HomeMy WebLinkAbout8 Pioneer Commerce Center Easement Agenda Item # Public Utility District Memorandum To: Board of Directors From: Neil Kaufman Date: September 14, 2006 Subject: Abandonment of Public Utility Easement at Pioneer Commerce Center Phase III 1. Why this matter is before the board: Board Authorization is required to abandon an easement. 2. History: There is an existing public utility along the eastern and southern boundaries of the Pioneer Commerce Center Phase M project described by ORNC 2002-040397. The location of the existing easement is shown on the attached Exhibit B. During plan review for this project, the developer requested that the District relocate this easement from the property line to the planned roadway serving the project (Trails End Road). There are no existing District facilities along the property line and staff agreed that relocation of the easement would be appropriate. 3. New information: The subdivision map for the Pioneer Commerce Center Phase /// granted a new public utility easement to the District along Trails End Road (which is a private road). In addition, the property owners for Pioneer Commerce Center Phase I// recently granted the District an access easement along Trails End Road allowing ingress/egress to the adjoining District property to the west. Therefore, abandonment of the old easement along the property line will not impact the District. 4. Recommendation: The Board of Directors adopt a resolution officially abandoning the existing public utility easement described by ORNC 2002-040397. Attachments: Exhibit A Exhibit B Draft Resolution TRUCKEE w, R Public Utility District Resolution No. 2006 - XX AUTHORIZING AN ABANDONMENT, AS TO ITS INTEREST, OF THE PUBLIC UTILITY EASEMENT DESCRIBED IN ORNC 2002-040397 WHEREAS, the developer of Pioneer Commerce Center Phase 3 has requested abandonment of the public utility easement described in ORNC 2002-040397; WHEREAS, District staff has investigated the matter and determined that such abandonment would not cause the District problems in providing electrical or water service; WHEREAS, the developer of Pioneer Commerce Center Phase 3 has granted a new public utility easement and access easement that is functionally equivalent to the easement described in ORNC 2002-040397; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Truckee Donner Public Utility District as follows: That the President of the board be authorized to execute a statement indicating that the Truckee Donner Public Utility District has no objection to the abandonment of the public utility easement described in Exhibit"A" and as shown on the attached map, which has been entitled Exhibit "B".
