Monthly Activity Report
During the month of December ’00 I focused my attention on four related areas:
1. Vectren Communications Services; Design, Plans & Specifications and Construction
Management
2. AON Financial Services
3. Litigation: TDPUD vs. USA Media Group, LLC; USA Media Group, LLC vs. TDPUD
4. Nevada Local Agency Formation Commission
5. Proposed Pole Contact License Agreement
Working with Vectren staff I have prepared a “scope of services” for the design, preparation of
plans & specifications of the District’s proposed broadband infrastructure. A report relating to
this work will be coming to the Board during the month of February.

Per Board direction I have met with AON Financial Services staff in order to prepare a “risk
mitigation” measure for the District’s proposed broadband infrastructure. I have brought a
report to the Board, including a letter of intent from AON, relating to the risk mitigation plan, and
am currently working to secure an underwriter for the policy.

Litigation in Federal Court continues between the District and USA Media. In addition, I am
working with Washington, DC counsel regarding USA Media’s filing at the Federal
Communications Commission.

Pursuant to our meeting with the Nevada County Local Agency Formation Commission, and
questions posed by Nevada LAFCo Executive SR Jones, General Manager Peter Holzmeister
and I have prepared and submitted a document to the Commission. Additionally, Jim Mass
and Peter Holzmeister met with LAFCo staff and select Commissioners to discuss the
document. As of this writing, we have been advised that LAFCo will hold a public hearing on
January 18 relating to our application to provide telephone and other means of communication.
Further, we have been told that the LAFCo committee working with SR Jones will recommend
approval of our application with specific conditions. I will bring a report to the Board regarding
these conditions in February.

On December 14, 2000, I sent USA Media a second letter regarding the District’s proposed
Pole Contact License Agreement. As you may recall I originally sent this document to USA
Media in August of last year. To date District staff has not received any form of response from
USA Media.
