSL with appropriate piping. f) Provide an 8" diameter loop construction connection with the off-site loop described in Item (d) above. g) Provide a 6" diameter loop construction throughout. -1- flV I h) Provide a duplex booster station designed to function with Item (e) above. i) Provide a surface mounted 200,000 gallon steel storage tank and 150' x 150' deeded parcel for the booster in (h) above and the tank. j) Facility fees shall be charged to the developments in accordance with the schedules and analysis provided in the guidelines, rules and regulations. k) The developers shall be required to provide the neces- sary submissions as detailed in the guidelines and standards prior to the issuance of a will serve letter that would be tied to the development agreement as provided in the rules, regulations, standards and guidelines. BE IT FURTHER RESOLVED by the Board of Directors of the Truckee Donner Public Utility District that the Secretary of the Board cause copies of the order, certified by the Secretary of the Board of Directors, to be mailed to the Executive Officer of the Local Agency Formation Commission of the County of Placer for filing with the Offices of the Recorders of the Counties of Nevada and Placer, State of California. PASSED AND ADOPTED at a regular meeting of the Board of Directors of the Truckee Donner Public Utility District duly called and held in said District on the 8th day of September, 1981, by the following roll call vote: I AYES: Corbett, Duffy, Kuttel and Maass. S-Sl LAI CO RESOLUTIOM APPROVING ANNEXATION I Conducting Agency: File Number; Siiort Form Designation: Trucfce-e-Donncr Public Utility District 81-3 Ponderosa Ranches Annexation WHEREAS, an application for annexation to the District was filed with thu Executive Officer of the Commission; and WHEREAS, said application was presented to the Commission in the form and manner provided by law; NOW, THEREFORE, the Commission DOSS HEREBY RESOLVE, DETERMINE AND ORDER as follows: 1. Subject to the terms and conditions herein specified, the annexation is approved. 2. The boundaries of said territory approved for annexation are described In Exhibit 'A" attached. The conducting agency .shall use this boundary descripticn in all subsequent proceedings. 3. Said territory approved for annexation is uninlabited ;md given the short form designation of the Pondsrosa Ranches Annexation. 4. The Truckee-Donner Pubtte I'tilily District is designated as the conducting agency, and the Hoard of Directors is authorized to complete the annexation in accordance with the District ReorganUation Act. j.
