County LAFCo Processes and
Consideration of Professional
Services Agreement

• District received a new proposed SOI from Nevada County
LAFCo
• Bruce Baracco helped develop the preferred 2011 SOI
• Preferred SOI submitted to Nevada County LAFCo on June
10th
• Issue 1: The LAFCo proposed SOI and the District's
preferred SOI are substantially different
• Issue 2: There are parcels legitimately served by the District
that were never annexed by the District and are therefore
NOT within the District's service territory
• Issue 3: There are four areas believed by District staff to be
within the District's jurisdictional boundaries that LAFCo
records show as outside the jurisdictional boundaries
• Issue 4: There may be some parcels that should have
voting rights that currently cannot vote in District elections;
and conversely parcels that should not have voting rights do

• Approve the Consulting Services Agreement with Baracco
Associates totaling $22,675 plus a 10 percent change order
authorization for an amount not to exceed $24,642.50
• With respect to Issue 2, non -annexed areas, if the Board
wishes to annex properties currently served by the District,
direct staff to begin the annexation process
• If the Board decides not to annex properties currently
served by the District, direct staff not to pursue annexation
• Issue 3, if the Board wishes to correct the jurisdictional
boundaries to be compliant with previous Board actions,
direct staff to pursue this issue with the desired outcome for
these areas to be accepted by LAFCo as being in the
District's jurisdictional boundaries
• If the Board does not wish to correct the jurisdictional
boundaries to be compliant with Board actions, direct staff
not to pursue this issue
