HomeMy WebLinkAboutRes 8236RESOLUTION NO. 8236 OF THE TRUCKEE DONNER PUBLIC UTILITY DISTRICT DECLARING DISTRICT INTENT TO ANNEX FOUR PARCELS OF REAL PROPERTY IN MARTIS VALLEY (LATRELL CROSBY) / I WHEREAS, the jwners of those certain four parcels of real property, as described and set forth in Exhibit "A", attached hereto and incorporat- ed herein, commonly known as Parcel A, Parcel B, Parcel C, and Parcel D, Latrell and Martha Crosby, husband and wife, have requested that such parcels be served by the Truckee Donner Public Utility District; and WHEREAS, the Board of Directors has determined that it is in the best interests of the District to annex the property into the District's service area, and WHEREAS, the District intends to develop a permanent looped water system in the vicinity of Old Mill Ro id and Frond Road which traverse such parcels; and WHEREAS, thj District'.. General Manager has begun negotiations with the owners uo determine a .Mutually acceptable method of serving the parcels mentioned above; and WHEREAS, tha Board of Directors has determined that in order to ul- timately develop a permanent looped Hater system in the vicinity of the parcels descrioed above, certain easements for the installation and main- tenance of wat ^r lines will be necessary across and concerning those par- cels and I WHEREAS, the owners have proposed that they transfer to the District the easements required by the District for the installation of its future permanent looped water system, in exchange for lawful consideration; and WHEREAS, the District has determined that the fair market value of the easements as described in Exhibit "A", attached hereto and incorporated here- in by reference is equal to the value of connection and facilities fees for the four parcels; and I WHEREAS, it has been determined that an Environmental Impact Report may be required to accomplish the annexation; and WHEREAS, the owners have agreed to pay for the necessary state and county proce.-.sing fees to accomplish the annexation; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public Utility District that annexation of Parcels A, B, C and D as described in Exhibit "A" proceed with the following conditions: 1. That the owners of Parcels A, B, C and D transfer to the District the easements described in Exhibit "A" attached hereto and incorporated herein by reference, in order to provide for the future installation of a permanent looped water system within the District's service area. 2. The District shall purchase from the owners, those certain easements across and upon owners' Parcels A, B, C and D, as more particularly and accurately described in Exhibit "A" attached hereto and incorporated herein, in exchange for the sum of $3,400, which sum shall be paid to owners upon recording of the easements. 3. That the District shall process the necessary Environmental Impact Reports in connection with the annexation process. 4. That owners will pay for all necessary etate and cessing fees. lunty pto- 5. That oiwners shall be solely responsible for the eXtM all water lines existing upon then property la tin- of Old Mill Road and Frond Road to such water improvements as may be installed to service their parcels, upon applica- tion for water services. fi- I 6. That an agreement detailing the factual and legal relation- ship between the parties, and the terms as outlined in this resolution, shall be prepared by the District and recorded with the Placer County Recorder's Office along with the ease- ments as described above. 7. That owners shall be responsible for payment to the District of all necessary connection and facilities fees in the approx- imate amount of $3,400, upon completion of the annexation pro- cess, recordation of easements, and application for water ser- vice. S. That the District's line extension reimbursement policy, as in- corporated in Rule 21 of the District's Rules and Regulations, shall remain in full force and effect. 9. That development of any improvements upon Parcels A, B, C and D will be subject to the availability of sewer hookups as pro- vided within the policies and rules established by the Truckee Sanitary District. 10. That any developers of improvements up n Parcels A, B, C and D shall provide adequate fire flow protection In conformance with the requirements established by the Truckee Fire Protection Dis- trict. I 11. The owner shall file an ippropriate application for annexation with the Local Agency Formation Commission of the County of Placer.
