Workshop: Drought and Executive Order N-7-22

RECOMMENDATION:
Review and provide feedback to staff on the provisions within Governor Newsom's
Executive Order N-7-22 (EO N-7-22) as it relates to continuing drought conditions in
California and the impacts to the District's water utility services.
BACKGROUND:
As we enter the third straight year of drought, with two especially dry years of rain/snow, the
Governor's office and Water Resource Control Board are preparing drought actions plans that
will be taken during the first half of 2022.
The Governor's Executive Order N-7-22 issued on March 28th 2022 (Attachment 1) responds
to continuing drought conditions currently present in the State of California, and directs the
State Resource Control Board to perform specific actions. The Governor's Executive Order
states that "the 21 st century to date has been characterized by record warmth and
predominantly dry conditions, and the 2021 meteorological summer in California and the rest
of the western United States was the hottest on record."
The Executive Order issued by Gov. Newsome includes several emergency compliance
actions that could potentially affect the operations of the District. Many of these are in draft
form with a more formal adoption expected later in May.
A paraphrased list of the order is provided below:
• The governor "encourages Californians to understand and track the amount of water
they use" as denoted in the Saveourwater.com campaign.
• Directed State Water Resources Control Board to adopt, by May 25th, 2022,
emergency regulations that address the following:
o Urban water suppliers will submit preliminary annual water supply and demand
assessment by June 1, 2022
o If Urban water supplier has adopted a Water Shortage Contingency Plan

(District adopted by BOD June 2, 2021), then the Urban Water Supplier will
implement Level 2 by a date that will be defined by the Water Board.
• Actions against "non-functional Turf" which is defined as "turf that is ornamental and
not otherwise used for human recreation purposes such as school fields, sport fields
and parks".
SWRCB RESPONSE:
On April 20t" 2022 the State Water Resource Control Board prepared a draft response to the
Governor's Executive Order EO N-7-22 (Attachment 2). The SWRCB stated they will utilize
the "actions developed by Department of Water Resources for the State Water Resources
Control Board," these actions were detailed in public water systems Water shortage
contingency plans. The District has a standing Water Shortage Contingency Plan (WSCP),
Adopted June 2, 2021 (Attachment 3), the District will be required to implement Stage II of
the WSCP by June 10t" 2022. Which will include the following criterion
• Expanded information campaigns
o Information about the increased drought actions via:
■ Paper mail
■ Bill Inserts
■ Website
• Limit landscape irrigation to no more than two days per week and prohibiting landscape
irrigation between the hours of 10:OOam and 6:OOpm
• Banning water waste and specific practices that lead to water waste
o Runoff onto non -irrigated areas, walkways, roadways, parking lots, or other hard
surfaces.
o Unfixed leaks and broken or defective plumbing and irrigation systems
o Use of hoses not fitted with automatic shut-off nozzles
o Serving of water in restaurants except on request
o Laundering towels and linens daily in hotels without providing guest an opt -out
option.
• Potable water prohibited for the irrigation of non-functional turf at commercial,
industrial, and institutional sites.

FISCAL IMPACT:
There is no direct fiscal impact associated with this item. However, the final and formal
adoption of the SWRCB drought
