RESOLUTION NO. 8221
OF THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
RESCINDING RESOLUTIONS 7856 AND 7863 REGARDING
SUSPENSION AND/OR TERMINATION OF EMPLOYEES
WHEREAS, on March 1, 1982, at a regular meeting of the Board of Directors
of the Truckee Donner Public Utility District the Board adopted and established
a Civil Service System and Disciplinary Procedure; and
WHEREAS, the Board previously adopted, on December 13, 1978, Resolution
No. 7863, which established an interim procedure for the termination of em-
ployees, and on November 13, 1978, Resolution No. 7856, which also establish-
ed procedures for the termination or suspension of employees; and
WHEREAS, it appears that Resolution No. 7863 was intended to supercede
Resolution No. 7856, and further that Paragraph No. 11 of Resolution No. 7863
provides that "The Resolution shall remain in effect until amended by the Beard
of Directors or until a Civil Service System is adopted which includes provi-
sions for the termination of classified employees)" and
WHEREAS, the Civil Service System and Disciplinary Procedure adopted pur-
suant to Resolution No. 8210 was intended to automatically supercede both Res-
olution No. 7856 and 7863; and

WHEREAS, the District's counsel have reviewed Resolution No. 7856 and
Resolution No. 7863, advised the District that neither resolution provides
those procedural due process protections for employees as required by State
and Federal law, and have advised the District that in order to avoid any
confusion as to which Civil Service System or Disciplinary Procedure is in
effect and otherwise to make the public record clear, Resolution No. 7856
and Resolution No. 7863 should be rescinded;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee
Donner Public Utility District that Resolution No. 7856 and Resolution No. 7863
are hereby rescinded, effective as of February 28, 1982, and that the procedures
adopted pursuant to Resolution No. 8210 are the effective District procedures
for disciplining District employees who fall within its terms.
PASSED AND ADOPTED by the Board or Directors of the Truckee Donner Public
Utility District at a meeting held within said District on the 19th day of Ap-
ril, 1982, by the following roll call vote:
