Holley Date: July 02, 2008 Subject: Resolution Granting General Manager Authority to Provide Emergency Temporary Residential Water Services 1. WHY THIS MATTER IS BEFORE THE BOARD A resolution is needed to authorize the General Manager to provide emergency temporary residential water services. 2. HISTORY From time to time, emergency water service is needed at properties adjacent to the District's water service territory. 3. NEW INFORMATION The General Manager is requesting authorization to provide water for emergency temporary residential water service. To qualify for this service, the General Manager must determine that an emergency exists that has potential to impact human health, that the proposed service location is adjacent to our existing water service area, that providing this service will not adversly impact existing customers, and that water will be used for a period not to exceed 6 months at individual residences. Should the General Manager exercise this authority, he will report back to the Board at the next regular meeting. RECOMMENDATION Authorize the Board President to sign the attached resolution granting the General Manager authority to provide emergency temporary residential water services. Michael D. Utility D R0solu io nn No. 2008 - XXX Resolution Granting General Manager Authority to Provide Emergency Temporary Residential Water Services WHEREAS,the Board of Directors of the Truckee Donner Public Utility District wishes to authorize the General Manager to provide emergency temporary residential water services provided that: 1. The emergency temporary residential water service is adjacent to the Truckee Donner Public Utility District's water service area; 2. The General Manager has determined that there is a water emergency on the property; 3. The General Manager has determined that there is a eminent risk to human health; 4. The emergency temporary water to be provided is for domestic residential services only; 5. The emergency temporary water service provided is for a period not to exceed 6 months; 6. The recipient of the emergency temporary residential water services is required to enter into a Temporary Water Service Agreement; and 7. The General Manager shall report to the Board of Directors at its next available meeting any actions taken under this Resolution and whether the Board shall either concur or not concur with those actions. If the Board does not concur, then the emergency temporary residential water services shall be immediately removed. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Board of Directors of the Truckee Donner Public Utility District that the General Manager be authorized to provide emergency temporary residential water services provided that all of the following conditions are satisfied: 1. The emergency temporary residential water service is adjacent to the Truckee Donner Public Utility District's water service area; 2. The General Manager has determined that there is a water emergency on the property; 3. The General Manager has determined that there is a eminent risk to human health; 4. The emergency temporary water to be provided is for domestic residential services only; 5. The emergency temporary water service provided is for a period not to exceed 6 months; 6.
