The project leader personnally and on behalf of the recipient shall agree to: (1) Certify that the equipment is in first-class working condition. (2) Be fully responsible for the equipment and indemnify the California Energy Commission against any damage or loss while in control or possession of the user, and "molee restitution upon demand by CEC should ariy damage or loss occur. (3) Practice due care in using said loaned equipment for public safety, and defend, hold harmless, protect and indemnify the California Energy Commission as owner from and against all claims or demands for damages, including claims for property damage, personal injury, or death resulting from equipment transportation or use or from acts on the part of the recipient or recipient's employees while said equip- ment Is in the control or possession of recipient. (4) Assume all responsibility for installing, reading, dismantling and returning the loaned instruments to the California Energy Commission. (5) Collect and record wind data on a weekly basis. (6) Provide the California Energy Commission with the wind resource data on a monthly basis. A minimum of three to six months of wind measurements will be required by the California Energy Commission to estimate the long-term resource at a given site, depending on the region and season in which data is taken. Normal data collection will be for a period of one year. (7) Assume full responsibility for establishing a wind fann development plan. (8) Return all equipment to the CEC or to a site determined by CEC and agreeable to recipient. The California Energy Commission shall: (1) Loan the equipment to the recipient. {?) Advise the recipient on where to install the loaned instruments. (3) Provide technical and economic advice for the recipient's wind farm development plan. (4) Calculate the seasonal and annual average windspeed and estimate the annual energy available based on data received from the recipient. f. If measurements at any site show little potential, the California Energy Commission reserves the right to remove the loaned instruments. Any changes to this agreement must be in writing and approved by both parties. I
