Subject: Extension of Employment after Retirement for the Interim General Manager
1. WHY THIS MATTER IS BEFORE THE BOARD
The Board has requested that the Interim General Manager continue to provide his
specialized skills to the District and he has agreed to remain employed on a full time basis
through February 8, 2008 and as needed through June 30, 2008.
2. HISTORY
The Board began recruitment in August 2007 for it's new General Manager to replace
its retiring General Manager. During the recruitment period the Board decided to retain an
Interim General Manager and John L. Ulrich was hired into this temporary position.
3. BACKGROUND and NEW INFORMATION
The District has received approval, dated January 14, 2008 from CaIPERS to allow for
the extension of employment of the Interim General Manager through June 30, 2008.
4. RECOMMENDATION
Approve the modification to the present employment agreement, approve the as
needed agreement for employment through June 30, 2008 and authorize the Board President
to sign_7 agree a on behalf of the Board.

�y Your duties ; scope of responsibilities will be limited to those specifically

5. pensated at the rate of One Hundred Dollars ($100.00) per hour,
less a quired and authorized withholdings, for each hour of service you
provide as an employee during the term of this Agreement as the sole and
complete compensation for your services. You will be paid at the same time and
in the same interval as other District employees.
6. Except as expressly provided for in this letter, you will not receive any benefits or
accruals related to your employment with the District. For example, and without
limitation, you will not receive health, eye or dental insurance, retirement benefits
and will not accrue vacation or sick leave benefits.

7. Any necessary travel shall be at the sole request of the Board. The District will
reimburse you for reasonable travel, lodging and expenses in accordance with
District policy while conducting official business upon your submittal of receipts
in accordance with District policy, provided that you establish a reasonable
budget for these items and have it approved by me in advance of incurring any
expenses.
8. In accordance with California law, the District will defend, indemnify and hold
you harmless from and against any action, lawsuit, claim, liability, loss, damages
or judgment arising from your employment with the D 'rict.

This is in response to your agency's request for an extension to the post-retirement
employment of John L. Ulrich beyond the 960 hour maximum. The request Indicates he
was appointed as the Interim General Manger under GC 21221(h)on August 13, 2007
and he will exceed the 960 hour maximum for fiscal year on January 20, 2008. Your
agency has requested an extension through June 30, 2008.
Your request complies with the requirements of Section 21221(h)of the Calhbmia
Government Code. Therefore, Mr. Ulrich may continue employment as the Interim
General Manager until June 30, 2008. He may not be appointed to this position again
under GC 21221(h)for the Truckee Donner Public Utility District. Appointments made
under this subdivision may not exceed a total of 12 months.
