Subject: Real Property and Easements Accepted and Abandoned during 2007
1. WHY THIS MATTER IS BEFORE THE BOARD
Resolution 90-03 directs the General Manager to submit a report to the Board of Directors in
January of each year regarding real property and easements accepted by the District and
easements abandoned by the District is the previous calendar year.
2. HISTORY
On January 2, 1990, the Board of Directors passed Resolution 90-03. A copy of this resolution
is attached. This resolution delegates certain responsibilities regarding the acceptance and
abandonment of easements of the General Manager. It also requires an annual report.
For the past five years, there has been confusion at both the Board and Staff level regarding the
need to bring certain easement abandonment requests to the Board for action. These requests
had been brought to the Board for action even though that responsibility had been previously
delegated to the General Manager.
3. NEW INFORMATION
In early 2007, this resolution was brought to Peter Holzmeister's attention. He then directed
District staff to comply with its requirements.
During the year 2007, the District accepted easements on 28 parcels of real property. These
are indicated in Table 1. There were four easements abandoned by the District. These are
shown on Table 2.
4. SOURCE OF FUNDING
This is a report to the Board as per Resolution 90-03. There is no funding required.
5. RECOMMENDATION
There is no recommend n. This report is provided at the direction of the Board as per
Resolution 90-03.

RESOLUTION NO. 9003
OF THE
TRUCKEE DONNER PUBLIC UTILITY DISTRICT
AUTHORIZING THE DISTRICT GENERAL MANAGER TO
ACCEPT, SIGN AND RECORD CERTAIN RECORDABLE DOCUMENTS
WHEREAS, from time to time various developers and/or other persons
offer to or are required to transfer easements and other interests
in real estate to the District, or to agree to the recordation of
a notice with respect to their property or to otherwise restrict
their property; and
WHEREAS, from time to time the District is asked to release or
abandon easements which it owns but does not need; and
WHEREAS, Government Code Section 27281 provides that the county
recorder shall not accept certain of the above-described documents
for recordation without receiving a resolution from the District
authorizing the recordation of same; and
WHEREAS, Government Code Section 27281 further provides that the
District may, by resolution, authorize one or more of its officers
to accept and/or consent to the recordation of such documents; and
WHEREAS, by authorizing the District's General Manager to accept
and/or consent to the recordation of such documents, it will not
be necessary for the District Board to consider the approval of
each such document at a Board meeting and adopt a resolution
consenting thereto;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the
Truckee Donner Public Utility District that it hereby authorizes
the General Manager of the District as follows:
1. To accept and consent to the recordation of any deeds
granting easements or any other interest in real estate
to the District.
2. To accept and consent to the recordation of any deeds or
other documents which grant a restriction on the
grantor's real property, in favor of the District.
3. To accept and consent to the recordation of any notices
which the District has requested the grantor record
against the grantor's real property.
4. To accept, sign, and consent to the recordation of any
deeds releasing or abandoning easements owned by the
District that the General Manager determines are not
needed by the District.
5. To sign letters on behalf of the District, directed to
Nevada or Placer County, informing such counties of the
District's willingness to release or abandon public
Utility easements if the General Manager determines that
such easements are not needed by the District.
6. Further, the General Manager is hereby directed to submit
to the Board of Directors in January of each year a
report of all real property and easements accepted or
abandoned during the previous year.
PASSED AND ADOPTED by the Board of Directors of the Truckee Donner
Public Utility District at a meeting duly called and held on the
2nd day of January 1990 by the following roll call vote:
AYES: Aguera, Corbett, Curran and Maass.
NOES: None.
ABSTAIN: Sutton.
