OF THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
ORDAINING THE ACCEPTANCE OF THE 79-1 WATER SYSTEM IMPROVEMENTS

WHEREAS, the plans, specifications and contract documents for the
various construction schedules of the 79-1 Water System Improvements were
reviewed and approved by the Board of Directors on August 4, 1980; and
WHEREAS, there have been ongoing construction, legal and operational
problems associated with completion of the improvements, culminating in
bankruptcy proceedings involving Dana W. Knudsen and Knudsen Construction
Company; and
WHEREAS, completion of the project has been undertaken with the as-
sistance of S s H Insurance Company, the project surety; and
WHEREAS, the construction has been completed by Knudsen Construction
Company, et al; and
WHEREAS, the District Consulting Engineer has provided periodic inspec-
tion of the construction in progress by the contractor and the District Con-
sulting Engineer has provided a written recommendation that work be accepted
by the Truckee Donner Public Utility District for ownership operations and
maintenance subject to some minor deficiencies; and
WHEREAS, the subject improvements were financed through the sale of
Revenue Bonds to the U. S. Department of Agriculture, Farmer's Home Admin-
istration;

NOW, THEREFORE, BE IT ENACTED by the Board of Directors of the Truckee
Donner Public Utility District as follows:
1. The District reserves any and all legal and equitable rights
and remedies available to it, arising out of that certain con-
struction contract between the District and Dana W. Knudsen, dated
November 17, 1980, relating to the Project 79-1 Water System Im-
provements, and all bonds and insurance related thereto.
2. The physical improvements to the Water System as constructed
and described in the Plans, Specifications and Contract Documents
shall be accepted by the Truckee Donner Public Utility District
for addition to the Plant, Operation and Maintenance.
3. This Ordinance shall become effective thirty days from the
date of adoption by the Board of Directors. The Clerk of the
District shall immediately cause a copy of this Ordinance to be
published once in the local newspaper and copies shall be posted
in at least three public places within the District boundaries.
PASSED AND ADOPTED by the Board of Directors of the Truckee Donner
Public Utility District at a meeting thereof called and held in the District
office on the 16th day of August, 1982, by the following roll call vote:
